In the said grounds, there is a<br \/>\n\treference of two criminal cases which are filed under the Immoral<br \/>\n\tTraffic (Prevention) Act. In the grounds of detention, the<br \/>\n\tstatements of certain witnesses have been recorded.\n<\/p>\n<p>   Learned<br \/>\n\tadvocate appearing on behalf of the petitioner has submitted that<br \/>\n\twhen the detention order dated 02.05.2005 came to be passed, the<br \/>\n\tpetitioner was in judicial custody in connection with two offences<br \/>\n\tregistered against him under the Immoral Traffic (Prevention) Act<br \/>\n\tand there was no likelihood of continuing anti-social dangerous<br \/>\n\tactivities so as to disturb the public order by the detenue. It is<br \/>\n\tsubmitted that there was no material before the detaining authority<br \/>\n\tin respect of filing of the bail application or in respect of<br \/>\n\tlikelihood of petitioner being released on bail, which results i<br \/>\n\tnon-application of mind vitiating the detention order.\n<\/p>\n<p>   On<br \/>\n\tthe other hand, Mrs. H.B.Punani, learned Assistant Government<br \/>\n\tPleader has tried to support the impugned detention order passed<br \/>\n\tagainst the petitioner. Affidavit in reply is filed on behalf of<br \/>\n\trespondent no.2.\n<\/p>\n<p>    The<br \/>\n\timpugned order came to be challenged by the petitioner detenue on<br \/>\n\tvarious grounds. It is not in dispute that the petitioner was in<br \/>\n\tjudicial custody when the detention order dated 02.05.2005 came to<br \/>\n\tbe passed by the detaining authority. Therefore, when the petitioner<br \/>\n\twas in judicial custody, there was no likelihood of continuing<br \/>\n\tantisocial dangerous activities as a ?SImmoral Traffic Offener??<br \/>\n\tso as to disturb the public order by the detenue. It is pertinent to<br \/>\n\tnote that likelihood of filing of bail application by the petitioner<br \/>\n\tand likelihood of releasing the petitioner on bail, both are<br \/>\n\tentirely different and separate propositions. It is required to be<br \/>\n\tnoted that there must be some credible material before the detaining<br \/>\n\tauthority to reach to the subjective satisfaction either about<br \/>\n\tlikelihood of filing of bail application and\/or likelihood of<br \/>\n\tpetitioner being released on bail. The facts of the present case are<br \/>\n\tsquarely covered by the decision of the Apex Court in the case of<br \/>\n\tAmrutlal Vs. Union of India, reported in AIR 2000 SC 3675 wherein<br \/>\n\tthe Apex Court observed that there must be cogent materials before<br \/>\n\tthe officer passing the detention order that the detenue was likely<br \/>\n\tto be released on bail. Admittedly, the petitioner was in judicial<br \/>\n\tcustody and there was no material before the detaining authority to<br \/>\n\treach to the subjective satisfaction that the detenue was likely to<br \/>\n\tfile the bail application and was likely to be released on bail and<br \/>\n\tin absence thereof, the subjective satisfaction of the detaining<br \/>\n\tauthority is vitiated, and, therefore, the impugned detention order<br \/>\n\tis required to be quashed and set aside.\n<\/p>\n<p>     It<br \/>\n\tis to be noted that other co-detenues viz. Sujay @ Devo @<br \/>\n\tDevadhikari S\/o. Satyadhikari Bangali and Irphan @ Karan Yusufbhai<br \/>\n\tChipa have already been ordered to be released by this Hon&#8217;ble Court<br \/>\n\tvide order dated 16.08.2005 passed in Special Civil Application<br \/>\n\tNo.12151 of 2005 and vide order dated 09.08.2005 passed in Special<br \/>\n\tCivil Application No.11448 of 2005 respectively.\n<\/p>\n<p>    In<br \/>\n\tview of what is stated above, the petition is allowed. The order of<br \/>\n\tdetention dated 02.05.2005 is quashed and set aside. The detenue<br \/>\n\tSeemakhan Salimkhan Pathan is ordered to be set at liberty forthwith<br \/>\n\tif not required in any other offence by any other authority.
