Mr. DR Dave,<br \/>\nLd. Advocate appears and waives service of rule on behalf of the<br \/>\nopponent.\n<\/p>\n<p>2.\t\tConsidering the<br \/>\nfacts and circumstances of the case and with consent of both the<br \/>\nsides, the application is taken up for final hearing today.\n<\/p>\n<p>3.\t\tThe applicant,<br \/>\nwho happens to be respondent in the above referred appeal, filed this<br \/>\napplication praying that the amount at present lying in fixed deposit<br \/>\nin the bank may be disbursed in appropriate proportion to the<br \/>\napplicant original respondent. It transpires that while admitting the<br \/>\nabove referred First Appeal on 4\/3\/2011, in the civil application<br \/>\nbeing Civil Application No. 1995\/2011, the ad-interim relief was<br \/>\ngranted staying the execution and further implementation of the<br \/>\nimpugned judgment and decree rendered by the trial Court, on the<br \/>\ncondition that the opponent herein, who was the appellant, shall<br \/>\ndeposit the entire decretal amount with costs and interest before the<br \/>\ntrial Court. Pursuant to that order, it transpires that the opponent\n<\/p>\n<p>&#8211; appellant deposited the said amount before the trial Court<br \/>\nand vide order dated 18\/4\/2011 passed in Civil Application for Stay<br \/>\nNo. 1995\/2011, in para. 3 following order was passed :\n<\/p>\n<p>&#8220;3.\t\tResultantly,<br \/>\nthe ad-interim relief as prayed for in paragraph 5(B) of this<br \/>\napplication shall continue till the pendency and final disposal of<br \/>\nthe appeal. The amount, which has been deposited by the applicant &#8211;<br \/>\nappellant \twith the trial Court, shall be invested by the trial Court<br \/>\nin  any nationalised bank in fixed deposit in the name of  Nazir,<br \/>\nCourt of Sr.Civil Judge, Jamnagar initially for the period of four<br \/>\nyears and said period shall stand extended at the interval of every<br \/>\nyear, till the appeal is finally \theard and decided. The amount shall<br \/>\nbe invested in fixed deposit, in<br \/>\nsuch scheme, wherein the amount of interest is accumulated.&#8221;\n<\/p>\n<p>4.\t\tIt is further<br \/>\nclear that on 18\/4\/2011 though the respondent in the appeal [the<br \/>\napplicant herein] was duly served with the rule, yet none appeared<br \/>\nfor the respondent &#8211; applicant. Pursuant to that, the entire<br \/>\namount deposited by the appellant &#8211; opponent ordered to be<br \/>\ndeposited in the fixed deposit and no interim order regarding<br \/>\ndisbursement came to be passed. Hence, this application is filed.\n<\/p>\n<p>5.\t\tUpon perusing<br \/>\nthe impugned judgment and order rendered by the trial Court, so also<br \/>\nthe above referred orders as well as considering the facts and<br \/>\ncircumstances narrated in this application and the submissions<br \/>\nadvanced on behalf of both the sides and especially considering the<br \/>\nnature of the litigation, this Court is of the opinion that 25%<br \/>\namount out of the amount deposited in the fixed deposit should be<br \/>\npermitted to be withdrawn by the applicant original respondent. It is<br \/>\nfurther made clear that the periodical interest on the fixed deposit<br \/>\nshall also be permitted to be withdrawn by the applicant &#8211;<br \/>\noriginal respondent.\n<\/p>\n<p>6.\t\tFor the<br \/>\nforegoing reasons, the  application is partly allowed. The applicant<br \/>\nherein [original respondent] is permitted to withdraw 25% amount out<br \/>\nof the amount deposited in the fixed deposit and the remaining amount<br \/>\nshall be reinvested by the trial Court in the fixed deposit in any<br \/>\nnationalized bank in the name of Nazir, Court of Sr. Civil Judge,<br \/>\nJamnagar, initially for a period of four years and said period shall<br \/>\nstand extended at the interval of every year till the appeal is<br \/>\nfinally heard and decided. The applicant &#8211; original respondent shall<br \/>\nalso be entitled to receive periodical interest in the fixed deposit.<br \/>\nRule is made absolute accordingly.
