Justice M.RAMACHANDRAN\n\n Dated :23\/01\/2007\n\n O R D E R\n                        (V.K.BALI, C.J. &amp; M.RAMACHANDRAN, J)\n\n         -------------------------------------------------------------\n\n\n                        W.A.No. 2459 of  2005-A\n\n\n         --------------------------------------------------------------\n\n               Dated this the  23rd day of January, 2007\n\n\n                                 JUDGMENT\n<\/pre>\n<p>Ramachandran, J:\n<\/p>\n<\/p>\n<p>       Writ   Petition   filed   by   the   petitioner   [W.P.(C).No.16837   of<\/p>\n<p>2005] had been disposed of by the learned single Judge holding<\/p>\n<p>that   the   demand   made   by   the   first   respondent&#8211;Bank   could   not<\/p>\n<p>have   been   stated   to   be   unreasonable   and   consequently   the<\/p>\n<p>proceedings   before   the   Debt   Recovery   Tribunal   could   not   have<\/p>\n<p>been   faulted.     But,   however,   it   was   held   that   if   he   made   the<\/p>\n<p>payment as demanded by the Bank and settled the liability within<\/p>\n<p>the   time   prescribed,   coercive   proceedings   as   against   the<\/p>\n<p>petitioner   were   to   be   kept   in   suspension.     The   learned   single<\/p>\n<p>Judge had noticed that the petitioner had availed of a loan about<\/p>\n<p>15 years back and the  initial liability of Rs.7 lakhs had jumped to<\/p>\n<p>Rs.27   lakhs     and   although   the   petitioner   had   offered   to   pay<\/p>\n<p>Rs.8.25   lakhs   on   20-10-2004,   the   Bank   had   been   demanding<\/p>\n<p>Rs.9,72,589\/-.   This  sum, according  to  the  learned single Judge,<\/p>\n<p>was   reasonable   in   all   respects.       The   contention   raised   by   the<\/p>\n<p><span class=\"hidden_text\">[WA No.2459 of 2005]                      -2-<\/span><\/p>\n<p>petitioner   was   that   the   guidelines   issued   by   the   Reserve   Bank   of<\/p>\n<p>India   required   to   be   implicitly   followed,   and   if   so,   any   lesser<\/p>\n<p>amounts would have been payable.   But, according to the learned<\/p>\n<p>Judge,   guidelines   were   not   enforceable   by   a   court   of   law,   since<\/p>\n<p>such guidelines could not have overruled the contract between the<\/p>\n<p>parties   and   the   Reserve   Bank   was   not   competent   to   supersede<\/p>\n<p>agreements   executed   between   the   borrower   and   the   creditor.<\/p>\n<p>Feeling aggrieved about the judgment as above, the petitioner has<\/p>\n<p>filed this appeal.\n<\/p>\n<\/p>\n<p>       2.     The primary contention of Mr.Abdul Jabbar, appearing<\/p>\n<p>for   the   appellant,   is   that   the   learned   single   Judge   had   erred   in<\/p>\n<p>entering the finding that the guidelines issued by the Reserve Bank<\/p>\n<p>was   not   binding   on   the   first   respondent&#8211;Bank.     The   further<\/p>\n<p>submission is that if such guidelines were applied in the matter of<\/p>\n<p>interest   payable,   and   also   declaration   of   the   date   when   the<\/p>\n<p>transaction became   a non-performing asset, the demand as made<\/p>\n<p>by the Bank would have come down.\n<\/p>\n<\/p>\n<p>       3.     On   the   other   hand,   Mr.M.Pathrose   Mathai,   senior<\/p>\n<p>counsel   appearing   for   the   respondents,   submitted   that   since   the<\/p>\n<p>issue   was   already   before   the   Debt   Recovery   Tribunal   and   there<\/p>\n<p>might be element of interest as payable during the pendency of the<\/p>\n<p><span class=\"hidden_text\">[WA No.2459 of 2005]                        -3-<\/span><\/p>\n<p>writ   petition   as   well   as     writ   appeal,   it   would   have   been   more<\/p>\n<p>appropriate   to     remit   the   issue   back   to   the   Tribunal.     It   is   also<\/p>\n<p>suggested that the guidelines were not statutory and the argument<\/p>\n<p>of the appellant therefore may not be sustainable.<\/p>\n<p>        4.     Mr.Abdul   Jabbar   referred   to   two   decisions   of   the<\/p>\n<p>Supreme Court, namely  <a href=\"\/doc\/1423031\/\">Central Bank of India  v.  Ravindra<\/a> [AIR<\/p>\n<p>2001  SC 3095] and  <a href=\"\/doc\/1879607\/\">Mardia  Chemicals  v.  Union of India<\/a>  [2004<\/p>\n<p>(2)   KLT   273],   which   conclusively   speak   that   directions\/circulars<\/p>\n<p>dealing   with   charging             rate   of   interest   and   capitalisation<\/p>\n<p>procedure,   which   were   issued   by   the   Reserve   Bank   from   time   to<\/p>\n<p>time are binding on the other Banks.   Therefore, we find that the<\/p>\n<p>observations of the learned single Judge to the contrary require to<\/p>\n<p>be vacated.   Otherwise arbitrariness will govern the field.<\/p>\n<p>        5.      However,  it  is necessary  that attention in some detail<\/p>\n<p>is to be invested as to the liability of the appellant and this has to<\/p>\n<p>be   determined   in   the   light   of   the   Circulars   which   govern   the<\/p>\n<p>transactions.     It   will   be   beneficial   for   the   parties   therefore   to<\/p>\n<p>agitate   the   matter   before   the   Debt   Recovery   Tribunal   in   the<\/p>\n<p>pending   proceedings   [O.A.No.51   of   1999].     The   Tribunal   has   to<\/p>\n<p>take   notice   of   the   rival   contentions   appropriate   and   come   to   a<\/p>\n<p>decision   in   accordance   with   law   and   in   the   light   of   the<\/p>\n<p><span class=\"hidden_text\">[WA No.2459 of 2005]                              -4-<\/span><\/p>\n<p>observations made earlier.\n<\/p>\n<\/p>\n<p>        6.       The writ   appeal  is disposed of  as  above.
