M. SAHAI)<\/a><\/p>\n<p>1.\t\tWe<br \/>\nhave heard Mr Manish J Patel, learned counsel for the petitioner and<br \/>\nMs. Archana Amin, learned counsel for the respondents. The petitioner<br \/>\nin this petition challenges the order passed by the respondents No.2<br \/>\nand 3. The facts of the case in brief are that the petitioner was<br \/>\nworking as Constable in CISF, Ukai. A theft of 17 numbers of<br \/>\ntroughing rollers  took place on 5.10.2009. After issuing show cause<br \/>\nnotice to the petitioner, the petitioner was suspended. After<br \/>\ncompletion of the departmental proceedings, the respondents, by order<br \/>\ndated 17.12.2010, imposed punishment of reduction of pay by 3 stages<br \/>\nfrom Rs. 10670\/- to Rs.9750\/- for a period of three years from the<br \/>\ndate of issue of the order with further direction that the petitioner<br \/>\nwill not earn increments of pay during the period of reduction and<br \/>\nthat on expiry of this period, the reduction will not have the effect<br \/>\nof postponing his future increments of pay.  This order was<br \/>\nchallenged in Appeal and in Revision and the orders passed by the<br \/>\npunishing authority has been affirmed.\n<\/p>\n<p>2.\t\tHaving<br \/>\nheard the learned counsel for the parties, we find that the<br \/>\npetitioner was on guard duty when the theft took place.  The<br \/>\nrespondents have taken a lenient view in the matter while passing the<br \/>\nimpugned orders.   CISF is a Disciplined Force and for the charge of<br \/>\ntheft, the action has rightly been taken by the respondent<br \/>\nauthorities.
