K. Wadhwa Under Secretary (A), CPIO<br \/>\nShri Harjit Singh, Under Secretary (F) &amp; CPIO Shri Rajan Sood, Section Officer<br \/>\n(G), Department of Pension and Pensioners&#8217; Welfare, Lok Nayak Bhawan, New<br \/>\nDelhi, has been responded to by none, even though the same was duly<br \/>\nsubmitted along with the requisite fee on 04.04.2008. Besides, no response has<br \/>\nbeen given to the reminder sent dated 30.05.2008.\n<\/p>\n<p>        Having admitted the complaint of Shri Mohan Lal u\/s 18(1)(b) of the RTI<br \/>\nAct, 2005 the Commission served notice on 22.09.2009 to all three CPIOs,<br \/>\nDepartment of Pension &amp; Pensioners&#8217; Welfare, New Delhi seeking their<br \/>\ncomments on the complaint. In a response of 30.09.2009, all CPIOs S\/Shri Rajan<br \/>\nSood, V. K. Wadhwa and Harjit Singh, Department of Pension &amp; Pensioner&#8217;s<br \/>\nWelfare, New Delhi submitted their comments by endorsing a copy of the same<br \/>\nto the complainant Shri Mohan Lal. The CPIO Shri Rajan Sood has informed the<br \/>\nCommission that the application dated 04.04.2008 of the complainant, on receipt,<br \/>\nwas forwarded on 11.04.2008 by the then CPIO Shri Sukar Singh Under<br \/>\nSecretary to the concerned sections under the provision of RTI Act for furnishing<\/p>\n<p><span class=\"hidden_text\">                                        1<\/span><br \/>\n information directly to the complainant and he has ascertained that the<br \/>\ninformation had been supplied by Shri Harjit Singh and Shri V. K. Wadhwa on<br \/>\n29.07.2008 and 01.08.2008 respectively. No rejoinder has been received from<br \/>\ncomplainant Shri Mohan Lal against the response submitted by the CPIOs<br \/>\ndespite the lapse of two months.\n<\/p>\n<p>                                   Decision Notice<\/p>\n<p>      It is clear from the comments submitted by the CPIOs that the desired<br \/>\ninformation has been supplied by the CPIO Shri V. K. Wadhwa, Under Secretary<br \/>\nP &amp; PW (G), Department of Pension and Pensioners&#8217; Welfare, New Delhi who is<br \/>\nthe custodian of the information, but the response is overdue by more than two<br \/>\nmonths. Moreover Shri V. K. Wadhwa has not given any reason for this late<br \/>\nresponse.\n<\/p>\n<p>      In light of the above, the complainant Shri Mohan Lal is advised that if he<br \/>\nfinds the response unsatisfactory, he may approach the first appellate authority<br \/>\nof the department u\/s 19(1) of RTI Act, and if, not satisfied with the information<br \/>\nprovided on his 1st appeal consequently, complainant Shri Mohan Lal will be free<br \/>\nto move a 2nd appeal before us as per Sec 19 (3).\n<\/p>\n<p>      On the other hand the CPIO &amp; Under Secretary P&amp;PW (G), Department of<br \/>\nPension &amp; Pensioners&#8217; Welfare, New Delhi Shri V. K. Wadhwa will show cause<br \/>\nas to why a penalty of Rs. 250\/- per day from the date when the information fell<br \/>\ndue i.e. 11.05.2008 to the date when the information is actually supplied, not<br \/>\nexceeding Rs. 25,000\/- should not be imposed on him under Section 20(1) of the<br \/>\nRTI Act. The CPIO may submit his written submission to this Commission on or<br \/>\nbefore 23.12.2009, failing which this Commission will proceed with application of<br \/>\nSec 20. The present complaint is disposed of accordingly.\n<\/p>\n<p><span class=\"hidden_text\">                                        2<\/span><\/p>\n<p>        Announced on this ninth day of December 2009.
