Justice R.BASANT\n\n Dated :12\/07\/2007\n\n O R D E R\n                                     R.BASANT, J.\n\n                                  ----------------------\n\n                                B.A.No.4228 of 2007\n\n                            ----------------------------------------\n\n                      Dated this the 12th  day of July 2007\n\n\n                                       O R D E R\n<\/pre>\n<p>       Application   for   anticipatory   bail.     The   petitioner   is   the   fourth<\/p>\n<p>accused.     Crime   has   been   registered   against   five   accused   persons<\/p>\n<p>including the petitioner on the basis of a private complaint filed by the<\/p>\n<p>defacto   complainant   &#8211;   manager   of   a   bank   before   the   learned<\/p>\n<p>Magistrate, which complaint was referred to the police under Section<\/p>\n<p>156(3) Cr.P.C.\n<\/p>\n<\/p>\n<p>       2.      The   crux   of   the   allegations,   submits   the   learned   Public<\/p>\n<p>Prosecutor is that the first accused had approached the bank to raise<\/p>\n<p>a loan.  He had produced a partition deed to show the  title of an item<\/p>\n<p>of property.  Encumbrance certificate was also obtained and produced<\/p>\n<p>before   the   bank.     A   liability   was   created   on   the  strength   of  the   said<\/p>\n<p>property.     The   loan   amount   was   not   repaid.     It   is   alleged   that<\/p>\n<p>subsequent to the creation of the loan, the first accused had sold the<\/p>\n<p>property,   offered   as   security,   to   various   other   persons.     This   was<\/p>\n<p>allegedly done by him with fraudulent and objectionable motives.  The<\/p>\n<p>petitioner is the Sub Registrar.   The allegation against him is that he<\/p>\n<p>is a party to the registration of such post-pledge documents to various<\/p>\n<p>persons by the first accused.\n<\/p>\n<p>\n<span class=\"hidden_text\">B.A.No.4228\/07                             2<\/span><\/p>\n<p>       3.     The   learned   counsel   for   the   petitioner   submits   that   the<\/p>\n<p>allegations,   even   if   accepted   in   toto,   cannot   at   all,   indicate   any<\/p>\n<p>complicity of the petitioner.   When the title holder, who has pledged<\/p>\n<p>the   property,   decides   to   sell   the   property   to   some   others,   the<\/p>\n<p>Registrar  has no obligation to prevent  such registration, submits the<\/p>\n<p>learned counsel for the petitioner.  In these circumstances, directions<\/p>\n<p>under Section 438 Cr.P.C may be issued to save the petitioner of the<\/p>\n<p>undeserved trauma of arrest and incarceration in prison, submits the<\/p>\n<p>learned counsel for the petitioner.\n<\/p>\n<\/p>\n<p>       4.     The learned Public Prosecutor does not oppose the prayer<\/p>\n<p>for   anticipatory  bail.    He   only   prays  that  appropriate  directions  may<\/p>\n<p>be  issued  to  ensure  that  an  efficient  and  expeditious  investigation  is<\/p>\n<p>conducted.\n<\/p>\n<\/p>\n<p>       5.     I   am   satisfied   in   the   circumstances   of   this   case   that<\/p>\n<p>directions   under   Section   483   Cr.P.C   can   be   issued   in   favour   of   the<\/p>\n<p>petitioner.  Appropriate conditions can, of course, be imposed.<\/p>\n<p>       6.     In the result, this petition is allowed.  Following directions<\/p>\n<p>are issued under Section 438 Cr.P.C in favour of the petitioner.<\/p>\n<p>       i)     Petitioner   shall   surrender   before   the   learned   Magistrate<\/p>\n<p>having jurisdiction at 11 a.m on 19\/7\/2007.\n<\/p>\n<\/p>\n<p>       ii)    He  shall   be  released  on  regular   bail  on  condition that  he<\/p>\n<p>executes   a   bond   for   Rs.25,000\/-(Rupees   twenty   five   thousand   only)<\/p>\n<p><span class=\"hidden_text\">B.A.No.4228\/07                              3<\/span><\/p>\n<p>with  two solvent  sureties  each  for  the  like sum to the satisfaction of<\/p>\n<p>the learned Magistrate.\n<\/p>\n<\/p>\n<p>       iii)    The   petitioner   shall   make   himself   available   for<\/p>\n<p>interrogation  before  the investigating   officer    between  10  a.m  and   1<\/p>\n<p>p.m   on   20\/07\/2007   and   thereafter   as   and   when   directed   by   the<\/p>\n<p>investigating officer  in writing to do so.\n<\/p>\n<\/p>\n<p>       (iv)    If   the   petitioner   does   not   appear   before   the   learned<\/p>\n<p>Magistrate   as   directed   in   clause   (i),   directions   issued   above   shall<\/p>\n<p>thereafter   stand   revoked   and   the   police   shall   be   at   liberty   to   arrest<\/p>\n<p>the  petitioner   and   deal   with   him   in  accordance   with  law,   as  if   these<\/p>\n<p>directions were not issued at all.\n<\/p>\n<\/p>\n<p>       (v)     If   he   were   arrested   prior   to   19\/7\/2007,   he   shall   be<\/p>\n<p>released   on   bail   on   his   executing   a   bond   for   Rs.25,000\/-   (Rupees<\/p>\n<p>twenty   five   thousand   only)   without   any   sureties,   undertaking   to<\/p>\n<p>appear before the learned Magistrate on 19\/7\/2007.<\/p>\n<pre>\n\n\n\n\n\n\n\n\n                                                              (R.BASANT, JUDGE)\n\njsr\n\n\n                             \/\/ True Copy\/\/          PA to Judge\n\n\n<span class=\"hidden_text\">B.A.No.4228\/07    4<\/span>\n\n\n<span class=\"hidden_text\">B.A.No.4228\/07    5<\/span>\n\n\n       R.BASANT, J.\n\n\n\n\n\n         CRL.M.CNo.\n\n\n\n\n\n            ORDER\n\n\n\n\n\n21ST DAY OF MAY2007\n\n\n<\/pre>\n","protected":false},"excerpt":{"rendered":"<p>Kerala High Court K.P.Kunhikannan vs State Of Kerala Rep.
