Asha Devi W\/O Munna Ram R\/O Vill.- Jigna, P.S.- Dinara,\n         Distt.- Rohtas\n                                               -----------\n<\/pre>\n<p>                For the Petitioner:-             Mr. Vivekanand Kumar, Adv.<br \/>\n                For the State:-                  Mr. Rajeev Lochan, Adv.<br \/>\n                For the Respondent no. 12 :- Mr. Ranvijay Narain Singh, Adv.\n<\/p>\n<p>                                                 Mr. Tej Narayan Singh, Adv.\n<\/p>\n<p>                                      &#8212;&#8212;&#8212;-\n<\/p>\n<p>3.   22.09.2011             Heard learned counsel for the petitioner,<\/p>\n<p>                  the State and for respondent no. 12.<\/p>\n<p>                            The petitioner is aggrieved by the order<\/p>\n<p>                  dated 24.11.2009 unseating her from the post of<\/p>\n<p>                  Anganwari Sewika on account of irregularities in<\/p>\n<p>                  the selection process and directing fresh selection.<\/p>\n<p>                  The    challenge    is     also    to     the     subsequent<\/p>\n<p>                  communication dated 1.12.2009.\n<\/p>\n<p>                            Learned        counsel    for     the    petitioner<br \/>\n<span class=\"hidden_text\">                           2<\/span><\/p>\n<p>submits that the notice for selection was duly<\/p>\n<p>circulated      in    the        village     from    5.6.2008     to<\/p>\n<p>15.6.2008.      He relies on an extract of the notice<\/p>\n<p>from the register stated to have been signed by<\/p>\n<p>approximately 60 villagers.                It is next submitted<\/p>\n<p>that the impugned order is ex parte in nature. The<\/p>\n<p>petitioner has already joined in pursuance of the<\/p>\n<p>selection and working. Had she been noticed and<\/p>\n<p>given an opportunity for defence she could have<\/p>\n<p>demonstrated that the notice was duly published<\/p>\n<p>before selection as no other illegality in the<\/p>\n<p>selection or her ineligibility has been alleged.<\/p>\n<p>Reliance is also placed on an order of this Court in<\/p>\n<p>C.W.J.C. No. 2255 of 2010 that removal of an<\/p>\n<p>Anganwari Sewika in violation of principles of<\/p>\n<p>natural       justice         was    unsustainable        without<\/p>\n<p>furthermore. It is next submitted that a Division<\/p>\n<p>Bench of this Court on 16.2.2010 held that issues<\/p>\n<p>with regard to appointment of an Anganwari<\/p>\n<p>Sewika as distinct from dereliction in discharge of<\/p>\n<p>duties are the exclusive domain of the District<\/p>\n<p>Magistrate.          Therefore the District Programme<\/p>\n<p>Officer   had        no       jurisdiction    to    terminate    the<\/p>\n<p>petitioner.\n<\/p>\n<p>          Counsel              for   the     respondents        have<br \/>\n<span class=\"hidden_text\">                    3<\/span><\/p>\n<p>supported the impugned orders.\n<\/p>\n<p>          This Court in more than one case has<\/p>\n<p>held that the judgment of the Division Bench in<\/p>\n<p>2010 (2) PLJR 374 (Prabha Kumari Devi Vs. The<\/p>\n<p>State of Bihar &amp; Ors.) was delivered on 16.2.2010.<\/p>\n<p>It has to be understood as operative prospectively<\/p>\n<p>in absence of any directions contained to give effect<\/p>\n<p>to it retrospectively.\n<\/p>\n<p>          If what the petitioner contends be correct,<\/p>\n<p>there shall be no limit to reopening of selections<\/p>\n<p>and   appointment        and\/or   terminations   which<\/p>\n<p>attained finality much before 16.2.2010 creating<\/p>\n<p>absolute turmoil. No order of a Court of law can be<\/p>\n<p>interpreted in such manner.        The petitioner was<\/p>\n<p>terminated on 24.11.2009 before the order of the<\/p>\n<p>Division Bench.\n<\/p>\n<p>          Learned counsel for the petitioner is right<\/p>\n<p>in his submission that if the order is in violation of<\/p>\n<p>the principles of natural justice it is a nullity. But<\/p>\n<p>it is equally settled law that if interference with an<\/p>\n<p>order shall result in the revival of another illegal<\/p>\n<p>order, the Court may decline interference. It must<\/p>\n<p>be kept in mind that the respondents have only<\/p>\n<p>directed a fresh selection when all including the<\/p>\n<p>petitioner and private respondent have to be<br \/>\n<span class=\"hidden_text\">                     4<\/span><\/p>\n<p>considered again.\n<\/p>\n<p>         Such interpretation of the law must be<\/p>\n<p>avoided as held in (1999) 8 SCC 16 (Maharaja<\/p>\n<p>Chintamani Saran Nath Shahdeo Vs. State of<\/p>\n<p>Bihar) held at Pargraph-38 as follows:-<\/p>\n<blockquote><p>                      &#8220;38. For what has been<br \/>\n            stated above we hold that the order<br \/>\n            of the learned Member of Board of<br \/>\n            Revenue directing action to be taken<br \/>\n            for    refund     of   the      excess<br \/>\n            compensation was valid and proper<br \/>\n            though he has no jurisdiction to pass<br \/>\n            the order. In the event it is set aside<br \/>\n            it would amount to reviving an<br \/>\n            invalid order of payment of excess<br \/>\n            compensation to the appellant.&#8221;<\/p><\/blockquote>\n<p>       The petitioner contends in her pleadings at<\/p>\n<p>Paragraph-6 that a general notice was circulated in<\/p>\n<p>the village. The guidelines under Clause 6(iii)<\/p>\n<p>provide that the District Magistrate is required to<\/p>\n<p>publish an advertisement in the newspaper.       The<\/p>\n<p>notice for the Aam Sabha is required to be<\/p>\n<p>published in the Gram Panchayat Office, the<\/p>\n<p>proposed Anganwari Centre, the Project Office, the<\/p>\n<p>Block Office and additionally is required to be<\/p>\n<p>published by the beat of drum\/loudspeaker in the<\/p>\n<p>area concerned.     There is no pleading on behalf of<\/p>\n<p>the petitioner that these procedures were followed.<\/p>\n<p>The Court therefore finds it difficult to interfere<\/p>\n<p>with the impugned order.\n<\/p>\n<p><span class=\"hidden_text\">                            5<\/span><\/p>\n<p>                    The Court therefore does not consider it<\/p>\n<p>           necessary to go into the allegations of alleged<\/p>\n<p>           ineligibility of respondent no. 12 as the issue is<\/p>\n<p>           premature.\n<\/p>\n<p>                    The writ application is dismissed.<\/p>\n<pre>P.
