In<br \/>\nsupport of the application a certificate from the Panchayat is<br \/>\nenclosed.\n<\/p>\n<p>2.\t RULE.\n<\/p>\n<p> Mr.Kartik Pandya,  learned Additional Public Prosecutor waives<br \/>\nservice of rule on  behalf of the respondent-State.\n<\/p>\n<p>3.\tThe<br \/>\napplicant- appellant- original accused has been convicted for the<br \/>\noffence punishable under section 302 of the IPC to suffer<br \/>\nimprisonment for life, with fine of Rs.5000\/-, in default to further<br \/>\nundergo imprisonment for 2 years as awarded by the learned Additional<br \/>\nSessions Judge, Vadodara in Sessions Case No.249 of 2005.\n<\/p>\n<p>4.\tThe learned<br \/>\nAPP has invited attention of the Court to the Jail remarks.  The<br \/>\nconvict had enjoyed temporary bail from 8th to 20th<br \/>\nFebruary 2011.  The convict had also enjoyed first and second<br \/>\nfurlough and parole for 30 days in 2007 for the purpose of filing<br \/>\nappeal in the High Court. Every time he had reported back in time.<br \/>\nThe convict&#8217;s Jail conduct is reported to be good.\n<\/p>\n<p>5.\tTaking into<br \/>\nconsideration the contents of the application and the record of the<br \/>\nconvict, the convict is ordered to be released on  temporary<br \/>\nbail for a period of 30 (thirty) days from the date of his<br \/>\nrelease on his executing a personal bond of Rs.5000\/- (Rupees five<br \/>\nthousand only) to the satisfaction of the Jail authorities.\n<\/p>\n<p>6.\tThe<br \/>\napplicant shall surrender himself to the Jail authorities on expiry<br \/>\nof the above temporary bail period.\tThe application is allowed.
