Expenditure, \u00a0 Ministry \u00a0 of \u00a0 Finance, \u00a0 point \u00a0 Nos. \u00a0 37 \u00a0 &amp; \u00a0 38 \u00a0 were\u00a0<br \/>\ntransferred\u00a0to\u00a0the\u00a0State\u00a0Government\u00a0of\u00a0Kerala.\u00a0 \u00a0The\u00a0Director\/CPIO\/Ministry\u00a0of\u00a0<br \/>\nAgriculture \u00a0 and \u00a0 Cooperation \u00a0 replied \u00a0 to \u00a0 the \u00a0 Appellant \u00a0 vide \u00a0 his \u00a0 letter \u00a0 dated\u00a0<br \/>\n7.12.2009.\u00a0 \u00a0Aggrieved\u00a0with\u00a0the\u00a0response\u00a0of\u00a0various\u00a0Respondents,\u00a0the\u00a0Appellant\u00a0<br \/>\nfiled \u00a0 first \u00a0 appeal \u00a0 before \u00a0 the \u00a0 First \u00a0 Appellate \u00a0 Authority \u00a0 (FAA), \u00a0 Shri \u00a0 Atanu\u00a0<br \/>\nPurkayastha,\u00a0Joint\u00a0Secretary\u00a0&amp;\u00a0Mission\u00a0Director\u00a0(Hort)\/FAA,\u00a0who\u00a0vide\u00a0his\u00a0reply\u00a0<br \/>\ndated\u00a019.3.2010\u00a0\u00a0held\u00a0as\u00a0follows:\u00ad<br \/>\n         &#8220;The\u00a0CPIO(s)\u00a0have\u00a0made\u00a0sincere\u00a0efforts\u00a0to\u00a0provide\u00a0the\u00a0information\u00a0within \u00a0<br \/>\nthe\u00a0stipulated\u00a0time\u00a0period.\u00a0\u00a0However:\u00ad<\/p>\n<p>        (i)\u00a0For\u00a0points\u00a0no.8,\u00a09,\u00a010,\u00a011,\u00a016\u00a0and\u00a018\u00a0the\u00a0concerned\u00a0CPIO\u00a0(Marketing) \u00a0<br \/>\nhas \u00a0 informed \u00a0 that \u00a0 the \u00a0 information \u00a0 was \u00a0 provided \u00a0 to \u00a0 you \u00a0 vide \u00a0 letter \u00a0 dated \u00a0<br \/>\n8.12.2009,\u00a0which\u00a0has\u00a0again\u00a0been\u00a0sent\u00a0to\u00a0you\u00a0on\u00a09.3.2010.\n<\/p>\n<p>       (ii)\u00a0For\u00a0points\u00a0No.\u00a01\u00a02,\u00a03,\u00a04\u00a0&amp;\u00a015,\u00a0the\u00a0CPIO\u00a0(Hort)\u00a0is\u00a0directed\u00a0to\u00a0provide\u00a0you \u00a0<br \/>\nadditional\u00a0information.\n<\/p>\n<p>     (iii)\u00a0\u00a0For\u00a0point\u00a0no.5,\u00a0you\u00a0may\u00a0seek\u00a0the\u00a0information\u00a0from\u00a0the\u00a0Directorate\u00a0of \u00a0<br \/>\nEconomic\u00a0and\u00a0Statistics.\n<\/p>\n<p>     (iv) \u00a0 For \u00a0 points \u00a0 No.36, \u00a0 37 \u00a0 and \u00a0 38, \u00a0 you \u00a0 may \u00a0 seek \u00a0 the \u00a0 information \u00a0 from \u00a0<br \/>\nKSHPDC.&#8221;\n<\/p>\n<p>       The \u00a0 FAA \u00a0 has \u00a0 also \u00a0 held \u00a0 that \u00a0 Appellant \u00a0 is \u00a0 seeking \u00a0 interpretations\/\u00a0<br \/>\ninferences\/\u00a0explanations\u00a0related\u00a0to\u00a0government\u00a0policies,\u00a0which\u00a0are\u00a0not\u00a0covered\u00a0<br \/>\nunder\u00a0RTI\u00a0Act,\u00a02005.\n<\/p>\n<p>        Not\u00a0satisfied\u00a0with\u00a0the\u00a0reply\u00a0of\u00a0the\u00a0FAA,\u00a0the\u00a0Appellant\u00a0has\u00a0filed\u00a0the\u00a0present\u00a0<br \/>\nappeal\u00a0before\u00a0the\u00a0Commission\u00a0in\u00a0which\u00a0he\u00a0pleads\u00a0\u00a0that\u00a0replies\u00a0from\u00a0most\u00a0CPIOs\u00a0<br \/>\nhave \u00a0 either \u00a0 not \u00a0 been \u00a0 furnished \u00a0 and \u00a0 those \u00a0 that \u00a0 have \u00a0 been \u00a0 furnished \u00a0 are\u00a0<br \/>\nincomplete,\u00a0incorrect\u00a0and\u00a0misleading\u00a0and\u00a0sent\u00a0after\u00a0the\u00a0statutory\u00a0time\u00a0limit.\u00a0\u00a0The\u00a0<br \/>\nAppellant \u00a0 submits \u00a0 that \u00a0 the \u00a0 \u00a0 FAA \u00a0 has \u00a0 directed \u00a0 the \u00a0 Appellant \u00a0 to \u00a0 obtain \u00a0 the\u00a0<br \/>\ninformation \u00a0independently \u00a0 from\u00a0 different \u00a0CPIOs, \u00a0thus \u00a0unilaterally\u00a0 absolving \u00a0the\u00a0<br \/>\nCPIO\u00a0from\u00a0his\u00a0legal\u00a0obligation\u00a0u\/s\u00a06(3)\u00a0of\u00a0the\u00a0RTI\u00a0Act\u00a0and\u00a0facilitate\u00a0information\u00a0to\u00a0<br \/>\nthe \u00a0 RTI \u00a0 application. \u00a0 \u00a0 The \u00a0 Appellant, \u00a0 therefore \u00a0 pleads \u00a0 that \u00a0 NHM, \u00a0 the \u00a0 Public\u00a0<br \/>\nAuthority\u00a0and\u00a0FAA\u00a0and\u00a0Joint\u00a0Secretary\u00a0(NHM)\u00a0may\u00a0provide\u00a0complete\u00a0and\u00a0correct\u00a0<br \/>\ninformation \u00a0 to \u00a0 the \u00a0 Appellant \u00a0 and \u00a0 that \u00a0 they \u00a0 may \u00a0 be \u00a0 asked \u00a0 to \u00a0 comply \u00a0 with \u00a0 the\u00a0<br \/>\nrequirement\u00a0of\u00a0facilitating\u00a0and\u00a0organizing\u00a0the\u00a0inspection\u00a0of\u00a0documents\/papers\u00a0\u00a0of\u00a0<br \/>\nnot\u00a0only\u00a0National\u00a0Horticulture\u00a0Mission\u00a0but\u00a0also\u00a0the\u00a0\u00a0other\u00a0Public\u00a0Authorities.\n<\/p>\n<p>       In \u00a0 a \u00a0 written \u00a0 statement, \u00a0 during \u00a0 the \u00a0 hearing, \u00a0 Shri \u00a0 Sanjiv \u00a0 Chopra, \u00a0 Joint\u00a0<br \/>\nSecretary\u00a0(NHM)\u00a0submits\u00a0that\u00a0the\u00a0Appellant\u00a0is\u00a0an\u00a0ex\u00ademployee\u00a0of\u00a0the\u00a0Ministry\u00a0of\u00a0<br \/>\nAgriculture\u00a0and\u00a0at\u00a0the\u00a0time\u00a0of\u00a0filing\u00a0the\u00a0application\u00a0and\u00a0he\u00a0was\u00a0in\u00a0service.\u00a0 \u00a0The\u00a0<br \/>\nAppellant \u00a0 has \u00a0 sought \u00a0 voluminous \u00a0 information \u00a0 on \u00a0 38 \u00a0 points \u00a0 related \u00a0 to \u00a0 different\u00a0<br \/>\nsubject \u00a0 matters \u00a0 concerning \u00a0 different \u00a0 CPIOs \u00a0 of \u00a0 Department \u00a0 of \u00a0 Agriculture \u00a0 &amp;\u00a0<br \/>\nCooperation\u00a0(DAC),\u00a0other\u00a0departments\u00a0and\u00a0State\u00a0Governments.\u00a0 \u00a0The\u00a0Appellant\u00a0<br \/>\nbeing\u00a0an\u00a0employee\u00a0of\u00a0DAC\u00a0should\u00a0have\u00a0sought\u00a0information\u00a0from\u00a0the\u00a0concerned\u00a0<br \/>\n CPIOs.\u00a0\u00a0However,\u00a0he\u00a0has\u00a0addressed\u00a0his\u00a0application\u00a0to\u00a0the\u00a0CPIO\u00a0(NHM),\u00a0Ministry\u00a0<br \/>\nof\u00a0Agriculture,\u00a0(DAC).\u00a0 \u00a0The\u00a0Appellant\u00a0had\u00a0also\u00a0sought\u00a0explanations,\u00a0inferences\u00a0<br \/>\nand\u00a0interpretations\u00a0of\u00a0various\u00a0schemes\/programmes\u00a0of\u00a0DAC\u00a0as\u00a0well\u00a0as\u00a0of\u00a0other\u00a0<br \/>\ndepartments.\u00a0 \u00a0The\u00a0CPIO\u00a0(NHM),\u00a0to\u00a0whom\u00a0the\u00a0application\u00a0was\u00a0addressed,\u00a0has\u00a0<br \/>\nforwarded\u00a0the\u00a0same\u00a0to\u00a0the\u00a0following\u00a0CPIOs\u00a0for\u00a0furnishing\u00a0the\u00a0relevant\u00a0information\u00a0<br \/>\nto\u00a0the\u00a0Appellant:\n<\/p>\n<blockquote><p>            a.  AMD\u00a0&amp;\u00a0CPIO,\u00a0National\u00a0Horticulture\u00a0Board.<br \/>\n            b. \u00a0 Commission \u00a0 is \u00a0 of \u00a0 the \u00a0 view \u00a0 that \u00a0 there \u00a0 is \u00a0 no \u00a0 omission \u00a0 on \u00a0 the \u00a0 part \u00a0 of\u00a0<br \/>\nRespondent \u00a0 in \u00a0 forwarding \u00a0 the \u00a0 RTI \u00a0 application \u00a0 to \u00a0 the \u00a0 concerned \u00a0 PIO, \u00a0 on \u00a0 the\u00a0<br
