His right for<br \/>\nconsideration would arise in case the ESM candidates are not<br \/>\navailable. There is no information placed on record by the petitioner<br \/>\nto show that the ESM candidates are not available.\n<\/p>\n<p>            Counsel     contends     that   the   petitioner   had   sought<br \/>\ninformation under the Right to Information Act, but the same has not<br \/>\nbeen supplied to him. The petitioner may first obtain the information<br \/>\nand then may make an approach before this court.
