Application No. 9497<br \/>\nof 2004 subject to certain conditions including that the applicant<br \/>\nshall not enter Bhachau Taluka. Said condition, however, was deleted<br \/>\nby subsequent order dated 28.01.2005 passed in Criminal Misc.<br \/>\nApplication No. 112 of 2005. Yet again by order dated 20.04.2007<br \/>\npassed in Criminal Misc. Application No. 14945 of 2006, following<br \/>\ncondition was reproduced while not entertaining the application for<br \/>\ncancellation of bail of the applicant:\n<\/p>\n<p>&#8220;(f)\tnot<br \/>\nenter into the revenue limits of Bhachau taluka without prior<br \/>\npermission of this Court, but for           attending the Court in<br \/>\nconnection with this case, he         will be free to enter the<br \/>\nlimits leave the limits                 soon thereafter the matter is<br \/>\nadjourned.&#8221;\n<\/p>\n<p>2.\tCounsel<br \/>\nsubmitted that the applicant has been acquitted in the criminal case<br \/>\non the basis of which the bail cancellation was prayed for. He<br \/>\nsubmitted that father of the applicant was killed and the accused<br \/>\nhave been convicted. He further submitted that the original case, in<br \/>\nwhich the applicant has been released on bail, is pending since 2004.<br \/>\nHe further requested that condition of not entering into Bhachau<br \/>\ntaluka limits may be deleted.\n<\/p>\n<p>3.\tConsidering<br \/>\nfacts and circumstances of the case, above noted condition No. (f) in<br \/>\norder dated 20.04.2007 is deleted. Rule is made absolute.
