This application, in fact, was notified yesterday for hearing.<br \/>\nAfter brief discussion, at our request, learned counsel Mr. Oza<br \/>\nconveyed to the respondents; and in particular respondents no. 2 &amp;<br \/>\n3 that the imposition of condition of providing bank guarantee, only<br \/>\nafter which the goods will be cleared, runs counter to our directions<br \/>\ncontained in Order dated 9th<br \/>\nSeptember 2011. We noted that learned counsel Mr. Oza has been able<br \/>\nto prevail over the respondents and today,<br \/>\nwithin less than twenty four hours, he has ensured that proper<br \/>\ncorrective steps are taken by the respondents. In furtherance to<br \/>\nthis, he places on record a communication dated 20th<br \/>\nOctober 2011, by virtue of which, the goods of the applicant are<br \/>\nordered to be released provisionally. In so far as the application is<br \/>\nconcerned, the prayers stand satisfied.\n<\/p>\n<p>\tWe<br \/>\nmight have examined the issue of ignoring the Court&#8217;s order further,<br \/>\nhowever, in view of  unconditional apology tendered by Shri Sanket<br \/>\nKale, on behalf of the authority who had passed the order, as also<br \/>\nthe assurance of learned counsel Mr. Oza that the Court&#8217;s anguish and<br \/>\nannoyance will be conveyed to the concerned officer, we close the<br \/>\nissue.\n<\/p>\n<p>\tIn<br \/>\nview of the developments noted above, no further order is passed in<br \/>\nthis Misc. Civil Application.
