The<br \/>\n\thusband of respondent no.3 was also declared as Girashdar. No<br \/>\n\tactions were initiated by any authority against them. The action of<br \/>\n\tissuance of notice and inviting reply thereof from concerned Talati<br \/>\n\tsmacks malafide action on the part of the State, as the Private<br \/>\n\tCompany located in surrounding is interested in getting the land in<br \/>\n\tquestion. The haste on the part of authority is sufficient to<br \/>\n\tdiscourage the petitioner from taking out appropriate remedy<br \/>\n\tavailable under law.\n<\/p>\n<p>This<br \/>\n\tCourt is unable to accept the submission of learned advocate for the<br \/>\n\tpetitioner and this petition in my view, deserves to be dismissed on<br \/>\n\taccount of availability of alternative remedy. The apprehension<br \/>\n\tsought to be made basis for avoiding alternative remedy is not made<br \/>\n\tout in any manner by the petitioner. The petitioner is at absolute<br \/>\n\tliberty to move the concerned authority with appropriate application<br \/>\n\tfor interim relief also, as at this stage, if the petition is<br \/>\n\tentertained, containing challenge to the order dated 27.8.2010 on<br \/>\n\tthe apprehension, which is made out, then, it would amount to<br \/>\n\tpermitting the petitioner to bye-pass the alternative remedy, which<br \/>\n\twould not be in the interest of justice. Had there been a genuine<br \/>\n\tapprehension with regard to malafide intention, than, the petitioner<br \/>\n\twould not wait in taking action, as the impugned order is dated<br \/>\n\t27.8.2010. The reasoning given by the petitioner&#8217;s advocate for not<br \/>\n\tapproaching the Court that the order was not received, is also not<br \/>\n\tacceptable, as the petitioner cannot be now permitted to say that<br \/>\n\tthe order had been served lately upon the petitioner. Be that as it<br \/>\n\tmay. This need not detain the court longer on this aspect. Suffice<br \/>\n\tit to say that the petition is bereft of merits, and is not required<br \/>\n\tto be entertained, the same deserves to be dismissed. Hence, it is<br \/>\n\tdismissed.
