JUSTICE JYOTI SARAN\n\n                                         ORAL ORDER<\/pre>\n<p>                       (Per: HONOURABLE THE CHIEF JUSTICE)<\/p>\n<p>7   30\/9\/2010               Heard the learned advocates.\n<\/p>\n<p>                            With the consent of the learned advocates, the<br \/>\n                 petition is heard and decided today.\n<\/p>\n<p>                            The petitioner, a resident of village- Sirsa, Police<br \/>\n                 Station &#8211; Muffasil Motihari, District &#8211; East Champaran, is<br \/>\n                 a social and political worker. The petitioner has brought<br \/>\n                 this petition under Article 226 of the Constitution in public<br \/>\n                 interest. It is the complaint of the petitioner          that the<br \/>\n<span class=\"hidden_text\">                    2<\/span><\/p>\n<p>respondent no.1 &#8211; the Bihar School Examination Board<br \/>\n(hereinafter referred to as \u201ethe Board\u201f) and its Chairman,<br \/>\nrespondent no.2, have committed illegality in giving the<br \/>\nCode number to the respondent no.5 Sri Anugrah Narain<br \/>\nSingh College, East Champaran at Motihari (hereinafter<br \/>\nreferred to as \u201ethe College\u201f) though it was     derecognized<br \/>\nas early as in the year 2004.\n<\/p>\n<p>           The learned advocate Mr. H.S. Himkar          has<br \/>\nappeared for the petitioner.     He has relied upon the<br \/>\ncommunication dated 14th May 2004 addressed by the then<br \/>\nBihar Intermediate Education Council, Patna to the College.<br \/>\nUnder the said communication, the College was informed<br \/>\nthat the    College had failed to satisfy the terms and<br \/>\nconditions of the temporary recognition         such as, the<br \/>\nCollege did not have its own land, the building of the<br \/>\nCollege taken on lease for 30 years was dilapidated; and<br \/>\nthe College did not have a laboratory or a library. The<br \/>\ntemporary recognition granted to the College was,<br \/>\ntherefore, cancelled for the said reasons in the interest of<br \/>\neducation and the students.\n<\/p>\n<p>           The petitioner has alleged         that since the<br \/>\ncancellation of the recognition, no fresh recognition has<br \/>\nbeen granted to the College, nevertheless the College has<br \/>\nbeen granted the Code number under communication<br \/>\ndated 31st July 2008, meaning thereby that the students<br \/>\nadmitted by the College are permitted to take the Board<br \/>\nexamination.\n<\/p>\n<p>           In answer to the notice issued by this Court, the<br \/>\nrespondents have entered appearance and have contested<br \/>\n<span class=\"hidden_text\">                      3<\/span><\/p>\n<p>the petition.\n<\/p>\n<p>            The Board       has appeared through the learned<br \/>\nadvocate Mr. Purnendu singh. He has submitted that the<br \/>\nBihar Intermediate Education Council Act, 1992 has been<br \/>\nrepealed under the Bihar Intermediate education Council<br \/>\nAct, 2007 (hereinafter referred to as &#8220;the Repeal Act&#8221;). It<br \/>\nmay, however, be noted that under section 7 of the Repeal<br \/>\nAct, any act done or any action taken under the Bihar<br \/>\nIntermediate Education Council Act, 1992 has been saved.<br \/>\nThus, in our view, the cancellation of the temporary<br \/>\nrecognition of the College       continues to be in force in<br \/>\nspite of the Repeal Act. The learned advocate has also<br \/>\nrelied on the resolution dated 13th May 2008 passed by the<br \/>\nBihar School Examination Board, Patna.               He    has<br \/>\nsubmitted that under the said resolution the Board had<br \/>\ndecided to allow the students of the institutions to take the<br \/>\nBoard examination. It was pursuant to the said resolution<br \/>\nthat the impugned action of granting Code number to the<br \/>\nCollege was taken.\n<\/p>\n<p>            The fallacy in the submission is apparent. The<br \/>\nresolution in question was passed in respect of           those<br \/>\nColleges     which were        recognized    and    which had<br \/>\nsubmitted       the list of their students who were to take the<br \/>\nBoard examination. Evidently, the said resolution did not<br \/>\napply to the institutions which were not recognized.<br \/>\nHowever, taking the shelter under the said resolution, the<br \/>\nCollege was granted Code number             illegally under the<br \/>\nsignature of the Deputy Controller of Examination. The<br \/>\naction was depricable and        is deprecated.    The learned<br \/>\n<span class=\"hidden_text\">                    4<\/span><\/p>\n<p>advocate has conceded that the Board has failed to bring<br \/>\non record       any material to establish that        since its<br \/>\nderecognition the College did remove the deficiencies and<br \/>\nthat it was granted recognition afresh.\n<\/p>\n<p>           The learned advocate Mr. Tej Bahadur Singh has<br \/>\nappeared for the College.     He admits that      since      its<br \/>\nderecognition      the College has not been granted<br \/>\nrecognition afresh. He has relied upon the            inspection<br \/>\nreport made by the District Education Officer on 31st<br \/>\nMarch 2009. He has submitted that though the inspection<br \/>\nreport was made as early as on 31st March 2009, till date<br \/>\nthe Board has not taken any decision on it. Pending the<br \/>\ndecision the Board has permitted the students of the<br \/>\nCollege to take examination through other institutions.\n<\/p>\n<p>           We may, at the outset, note that the copy of the<br \/>\ninspection report placed before us is incomplete and<br \/>\nhardly discloses any material fact about the College. As<br \/>\nrecorded hereinabove, it is an admitted fact that till date<br \/>\nthe College has not been given recognition nor it is<br \/>\naffiliated to the Board. The College is thus not entitled to<br \/>\nadmit students nor the students are entitled to take the<br \/>\nBoard     examination. Nevertheless,      under the    guise of<br \/>\nCode number granted to the College the students are<br \/>\npermitted to take the examination. Thus, the illegality is<br \/>\nperpetuated from year to year. Neither the Board nor the<br \/>\nCollege         has any problem with this             makeshift<br \/>\narrangement.\n<\/p>\n<p>            Learned advocate Mr. Tej Bahadur Singh has<br \/>\ncandidly admitted that the College does admit the students<br \/>\n<span class=\"hidden_text\">                             5<\/span><\/p>\n<p>         and charge the fees but does not inform the students or<br \/>\n         their guardians that the College is not recognized or not<br \/>\n         affiliated to the Board.\n<\/p>\n<p>                     Illegality is writ large. No further evidence or<br \/>\n         material is required. Neither of the respondents is in a<br \/>\n         position to controvert the aforesaid fact situation.\n<\/p>\n<p>                     In above   view of the matter,      we allow this<br \/>\n         petition.   The impugned communication dated 31st July<br \/>\n         2008 granting Code number to Shri Anugrah Narain Singh<br \/>\n         College, East Champaran at Motihari is set aside. Legal<br \/>\n         consequences shall follow.      It will be    the duty of the<br \/>\n         respondent Bihar School Examination Board to give wide<br \/>\n         publicity to the fact that the above referred Shri Anugrah<br \/>\n         Narain Singh College, East Champaran at Motihari is not<br \/>\n         recognized nor it is affiliated to the Board. If at all the<br \/>\n         application made by the College for recognition\/affiliation<br \/>\n         is pending before the Board, the Board will consider and<br \/>\n         decide the same in accordance with law within two months<br \/>\n         from today<br \/>\n                     The writ petition is allowed to the above extent.\n<\/p>\n<p>         The parties will bear their own cost.<\/p>\n<pre>\n\n\n\n                                       ( R.
