SHAH\n\t\t\n\t\n\n \n\n \n \n\n\n \n\nDate\n: 22\/02\/2011 \n\n \n\n \n \nORAL\nORDER<\/pre>\n<p>1.\tIt<br \/>\nis not in dispute that the proceedings are pending before the<br \/>\nDistrict Development Officer, Patan and there is no final decision<br \/>\ntaken by the District Development Officer, Patan on the application<br \/>\nsubmitted by the petitioners for Non Agricultural Use Permission.<br \/>\nVide communication dated 28\/01\/2011 the District Development Officer,<br \/>\nPatan sought opinion from the Assistant Collector, Patan and it<br \/>\nappears from the communication at Annexure Q dated 09\/02\/2011 that<br \/>\nthe Assistant Collector, Patan has already sent its opinion to the<br \/>\nDistrict Development Officer, Patan and, therefore, considering the<br \/>\nsame now the District Development Officer, Patan is required to pass<br \/>\nan appropriate order in accordance with law on its own merits on the<br \/>\napplication submitted by the petitioners.  Nothing is on record that<br \/>\nany final decision has been taken by the District Development<br \/>\nOfficer, Patan on the application by the petitioners for grant of Non<br \/>\nAgriculture Use Permission.  Hence, the present petition is not<br \/>\nentertained.  However, it is expected that the District Development<br \/>\nOfficer, Patan shall  pass an appropriate final order on the<br \/>\napplication submitted by the petitioners for grant of Non Agriculture<br \/>\nPermission at the earliest.
