The Letters Patent Appeal has been filed by the original writ<\/p>\n<p>petitioner against the order of the learned single Judge dated 25th<\/p>\n<p>March, 2009 refusing to permit him to appear in the FMGE-<\/p>\n<p>Screening Test conducted by the respondent No. 1 on 29th March,<\/p>\n<p>2009 and at later stages.      Pursuant to the interim order of the<\/p>\n<p>Division Bench, the appellant was provisionally allowed to appear in<\/p>\n<p>the FMGE-Screening Test conduced by the Board on 29th March,<\/p>\n<p>2009 and he failed in the examination.          Next examination is<\/p>\n<p>scheduled to be held in September, 2009.\n<\/p>\n<\/p>\n<p>2.      Learned counsel appearing for the parties agreed that the writ<\/p>\n<p>petition be also taken up for hearing along with the present appeal.<\/p>\n<p>Accordingly, we have heard submissions of the parties on the appeal<\/p>\n<p><span class=\"hidden_text\">LPA No.133\/2009                                         Page 1 of 10<\/span><br \/>\n as well as on the writ petition.\n<\/p>\n<\/p>\n<p>3.      The appellant after completing 10+2 examination joined<\/p>\n<p>Zaporozhye State Medical University, Ukraine to study medicine.<\/p>\n<p>This University falls in the WHO Directory of recognized medical<\/p>\n<p>colleges as also it falls under the list of medical colleges recognized by<\/p>\n<p>respondent No. 2, Medical Council of India (in short \u201eMCI\u201f).              The<\/p>\n<p>appellant took admission in the said University in the year 1997 and<\/p>\n<p>he was awarded Diploma of Specialist in Medicine in the year 2003.<\/p>\n<p>The appellant when came back to India after obtaining the Diploma,<\/p>\n<p>as per the MCI Regulations wanted to appear in the Screening Test<\/p>\n<p>conducted by respondent No. 1, however, he was denied permission<\/p>\n<p>on the premise that he was not having Biology as a subject in<\/p>\n<p>Intermediate Examination. He, therefore, invoked writ jurisdiction of<\/p>\n<p>this Court seeking that the respondent No.1 be directed to allow him<\/p>\n<p>to appear in the Screening Test going to be held on 29th March, 2009<\/p>\n<p>and in the subsequent tests.\n<\/p>\n<\/p>\n<p>4.      The writ petition has been opposed           on behalf of         the<\/p>\n<p>respondents who had taken an objection in their counter affidavit<\/p>\n<p>that the petitioner was not eligible to undertake the Screening Test<\/p>\n<p>inasmuch as he had passed his 10+2 examination without Biology.<\/p>\n<p>The respondents had placed reliance on the &#8220;Regulations on<\/p>\n<p>Graduate Medical Examination, 1997&#8221; and have urged that the<\/p>\n<p>petitioner was not entitled to pursue the graduate medical course<\/p>\n<p>either in India or abroad and as such, has no enforceable right in the<\/p>\n<p><span class=\"hidden_text\">LPA No.133\/2009                                            Page 2 of 10<\/span><br \/>\n present writ petition. According to the respondents, the Regulation<\/p>\n<p>2(h) of the &#8220;Screening Test Regulations 2002&#8221; and Regulation 2(f) of<\/p>\n<p>the     &#8220;Eligibility     Requirement       For   Taking   Admission       in    an<\/p>\n<p>Undergraduate Medical Course in a Foreign Medical Institution<\/p>\n<p>Regulations 2002&#8221;, mandates that the qualifying examination for<\/p>\n<p>seeking admission to the graduate medical course has to be in<\/p>\n<p>accordance with &#8220;Regulations on Graduate Medical Examination,<\/p>\n<p>1997&#8221;. Based thereon, it has been argued that the petitioner does not<\/p>\n<p>have the requisite qualification as prescribed by the regulations.<\/p>\n<p>5.      Learned counsel for the petitioner has contended that the issue<\/p>\n<p>raised in this petition is clearly covered by a decision of the Supreme<\/p>\n<p>Court in <a href=\"\/doc\/618966\/\">Medical Council of India vs. Indian Doctors<\/a> from Russia<\/p>\n<p>Welfare Associations &amp; Ors., reported in (2002) 3 SCC 696. The<\/p>\n<p>said case dealt with the problem of students who have undergone<\/p>\n<p>courses in medicine in medical colleges in the erstwhile USSR. The<\/p>\n<p>MCI had registered these students who had obtained degrees from<\/p>\n<p>the    said       colleges\/universities.     Without   registration   the      said<\/p>\n<p>graduates who have degree in Medicine from abroad cannot practice<\/p>\n<p>as a medical practitioner in India.         The MCI had filed a Special Leave<\/p>\n<p>Petition against the orders passed by the Allahabad High Court and<\/p>\n<p>Delhi High Court.           The Supreme Court while hearing the matter<\/p>\n<p>made certain observations in the interest of all concerned that<\/p>\n<p>Government of India should formulate an appropriate policy<\/p>\n<p>considering the history of the problem and need to maintain<\/p>\n<p>standards and also bearing in mind the human problem of students<\/p>\n<p><span class=\"hidden_text\">LPA No.133\/2009                                                 Page 3 of 10<\/span><br \/>\n who had undergone training\/studies and had spent years to obtain<\/p>\n<p>degrees.      The Supreme Court also noticed that Section 13 of the<\/p>\n<p>Indian Medical Council Act, 1956 had been amended to deal with the<\/p>\n<p>situation that had arisen w.e.f. 18th February, 2002, new regulations<\/p>\n<p>had been sent for being published in the Gazatte.                 The new<\/p>\n<p>regulations dealt with a situation where a student has proceeded<\/p>\n<p>outside India for study of Medicine and has successfully completed<\/p>\n<p>and obtained degree in Medicine which entitled him to be enrolled<\/p>\n<p>and practice as a medical practitioner. It prescribes requirement to<\/p>\n<p>qualify and pass a screening test for the purpose of registration and<\/p>\n<p>that a person will not be entitled to appear in the screening test if : (i)<\/p>\n<p>Medical College situated abroad is not recognized by the country in<\/p>\n<p>which an institution awarding the said qualification is situated and<\/p>\n<p>(ii) Indian Citizen who is desirous of taking admission in an<\/p>\n<p>undergraduate medical course abroad on or after 15th March, 2002,<\/p>\n<p>should have obtained eligibility certificate from MCI for admission to<\/p>\n<p>MBBS Course in India.     The Supreme Court, however, was conscious<\/p>\n<p>of the problem relating to students who have obtained degrees or had<\/p>\n<p>taken admission before the publication of the Notification or prior to<\/p>\n<p>15th March, 2002.       The Government was also aware of the said<\/p>\n<p>problem and in these circumstances placed guidelines before the<\/p>\n<p>Supreme Court, which have been reproduced in para 6 of the<\/p>\n<p>judgment and the Supreme Court exercising its power under Article<\/p>\n<p>142 of the Constitution of India held that these guidelines will be<\/p>\n<p>applicable to all such students who are similarly situated whether<\/p>\n<p>they are parties before the Supreme Court or not.         The guidelines<\/p>\n<p><span class=\"hidden_text\">LPA No.133\/2009                                             Page 4 of 10<\/span><br \/>\n read as under:-\n<\/p>\n<blockquote><p>                  &#8220;6. In order to regulate the grant of registration<br \/>\n                  to such persons who have completed their<br \/>\n                  degree abroad prior to 15-3-2001, the following<br \/>\n                  guidelinesare placed before this Court by the<br \/>\n                  Government of India:\n<\/p><\/blockquote>\n<blockquote><p>                        ( A ) The case of all persons who<br \/>\n                        applied for registration to MCI prior to<br \/>\n                        15-3-2001 shall be dealt with<br \/>\n                        according to the provisions of the Act<br \/>\n                        as existing prior to the commencement<br \/>\n                        of the IMC (Amendment) Act, 2001<br \/>\n                        subject to the following:\n<\/p><\/blockquote>\n<blockquote><p>                        (i) Those students who obtained<br \/>\n                        degrees where the total duration of<br \/>\n                        study in recognised institutions is less<br \/>\n                        than six years (i.e. where a part of the<br \/>\n                        study has been in unrecognised<br \/>\n                        institutions, or the total length of<br \/>\n                        study in a recognised institution is<br \/>\n                        short of six years), shall be granted<br \/>\n                        registration by MCI provided that the<br \/>\n                        period of shortfall is covered by them<br \/>\n                        by way of additional internship over<br \/>\n                        and above the regular internship of<br \/>\n                        one year. In other words, for such<br \/>\n                        categories of students, the total<br \/>\n                        duration of study in a recognised<br \/>\n                        institution plus the internship, would<br \/>\n                        be seven years, which is the<br \/>\n                        requirement even otherwise.\n<\/p><\/blockquote>\n<blockquote><p>                        (ii) Where students who did not meet<br \/>\n                        the minimum admission norms of MCI<br \/>\n                        for joining undergraduate medical<br \/>\n                        course, were admitted to foreign<br \/>\n                        institutes recognised by MCI, this<br \/>\n                        irregularity be condoned. In other<br \/>\n                        words, the degrees of such students be<br \/>\n                        treated as eligible for registration with<br \/>\n                        MCI.<\/p><\/blockquote>\n<blockquote><p>                        (B) All students who have taken<br \/>\n                        admission abroad prior to 15-3-2002<br \/>\n                        and are required to qualify the<br \/>\n                        screening test for their registration as<br \/>\n                        per the provisions of the Screening<br \/>\n                        Test Regulations, 2002 shall be<br \/>\n                        allowed to appear in the screening test<\/p>\n<p><span class=\"hidden_text\">LPA No.133\/2009                                                Page 5 of 10<\/span><br \/>\n                    even if they also come in the categories<br \/>\n                   of circumstances contained in ( A )( ii )<br \/>\n                   above, as the relaxation contained<br \/>\n                   therein would also be applicable in<br \/>\n                   their case. In other words, any person<br \/>\n                   at    present     undergoing     medical<br \/>\n                   education abroad, who did not<br \/>\n                   conform to the minimum eligibility<br \/>\n                   requirements       for    joining    an<br \/>\n                   undergraduate medical course in India<br \/>\n                   laid down by MCI, seeking provisional<br \/>\n                   or permanent registration on or after<br \/>\n                   15-3-2002 shall be permitted to<br \/>\n                   appear in the screening test in<br \/>\n                   relaxation of this requirement provided<br \/>\n                   he had taken admission in an institute<br \/>\n                   recognised by MCI. This relaxation<br \/>\n                   shall be available to only those<br \/>\n                   students who had taken admission<br \/>\n                   abroad prior to 15-3-2002. From 15-3-<br \/>\n                   2002 and onwards all students are<br \/>\n                   required to first obtain an Eligibility<br \/>\n                   Certificate from MCI before proceeding<br \/>\n                   abroad for studies in Medicine.\n<\/p><\/blockquote>\n<blockquote><p>                   (C) The categories of students not<br \/>\n                   covered in (A) (i) and (ii) above and<br \/>\n                   whose entire period of study has been<br \/>\n                   in a medical college not recognised by<br \/>\n                   MCI, will be allowed to appear in the<br \/>\n                   screening test for the purpose of their<br \/>\n                   registration provided they fulfil all the<br \/>\n                   conditions laid down in the IMC<br \/>\n                   (Amendment) Act, 2001. In other<br \/>\n                   words, the qualification obtained by<br \/>\n                   them     must    be    a   qualification<br \/>\n                   recognised for enrolment as medical<br \/>\n                   practitioner in the country in which<br \/>\n                   the institution awarding the same is<br \/>\n                   situated and they must be fulfilling the<br \/>\n                   minimum eligibility qualification laid<br \/>\n                   down by MCI for taking admission in<br \/>\n                   an undergraduate medical course in<br \/>\n                   India. They shall not be entitled to any<br \/>\n                   relaxation.&#8221;\n<\/p><\/blockquote>\n<p>6.      In the instant petition, the petitioner had taken admission in<\/p>\n<p>the Ukraine University in the year 1997 and had successfully<\/p>\n<p>obtained Diploma in 2003. The said University is recognized by the<\/p>\n<p><span class=\"hidden_text\">LPA No.133\/2009                                           Page 6 of 10<\/span><br \/>\n MCI. He will, therefore, be covered by paragraph 6(B) of the aforesaid<\/p>\n<p>directions quoted above. On a bare reading of paragraph 6(B), it is<\/p>\n<p>clear that all students who had taken admission abroad prior to 15th<\/p>\n<p>March, 2002 are allowed to appear in the screening test, if they can<\/p>\n<p>be granted exemption in terms of paragraph 6(A)(ii).       The clauses<\/p>\n<p>clearly provide that such students who do not meet \u201eminimum<\/p>\n<p>admission norms\u201f of MCI for joining undergraduate course in India,<\/p>\n<p>shall be permitted to appear in the screening test by relaxation of the<\/p>\n<p>requirement of \u201eminimum admission norms\u201f. The reason for issuing<\/p>\n<p>this direction was that with effect from 15th March, 2002 onwards all<\/p>\n<p>students going abroad for medical studies have to first obtain<\/p>\n<p>eligibility certificate from MCI, but before the said date there was no<\/p>\n<p>such requirement. Students who had gone abroad before 15th March,<\/p>\n<p>2002 were admitted in Medical Colleges abroad as per their eligibility<\/p>\n<p>criteria which were different from those prescribed in India.<\/p>\n<p>7.      Our attention was also drawn to a judgment of the Division<\/p>\n<p>Bench of this Court in <a href=\"\/doc\/547602\/\">Naveen Sharma (Dr.) vs. Medical Council of<\/p>\n<p>India &amp; Anr., (RPA No.1092 of<\/a> 1092 of 2006 decided on 20th<\/p>\n<p>December, 2007) wherein the appellant had suffered from two<\/p>\n<p>disabilities, first that the appellant was 17 years of age, on the date<\/p>\n<p>when he took admission in the foreign University and the second<\/p>\n<p>objection was that the aggregate marks obtained by the appellant in<\/p>\n<p>Physics, Chemistry and Biology were less than the minimum<\/p>\n<p>prescribed marks i.e. 50%. The Division Bench held that the case is<\/p>\n<p>covered by the judgment of the Supreme Court in Medical Council<\/p>\n<p><span class=\"hidden_text\">LPA No.133\/2009                                          Page 7 of 10<\/span><br \/>\n of India vs. Indian Doctors from Russia Welfare Associations &amp;<\/p>\n<p>Ors. (supra):-\n<\/p>\n<\/p>\n<blockquote><p>                  &#8220;10. We may state here that the stand of the<br \/>\n                  respondent-Medical Council of      India is<br \/>\n                  somewhat inequitable and unjustified as the<br \/>\n                  appellant was permitted and allowed to sit in<br \/>\n                  the screening test conducted by the National<br \/>\n                  Board of Examination, Ministry of Health and<br \/>\n                  Family Welfare, Government of India in 2005<br \/>\n                  and has qualified the same.\n<\/p><\/blockquote>\n<blockquote><p>                  11. The Supreme Court in the case of Indian<br \/>\n                  Doctors from Russia Welfare Associations<br \/>\n                  (supra) has granted exemption to students who<br \/>\n                  do not meet \u201eminimum admission norms\u201f.<br \/>\n                  Supreme Court has not stated in the said<br \/>\n                  directions that students who do not meet one<br \/>\n                  minimum eligibility norm prescribed by the<br \/>\n                  Medical Council of India, will be granted<br \/>\n                  exemption and students who do not meet more<br \/>\n                  than one eligibility norm, will not be granted<br \/>\n                  exemption. A perusal of the guidelines shows<br \/>\n                  that as far as eligibility criteria is concerned,<br \/>\n                  under Clause 6(A)(ii) the expression used is<br \/>\n                  \u201eminimum      admission     norms\u201f    in   plural.<br \/>\n                  Similarly, in Clause 6(B) the expression used is<br \/>\n                  \u201eminimum eligibility requirements\u201f in plural.<br \/>\n                  The Government of India while framing the<br \/>\n                  guidelines was aware that a student may not<br \/>\n                  meet a single eligibility requirement or multiple<br \/>\n                  eligibility requirements and therefore had<br \/>\n                  expressly used the terms \u201enorms\u201f and<br \/>\n                  \u201erequirements\u201f in plural. Nothing prevented the<br \/>\n                  Government to state in the guidelines that<br \/>\n                  exemption from eligibility norms shall be<br \/>\n                  granted only in cases where a student does not<br \/>\n                  meet a single or one eligibility requirement and<br \/>\n                  students who do not meet two or more eligibility<br \/>\n                  requirements shall be barred and are not<br \/>\n                  entitled to appear in the screening test. The<br \/>\n                  intention of the Government and the guidelines<br \/>\n                  is clear, when it uses the two expressions in<br \/>\n                  plural sense. It is well settled that intention of<br \/>\n                  the legislator and the meaning at the first<br \/>\n                  instance has to be gathered from the words<br \/>\n                  used. When words used are clear, un-<br \/>\n                  ambiguous and bear only one meaning, the<br \/>\n                  courts give effect to that meaning. Plain words<\/p>\n<p><span class=\"hidden_text\">LPA No.133\/2009                                                Page 8 of 10<\/span><br \/>\n                   explicitly used in the guidelines supports the<br \/>\n                  stand of the appellants and goes against the<br \/>\n                  interpretation put forward by the respondent<br \/>\n                  Medical Council of India.\n<\/p><\/blockquote>\n<blockquote><p>                  12. Learned counsel for the Medical Council of<br \/>\n                  India has also not been able to point out any<br \/>\n                  specific order passed by the Supreme Court in<br \/>\n                  which any direction or observation has been<br \/>\n                  made holding that failure to meet two or more<br \/>\n                  eligibility requirements will not entitle a student<br \/>\n                  to benefit of Clause 6(B) read with clause 6(A)(ii)<br \/>\n                  of the guidelines.&#8221;<\/p>\n<p>8.      Learned counsel appearing on behalf of the respondents sought<\/p>\n<p>to rely upon an order passed by the Supreme Court dismissing a writ<\/p>\n<p>petition and certain other applications. It is argued that in that writ<\/p>\n<p>petition the point involved was the same and the relief claimed was<\/p>\n<p>also identical. We may mention that the order is non-speaking order<\/p>\n<p>and it merely says that writ petition is dismissed.            No reasons or<\/p>\n<p>grounds for dismissal are recorded in the order. It is not possible for<\/p>\n<p>this Court to hold and read into this non-speaking order dismissing a<\/p>\n<p>writ petition under Article 32 words or directions that has the effect<\/p>\n<p>of modifying or clarifying its earlier directions in Medical Council of<\/p>\n<p>India viz. Indian Doctors from Russia Welfare Associations &amp;<\/p>\n<p>Ors. (supra). We are bound by the decision and directions given in<\/p>\n<p>the aforesaid case by the Three Judge Bench.               Therefore, in our<\/p>\n<p>opinion, the respondents are obliged to follow the judgment of the<\/p>\n<p>Supreme Court in <a href=\"\/doc\/618966\/\">Medical Council of India vs. Indian Doctors<\/a><\/p>\n<p>from Russia Welfare Associations &amp; Ors. (supra) as well as the<\/p>\n<p>judgment of the Division Bench of this Court in <a href=\"\/doc\/547602\/\">Naveen Sharma<\/p>\n<p>(Dr.) vs. Medical Council of India &amp; Anr.<\/a> (supra).                 It is rather<\/p>\n<p>unfortunate that the respondents have denied the permission to the<\/p>\n<p><span class=\"hidden_text\">LPA No.133\/2009                                                 Page 9 of 10<\/span><br \/>\n petitioner to appear in the examination in spite of the judgment of the<\/p>\n<p>Supreme Court and the Division Bench of this Court and they had<\/p>\n<p>chosen to agitate the same issues which stand settled by the<\/p>\n<p>aforesaid judgment.\n<\/p>\n<\/p>\n<p>9.      In the circumstances, the petition is allowed. The respondents<\/p>\n<p>are directed to permit the petitioner to appear in the Screening Test<\/p>\n<p>which is going to be held in September, 2009 and the subsequent<\/p>\n<p>tests, if necessary. Respondents shall pay the costs of the petitioner<\/p>\n<p>quantified as Rs.10,000\/-. The writ petition and the present appeal<\/p>\n<p>are accordingly disposed of.
