     Challenge in this writ petition is against Exts.P6 and<\/p>\n
P7.\n<\/p>\n
     2. Petitioners were defaulters of Abkari dues as on<\/p>\n
31.3.1997. The Government of Kerala introduced Ext.P1<\/p>\n
scheme offering reduction of 75% of the amount of interest<\/p>\n
accrued on the rental and other dues as on 31.3.1997.<\/p>\n
According to the petitioners, they have submitted Exts.P2<\/p>\n
and P3 claiming benefit of Ext.P1 and orders were not<\/p>\n
passed. As the cut off date for payment in terms of the<\/p>\n
scheme was running out, petitioners approached this court<\/p>\n
by filing O.P.No.25046\/00, in which Ext.P4 interim order<\/p>\n
was passed directing the petitioners to remit the admitted<\/p>\n
amount in terms of the claim and furnish bank guarantee<\/p>\n
for the disputed liability. Accordingly, the petitioners<\/p>\n
                         2<\/span><\/p>\n
complied with the said order. The Original Petition was<\/p>\n
finally disposed of by Ext.P5 judgment. In Ext.P5, this court<\/p>\n
directed as follows.\n<\/p>\n
            “In the circumstances, the second respondent is<\/p>\n
            directed to call for the records pertaining to<\/p>\n
            payments and verify the liability after ensuring<\/p>\n
            that credit is given for full payments made by<\/p>\n
            the petitioners. The petitioners in any case will<\/p>\n
            be given amnesty benefit as petitioner has<\/p>\n
            complied with the interim order of this court.<\/p>\n
            However, if any balance liability is due i.e, if any<\/p>\n
            liability is left after granting rebate of 75% of<\/p>\n
            interest due up to 30.11.2000, then petitioners<\/p>\n
            will pay such amount along with 12% interest<\/p>\n
            per annum on the same before 31.1.2006. The<\/p>\n
            second     respondent     will  immediately      on<\/p>\n
            production of copy of this judgment verify<\/p>\n
            payments and adjustments and give a fresh<\/p>\n
            statement to the petitioners for clearing liability<\/p>\n
                        3<\/span><\/p>\n
            as above. In the event of default in payment by<\/p>\n
            the petitioners as above, they will forfeit the<\/p>\n
            amnesty benefit granted above.”<\/p><\/blockquote>\n
     3. In pursuance there of, petitioners’ liability has been<\/p>\n
quantified as per Exts.P6 and P7 and in terms there of<\/p>\n
petitioner will have to make an additional payment of<\/p>\n
Rs.5,15,67\/- towards the liability. It is challenging this<\/p>\n
quantification, made as per Exts.P6 and P7, that the writ<\/p>\n
petition has been filed.\n<\/p>\n
     4. As is evident from Ext.P6 order, the liability has<\/p>\n
been quantified, adding interest on the principal at 4.5%<\/p>\n
and it is on that basis additional amount is found to be due<\/p>\n
from the petitioner.\n<\/p>\n
     5. A reading of the extracted portion of the judgment<\/p>\n
in O.P.No.25046\/2000 shows that the respondents were<\/p>\n
required to quantify the petitioners’ liability towards<\/p>\n
principal and interest at the rate as applicable up to<\/p>\n
30.11.2000. Thereafter, the petitioners should have been<\/p>\n
given the benefit of Ext.P1 by reducing their liability to the<\/p>\n

extent of 75% there of. It is the amount so quantified which<\/p>\n
the petitioners    are made liable. The judgment further<\/p>\n
directed for adjusting the amount that the petitioners have<\/p>\n
paid in terms of Exts.P4 interim order including the bank<\/p>\n
guarantee and        if the liability stands discharged the<\/p>\n
petitioner will be exonerated entirely     and in case any<\/p>\n
additional amount is payable, the petitioners are liable for<\/p>\n
interest at 12%. Therefore, what is required is that the<\/p>\n
respondents have to first quantify the petitioners’ liability<\/p>\n
as on 30.11.2000 by adding interest at the rate applicable<\/p>\n
and then give reduction applying Ext.P1.<\/p>\n
     6. Respondent No.3 has filed a counter affidavit. It is<\/p>\n
stated that pursuant to Ext.P4 order petitioner remitted<\/p>\n
Rs.3,18,087\/-    and    furnished    Bank    guarantee   for<\/p>\n
Rs.3,05,000\/-. It is stated that out of the amount remitted,<\/p>\n
the entire arrears due in respect of shop No.4\/93-94 of<\/p>\n
Manjeri Range was adjusted and after closing that liability<\/p>\n
the balance account available was Rs.203762. According to<\/p>\n
the 3rd respondent, this amount was also adjusted against<\/p>\n
                          5<\/span><\/p>\n
his liability as shown in Ext.P7, and even thereafter,<\/p>\n
Rs.3,04,548\/-   was due from the petitioner. Respondent<\/p>\n
would also contend that along with 12% interest as allowed<\/p>\n
by this court, the total liability of the petitioner was<\/p>\n
Rs.515067\/-.\n<\/p>\n
      7. The factual position as above, is reflected in Ext.P7<\/p>\n
statement of accounts also and I have not been able to find<\/p>\n
anything irregular in the quantification of the petitioners’<\/p>\n
liability. However, in the statement and the affidavit, what<\/p>\n
remains unexplained is regarding the appropriation of the<\/p>\n
Bank guarantee that was furnished by the petitioners as<\/p>\n
ordered by this court in Ext.P4 order. Admittedly the<\/p>\n
petitioners had furnished the bank guarantee and the<\/p>\n
affidavit does not say that the same was encashed towards<\/p>\n
any of their liabilities. If bank guarantee was available, that<\/p>\n
ought to have been appropriated, and if it was done, a<\/p>\n
substantial portion of the liability would have been wiped<\/p>\n
off.\n<\/p>\n
                        6<\/span><\/p>\n
     8. For this reason, I find the matter needs to be re-<\/p>\n
examined by the 3rd respondent. Accordingly, I dispose of<\/p>\n
the writ petition, upholding Ext.P7 and the quantification of<\/p>\n
the liability, but however, directing that the 3rd respondent<\/p>\n
shall consider whether the Bank guarantee was appropriate<\/p>\n
towards the liability of the petitioners and if it is not done,<\/p>\n
the said respondent shall appropriate bank guarantee, if the<\/p>\n
same is still valid, and quantify the liability of the<\/p>\n
petitioners afresh. Once liability is quantified as above, it<\/p>\n
will be intimated to the petitioners and thereupon, amount<\/p>\n
if any due, will be paid by them, within one month<\/p>\n
thereafter.\n<\/p>\n
     Writ Petition is disposed of.\n<\/p>\n<\/p>\n
