      In this Revision petition filed under Section 397 read with<\/p>\n
Section 401 Cr.P.C. the petitioner who was the accused in S.C.<\/p>\n
No. 2218 of 1999            on the file of the Judicial First Class<\/p>\n
Magistrate, Payyannur challenges              the conviction      entered and<\/p>\n
the sentence passed against her for an offence punishable under<\/p>\n
Section 138 of the Negotiable Instruments Act, 1881 (hereinafter<\/p>\n
referred to as ‘the Act’).\n<\/p>\n
      2.   I heard the learned counsel for the Revision Petitioner<\/p>\n
and the learned Public Prosecutor and also the learned counsel<\/p>\n
for the complainant.\n<\/p>\n
      3.   The learned counsel appearing for the Revision<\/p>\n
Petitioner re-iterated the contentions in support of the Revision.<\/p>\n
The courts below have concurrently held that the cheque in<\/p>\n
question was drawn by the petitioner                        in favour of the<\/p>\n
complainant on the drawee bank, that the cheque was validly<\/p>\n
presented to the bank, that it was dishonoured for reasons which<\/p>\n

fall under Section 138 of the Act, that the complainant made a<\/p>\n
demand for payment by a notice in time in accordance with<\/p>\n
clause (b) of the proviso to Section 138 of the Act and that the<\/p>\n
Revision Petitioner\/accused failed to make the payment within<\/p>\n
15 days of receipt of the statutory notice.  Both the courts have<\/p>\n
considered and rejected the defence set up by the revision<\/p>\n
petitioner while entering the above finding. The said finding has<\/p>\n
been recorded on an appreciation of the oral and documentary<\/p>\n
evidence. I do not find any error, illegality or impropriety in the<\/p>\n
finding so recorded concurrently by the courts below.          The<\/p>\n
conviction was thus rightly entered against the petitioner.<\/p>\n
      4.      What now survives for consideration is the question<\/p>\n
as to whether what should be the proper sentence to be imposed<\/p>\n
on the revision petitioner.     Having regard to the facts and<\/p>\n
circumstances of the case, I am inclined to modify the sentence<\/p>\n
imposed on the revision petitioner.     In the light of the recent<\/p>\n
decision of the Supreme Court in Ettappadan Ahammedkutty<\/p>\n
v. E.P. Abdullakoya (2008(1) KLT 851) rendered on 3-8-<\/p>\n
2007 in Crl. Appeal 1013 of 2007, default sentence cannot be<\/p>\n
CRL.R.P.NO. 1143\/2008          -:3:-<\/span><\/p>\n
imposed for the enforcement of an order for compensation under<\/p>\n
Section 357 (3) Cr.P.C.    Accordingly, for the conviction under<\/p>\n
Section 138 of the Act the revision petitioner is sentenced to pay<\/p>\n
a fine of Rs.95,000\/- (Rupees ninety five thousand only). The<\/p>\n
said fine shall be paid as compensation under Section 357 (1)<\/p>\n
Cr.P.C. The revision petitioner is permitted either to deposit the<\/p>\n
said fine amount before the Court below       or directly pay the<\/p>\n
compensation to the complainant within five months from today<\/p>\n
and produce a memo to that effect before the trial Court in case<\/p>\n
of direct payment.    If she fails to   deposit or pay the said<\/p>\n
amount within the aforementioned period,          she shall suffer<\/p>\n
simple imprisonment for three months by way of default<\/p>\n
sentence.\n<\/p>\n
      In the result, this Revision is disposed of confirming the<\/p>\n
conviction entered but modifying the sentence imposed on the<\/p>\n
revision petitioner.\n<\/p>\n<\/p>\n
