Singh, Advocate<\/p>\n<p>                                             &#8212;&#8212;&#8212;&#8211;\n<\/p>\n<p>13   10-12-2010                 Heard the parties.\n<\/p>\n<p>                                This letters patent appeal has been preferred<\/p>\n<p>                     against the judgement and order dated 8-2-2006 passed<\/p>\n<p>                     by a learned Single Judge of this court whereby the writ<\/p>\n<p>                     petition bearing CWJC no. 9605\/2004 preferred by the<\/p>\n<p>                     appellant was dismissed. The writ court in the impugned<\/p>\n<p>                     order has noticed that the appellant had challenged the<\/p>\n<p>                     select list prepared by the Indian Oil Corporation<br \/>\n<span class=\"hidden_text\">                    2<\/span><\/p>\n<p>pursuant to an advertisement which is said to be dated<\/p>\n<p>29-2-2004. According to the appellant the selection<\/p>\n<p>process was vitiated and required interference of this<\/p>\n<p>court but the writ court dismissed the writ petition<\/p>\n<p>summarily on the ground that decision was commercial<\/p>\n<p>decision which should not be interfered by this court.<\/p>\n<p>          Learned counsel for the appellant has raised all<\/p>\n<p>the grounds raised before the writ court inviting us to<\/p>\n<p>hold that the select list should be quashed because of<\/p>\n<p>irregularities in the selection process. It is not necessary<\/p>\n<p>for us to go into the details of these submissions in view<\/p>\n<p>of a fair stand taken by Mr. Chatterji, learned Senior<\/p>\n<p>counsel for the Indian Oil Corporation Ltd. He has<\/p>\n<p>placed before us the findings given by a team of two<\/p>\n<p>members constituting a High Power Committee which<\/p>\n<p>had looked into selection process in question relating to<\/p>\n<p>grant of licence for retail vending of LPG at Supaul. As<\/p>\n<p>per the findings certain irregularities were found in the<\/p>\n<p>selection process and the main irregularity noticed was in<\/p>\n<p>the act of the Dealer Selection Committee taking<\/p>\n<p>cognizance of documents submitted at the time of<br \/>\n<span class=\"hidden_text\">                   3<\/span><\/p>\n<p>interview instead restricting the evaluation on the basis<\/p>\n<p>of documents submitted at the time of application.<\/p>\n<p>          Learned counsel for the Corporation has taken<\/p>\n<p>a stand that in view of findings of the High Power<\/p>\n<p>Committee under the scheme of the Corporation<\/p>\n<p>candidates have to be called for re-interview so that<\/p>\n<p>irregularities noticed by the High Power Committee are<\/p>\n<p>avoided and fresh evaluation is done as per policy<\/p>\n<p>decision and guidelines of the Corporation.<\/p>\n<p>          Learned counsel for the respondent no.7, Niraj<\/p>\n<p>Kumar Singh, has submitted that the selection process<\/p>\n<p>was indeed erroneous but subsequent findings of the<\/p>\n<p>High Power Committee are in favour of placing of<\/p>\n<p>respondent no.7 as number one candidate in the select<\/p>\n<p>list. It goes without saying that the High Power<\/p>\n<p>Committee cannot be substituted in place of the Dealer<\/p>\n<p>Selection Committee and, therefore, re-interview as per<\/p>\n<p>established schemes and policy is required to be held.<\/p>\n<p>Re-interview by Dealer Selection Committee should be<\/p>\n<p>held properly and in accordance with law within a<\/p>\n<p>reasonable time, preferably, within three months.<br \/>\n<span class=\"hidden_text\">                           4<\/span><\/p>\n<p>                  In the result, the order under appeal is<\/p>\n<p>        modified and substituted by this order.
