No.<br \/>\nI-104\/2010, has been registered with Udhna Police Station.\n<\/p>\n<p>3.\tLearned<br \/>\nadvocate Shakeel Qureshi referred to the papers and submitted that as<br \/>\nthe thief had entered the society, it resulted in the incident and<br \/>\nthe applicant has been falsely implicated and submitted that as now<br \/>\nthe charge sheet has been filed and other co-accused have been<br \/>\nreleased as per the order passed in Criminal Misc. Application Nos.<br \/>\n10676 of 2010 dated 17.9.2010, 11082 of 2010 dated 28.9.2010 and<br \/>\n10096 of 2010 dated 3.9.2010,  the present application may be<br \/>\nallowed.\n<\/p>\n<p>4.\tLearned<br \/>\nAPP Ms. Shah resisted the application.\n<\/p>\n<p>5.\tHaving<br \/>\nheard learned advocate Mr. Qureshi and learned APP Ms. Shah and<br \/>\nhaving considered the nature of offence, the role attributed and also<br \/>\nconsidering the fact that charge sheet has now been filed and other<br \/>\nco-accused have been released, the present application deserves to be<br \/>\nallowed.\n<\/p>\n<p>6.\tThe<br \/>\napplication is accordingly allowed.  The applicant is ordered to be<br \/>\nreleased on bail in connection with C.R. No. I-104\/2010<br \/>\nregistered with Udhna Police Station on his executing a<br \/>\npersonal bond of Rs. 5,000\/- (Rupees Five Thousand only) with one<br \/>\nsolvent surety for the like amount to the satisfaction of the lower<br \/>\ncourt and subject to the further conditions that he shall :\n<\/p>\n<p>(a)\tnot<br \/>\ntake undue advantage of his liberty or abuse his liberty.\n<\/p>\n<p>(b)\tnot to<br \/>\ntry to tamper or pressurize the prosecution witnesses or complainant<br \/>\nin any manner;\n<\/p>\n<p>(c )\tnot<br \/>\nact in any manner injurious to the interests of the prosecution.\n<\/p>\n<p>(d)\tmaintain<br \/>\nlaw and order and should co-operate with the investigating officers;\n<\/p>\n<p>(e)\tmark<br \/>\nhis presence before the concerned Police Station on the first Monday<br \/>\nof every calendar month between 11.00 am to 2.00 pm till the trial<br \/>\ncommences.\n<\/p>\n<p>(f)\tfurnish<br \/>\nthe address of his residence to the investigating officer and also to<br \/>\nthe court at the time of execution of the bond and shall not change<br \/>\nhis residence without prior permission of the court.\n<\/p>\n<p>(g)\tsurrender<br \/>\nhis passport, if any, to the lower court, within a week.\n<\/p>\n<p>7.\tIf<br \/>\nbreach of any of the above conditions is committed, the concerned<br \/>\nSessions Judge will be free to issue warrant or take appropriate<br \/>\naction in the matter.\n<\/p>\n<p>8.\tBail<br \/>\nbefore the lower court having jurisdiction to try the case. It would<br \/>\nbe open to the trial court concerned to give time to furnish the<br \/>\nsolvency certificate, if prayed for.\n<\/p>\n<p>\tRule is<br \/>\nmade absolute.
