7   13.12.2010                       The petitioners are employees in the Road Construction<\/p>\n
                    Department, Government of Bihar, Road Circle at Purnea. They are all<\/p>\n
                    aggrieved by the action of the respondent-District Accounts Officer in<\/p>\n
                    holding that they, not having passed Accountancy Examination, were not<\/p>\n
                    liable to be granted the first time bound promotion. They passed the said<\/p>\n
                    departmental examination in the year, 1998 and would, accordingly, get<\/p>\n
                    the first time bound promotion from that date. Pursuant to the aforesaid,<\/p>\n
                    petitioners’ pay scales were reduced and alleged excess amount paid were<\/p>\n
                    ordered to be recovered. Accordingly, deductions were being made till
\n                          2<\/span>
\nthis Court stayed the deductions. I make it clear that this Court did not<\/p>\n
stay reduction in pay but only the recovery of alleged past excess<\/p>\n
payments.\n<\/p>\n
                Counter affidavit has been filed. Learned counsel for the<\/p>\n
State submits that the condition for grant of time bound promotion, either<\/p>\n
at the end of 10 years or 25 years as the case may be, is an anti stagnation<\/p>\n
measure where if an employee is otherwise qualified and competent to be<\/p>\n
promoted but cannot get the promotion because of non-availability of<\/p>\n
promotional seats, he is given time bound promotion. Here, petitioners<\/p>\n
were required, as a matter of course, to pass the departmental examination<\/p>\n
in Accounts which they ultimately did in 1998 but notwithstanding that<\/p>\n
petitioner No 1 was granted first time bound promotion in 1995 and the<\/p>\n
rest in 1990.     Mr Bipin Kumar Sinha, learned counsel appearing in<\/p>\n
support of the writ petition submits with reference to the Government<\/p>\n
Circular as contained in Annexure-8 with regard to time bound<\/p>\n
promotion. It does not speak of any departmental examination. To that<\/p>\n
extent, he is correct but he is substantially wrong inasmuch as it states that<\/p>\n
a person, who is otherwise fit for being promoted, shall be granted time<\/p>\n
bound promotion.\n<\/p>\n
                In my view, this aspect of the matter, this Court has already<\/p>\n
dealt with and discussed in the case of Daya Shankar Singh -Versus-<\/p>\n
State of Bihar and others since reported in 2010 (3) PLJR 220. The<\/p>\n
scheme of the time bound promotion and the law in that regard has been<\/p>\n
dealt in detail and it has been held that no promotion having been granted<\/p>\n
to a person for over 10 years, he may still not be liable to be given time
\n                                   3<\/span>
\n          bound promotion if there be a requirement of passing departmental<\/p>\n
          examination in the normal course for seeking promotion and it is not so<\/p>\n
          passed.   However, in fairness to Mr Sinha, learned counsel for the<\/p>\n
          petitioner, in that very judgment, this Court has noticed that as petitioner<\/p>\n
          was not at fault, there could not be any recovery from remunerations paid<\/p>\n
          to him though necessary corrections with prospective effect could be<\/p>\n
          made.\n<\/p>\n
                        Thus, in my view, though this Court holds that State was<\/p>\n
          correct in withdrawing the time bound promotion as granted to the<\/p>\n
          petitioners which they would ordinarily be entitled to get. They could<\/p>\n
          only be entitled to be considered for time bound promotion in 1998 after<\/p>\n
          they passed the departmental examination. This is, however, subject to<\/p>\n
          the scheme of time bound promotion being available then.               Thus,<\/p>\n
          substantially the writ petition stands dismissed but so far as recoveries are<\/p>\n
          ordered to be made and have been made, they cannot be sustained. The<\/p>\n
          matter could not be reopened after such a long time to the detriment of the<\/p>\n
          petitioners, some of whom have already retired. Thus, any amount sought<\/p>\n
          to be recovered and any amount recovered has to be stopped and\/or<\/p>\n
          refunded, as the case may be, to the petitioners. The order, if any, would<\/p>\n
          operate prospectively only.\n<\/p>\n
                        With these observations, the writ petition stands disposed<\/p>\n
          of.\n<\/p>\n<\/p>\n
