SAHAI\n\t\t\n\t\n\t \n\t\t \n\t\t\t \n\n \n\n\t\t\t\n\t\t\n\t\t \n\t\t\t \n\nand\n\t\t\n\t\n\t \n\t\t \n\t\t\t \n\n \n\n\t\t\t\n\t\t\n\t\t \n\t\t\t \n\nHONOURABLE\n\t\t\tMR.JUSTICE KS JHAVERI\n\t\t\n\t\n\n \n\n \n \n\n\n \n\nDate<\/a>\n: 11\/10\/2011 \nORAL JUDGMENT<\/pre>\n<p>(Per<br \/>\n: HONOURABLE MR.JUSTICE KS JHAVERI)<\/p>\n<p>\t\tBy<br \/>\nway of this Intra-Court Letters Patent Appeal, the appellant &#8211;<br \/>\noriginal petitioner has challenged the judgment and order dated<br \/>\n06.12.2010 passed by the learned Single Judge in Special Civil<br \/>\nApplication No.15443 of 2010 whereby the learned Single Judge has<br \/>\ndismissed the writ petition filed by the appellant.\n<\/p>\n<p>2.\t\tWe<br \/>\nhave heard learned counsel Mr. Prabhakar Upadhyaya appearing for the<br \/>\nappellant.\n<\/p>\n<p>2.1.\t\tThe<br \/>\nfacts of the case<br \/>\nare that the appellant preferred application under Section 79 of the<br \/>\nBombay Industrial Relations Act, 1946 before the Labour Court,<br \/>\nAhmedabad on behalf of one employee, namely, Shri  Sarvantsinh<br \/>\nOmkarsinh challenging his order of dismissal dated 30.03.1989.  The<br \/>\nsaid employee was working as a watchman in Ward staff in Arun Mills<br \/>\nCompany Limited.  The Mills Company submitted its written statement<br \/>\nbefore the Labour Court in T. Application No.215 of 1989.  The<br \/>\nCompany approached BIFR under the provisions of SICA.  Subsequently,<br \/>\nBIFR submitted report for winding up of the Company before this<br \/>\nCourt.  Based on the said report, this Court has passed an order<br \/>\ndated 05.07.1993 in Company Petition No.92 of 1993 whereby the Mills<br \/>\nCompany was ordered to be wound up by this Court under the provisions<br \/>\nof the Companies Act, 1956.  Pursuant to the said order of winding<br \/>\nup, the Official Liquidator had taken over the charge of the assets<br \/>\nof the Company in<br \/>\nliquidation on 29.07.1993.\n<\/p>\n<p>2.2\t\tThe<br \/>\nManaging Director of the Mills Company submitted purshish dated<br \/>\n19.10.1993 in T. Application No.215 of 1989 below Exh.16.  The Labour<br \/>\nCourt rejected the said application on 15.07.2004.  The appellant<br \/>\nthereafter filed restoration application before the Labour Court<br \/>\nbeing Misc. Application No.88 of 2005 which also came to be rejected<br \/>\non 07.08.2008 by not condoning the delay preferred in filing the said<br \/>\nMisc. Application.\n<\/p>\n<p>2.3\t\tBeing<br \/>\naggrieved by the said order of the Labour Court, the appellant filed<br \/>\nAppeal (IC) No.47 of 2008 which also came to be dismissed on<br \/>\n21.06.2010. Hence, the appellant preferred writ petition being<br \/>\nSpecial Civil Application No.15443 of 2010 which also came to be<br \/>\ndismissed by the Learned Single Judge on 06.12.2010.\n<\/p>\n<p>3.\t\tWhile<br \/>\nconsidering the case of the appellant, the learned Single Judge in<br \/>\nthe impugned judgment in paragraph 6 has observed as under :-\n<\/p>\n<p>&#8220;6.\tHaving<br \/>\nheard learned advocate appearing for the petitioner and having<br \/>\nconsidered the orders passed by the Labour Court as well as the<br \/>\nIndustrial Tribunal, the Court is of the view that though the<br \/>\napplication was pending before the Labour Court in 1989 and though<br \/>\nthe Company went into liquidation in 1993, from 1993 to 2004, no<br \/>\naction was taken by the petitioner either by seeking the permission<br \/>\nof this Court under Section 446 of the Companies Act, 1956 or by<br \/>\nrequesting the Labour Court to join the Official<br \/>\nLiquidator as party despite the fact that the Managing Director has<br \/>\nalready filed purshish to that effect.  This gross delay of 11 years<br \/>\nis not explained at all.  As a matter of fact, in absence of<br \/>\npermission under Section 446, the petitioner could not have proceeded<br \/>\nwith the said T. Application.  The Labour Court has, therefore,<br \/>\nrightly rejected the said application and even restoration<br \/>\napplication was rightly rejected as it was not filed in time and<br \/>\ndelay was not explained at all.  The Industrial Tribunal has also<br \/>\ndismissed the appeal confirming the order passed by the Labour Court.<br \/>\n Since there is concurrent finding of both the Courts below and<br \/>\nlooking to the facts of the case, the Court does not think it just<br \/>\nand proper to show any indulgence in the matter.  Even otherwise,<br \/>\nthis Court while exercising its power under Article 227 of the<br \/>\nConstitution of India, does not interfere in the orders passed by the<br \/>\nCourts below and the said order is not in excess of jurisdiction or<br \/>\nnot in violation of principles of natural justice.&#8221;\n<\/p>\n<p>4.\t\tWe<br \/>\nare in complete agreement with the view taken by the learned Single<br \/>\nJudge.  No case is made out for interference.  The present appeal is<br \/>\ndevoid of any merits and deserves to be dismissed.  Accordingly, the<br \/>\npresent appeal stands dismissed.
