S.J. MUKHOPADHAYA)<\/p>\n<p>\tIn<br \/>\nthe writ petition preferred by the appellant, learned Single Judge<br \/>\npassed following interim order on 10.11.2009.\n<\/p>\n<p> Rule<br \/>\nreturnable on 23.12.2009.  Mrs. Krishna Rawal, learned advocate<br \/>\nwaives service of rule on behalf of respondent No.1<\/p>\n<p>\tIn<br \/>\nthe meanwhile, the order of the appellate authority is not stayed.<br \/>\nBut, it is clarified that the payment which are required to be<br \/>\nrefunded to the petitioner will be adjusted in the running bill<br \/>\nand\/or if the petitioner succeeds in the petition, then the<br \/>\npetitioner will pay the amount which is adjusted in the running bill<br \/>\nwithin a period of two months.\n<\/p>\n<p>\tThe<br \/>\nsaid order was further clarified by order dated 14.12.2009, wherein<br \/>\nin place of &#8216;petitioner&#8217; as appearing at all places, it was ordered<br \/>\nto be read as &#8216;respondent&#8217;.  It is against the above interim order,<br \/>\npresent appeal has been preferred under Clause 15 of the Letters<br \/>\nPatent.\n<\/p>\n<p>\tOn<br \/>\n30.12.2009, the appeal was admitted and ad-interim relief was granted<br \/>\nin terms of para 3(a) on condition that the appellant shall deposit<br \/>\nthe amount ordered to be refunded to the respondent with this Court,<br \/>\nby 6.1.2010.\n<\/p>\n<p>\tPara<br \/>\n3(a) reads as follows:-\n<\/p>\n<p> To<br \/>\nstay the operation of the impugned order dated 21.12.2009 passed by<br \/>\nthe learned Single Judge (Coram: K.S. Jhaveri,J.) in MCA No.<br \/>\n3279\/2009 in SCA No. 2505\/2009 and to stay the operation of the<br \/>\ninterim direction passed by the learned Single Judge directing<br \/>\nadjustment of the amount in the running bills, during the pendency<br \/>\nand final disposal of the LPA.\n<\/p>\n<p>\tPursuant<br \/>\nto the Court&#8217;s order, the appellant has deposited the amount with<br \/>\nthis Court.  In view of such order passed on 30.12.2009, which<br \/>\ncontinued for about 7 ? months, we are of the view that the<br \/>\naforesaid interim order dated 30.12.2009 should be made absolute and<br \/>\nto continue till the writ petition preferred by the appellant is<br \/>\ndisposed of.
