RADHAKRISHNAN, J.\n\n  = = = = = = = = = = = = = = = = = = = = = = = =\n\n            W.P.(C).No.10740 of 2008-C\n\n  = = = = = = = = = = = = = = = = = = = = = = = =\n\n       Dated this the 9th day of June, 2009.\n\n                     JUDGMENT\n<\/pre>\n<p>1.In  the   Thrissur   district,   samithies   were<\/p>\n<p> permitted to conduct toddy shops in two ranges.<\/p>\n<p> The petitioner states that he was a member of<\/p>\n<p> such samathi and that the samithies are exempted<\/p>\n<p> from payment of tree tax and that he has not<\/p>\n<p> conducted any abkari shop otherwise than as a<\/p>\n<p> member of a samithi. He accordingly states that<\/p>\n<p> it was illegal on the part of the State to have<\/p>\n<p> treated him as a defaulter on tree tax and in<\/p>\n<p> having denied him the privilege in terms of the<\/p>\n<p> Abkari Policy for the year 2008-2009. That abkari<\/p>\n<p> year has already ended.\n<\/p>\n<\/p>\n<p>2.The question now is as to whether the petitioner<\/p>\n<p> should be continued to be treated as a defaulter<\/p>\n<p> to   exclude   him   from   the   opportunity   to<\/p>\n<p><span class=\"hidden_text\">WP(C)10740\/2008        -: 2 :-<\/span><\/p>\n<p> participate and to be considered for allotment of<\/p>\n<p> shop in the Abkari year 2009-2010. If there is no<\/p>\n<p> arrear of tree tax, the petitioner is entitled to<\/p>\n<p> participate.     There    is   nothing  on    record<\/p>\n<p> demonstrating that the petitioner is liable to pay<\/p>\n<p> tree tax either on account of his having had any<\/p>\n<p> individual transaction or group transaction. The<\/p>\n<p> allegation of the petitioner that he was party<\/p>\n<p> only to samithies in Thrissur, therefore, prima<\/p>\n<p> facie, stands. Accordingly, it is ordered that the<\/p>\n<p> petitioner would not be treated as a defaulter for<\/p>\n<p> the purpose of the ensuing auction for the abkari<\/p>\n<p> year 2009-2010.\n<\/p>\n<\/p>\n<p>3.The petitioner has also a claim that he be<\/p>\n<p> refunded the amount which has been forfeited as<\/p>\n<p> per Ext.P4. This is an issue that the petitioner<\/p>\n<p> can    raise   before the    Excise Commissioner  on<\/p>\n<p> appropriate representation and if it is found that<\/p>\n<p> he had no individual liability and was party only<\/p>\n<p> to samithies which were exempted from payment of<\/p>\n<p> tree tax, the forfeiture order would be considered<\/p>\n<p><span class=\"hidden_text\">WP(C)10740\/2008        -: 3 :-<\/span><\/p>\n<p> for    release   of funds.    Any  request of  the<\/p>\n<p> petitioner in that regard will be considered and<\/p>\n<p> disposed of within three months from the date of<\/p>\n<p> receipt      of a copy   of   this judgment and  a<\/p>\n<p> representation requesting for such refund.
