\tRule.\n<\/p>\n
Mr.L.B. Dabhi, learned APP wavies service of notice of Rule on behalf
\nof the respondent-State.\n<\/p>\n
\tThis
\nmatter was mentioned in the morning today by the learned advocate
\nstating that the matter may be taken up for hearing at 2:30 and that
\ntoo only for interim bail for a period of one day as applicant no.2
\nlost his son on 14.06.2011 and a religious ceremony is to be
\npreformed on 20.06.2011.\n<\/p>\n
\tPermission
\nas prayed for was granted.  The matter was notified for hearing
\ntoday in a separate board of 2:30. When the matter was taken up for
\nhearing, this Court found that the offences punishable are 326, 504
\nread with 114 of the Indian Penal Code and Section 135 of the Bombay
\nPolice Act.\n<\/p>\n
\tTaking
\ninto consideration the offence with which the accused –
\napplicants have been charged, the application is taken up for hearing
\ntoday itself.\n<\/p>\n
\tThe
\napplicants pray for regular bail in connection with the offences
\nregistered with Vansda Police Station, Navsari vide C.R.No.I-45 of
\n2011 for the offences punishable under Sections 326, 504 read with
\n114 of the Indian Penal Code and Section 135 of the Bombay Police
\nAct.\n<\/p>\n
\tI
\nhave heard learned advocate Mr. Bharda for the applicants and Mr.L.B.
\nDabhi, learned APP for the respondent-State.\n<\/p>\n
\tIn
\nthe facts and circumstances of the case, I am persuaded to exercise
\nmy discretion in favour of the accused -applicants taking into
\nconsideration the following aspects:-\n<\/p>\n
\t(i)\tAll
\noffences are triable by the Magistrate<\/p>\n
\t(ii)\tInjured
\nhas been discharged from the hospital<\/p>\n
(iii)\tPrima-facie
\nit appears to be a case of inter-se dispute between the family
\nmembers. The accused no.1 is said to have hit the injured with a
\nbrick, which was lying nearby and the accused no.2 is said to have
\ninflicted a blow on the head of the injured with the stick<\/p>\n
(iv)\tInvestigation
\nis practically over<\/p>\n
\t(v)\tThere
\nare no past antecedents  or criminal history of the
\n\t\taccused-applicants <\/p>\n
(vi)\tThe
\nincident has occurred at the spur of moment on a \tvery trivial issue
\nwithout any pre-planned or any pre- \tmeditation   <\/p>\n
\tTaking
\ninto consideration the aforesaid prima facie aspects, I order release
\nof the accused – applicants on regular bail in connection with
\noffence registered with Vansda Police Station, Navsari being
\nC.R.No.I-45 of 2011 on each of them executing a bond in the sum of
\nRs.15,000\/- (Rupees fifteen thousand only) with one solvent surety of
\nthe like amount to the satisfaction of the Lower Court and subject to
\nthe conditions that they shall,<\/p>\n
\t(a)\tnot
\ntake undue advantage of or misuse liberty;\n<\/p>\n
\t(b)\tmaintain
\nlaw and order and should co-operate with the  \t\tInvestigating
\nOfficer;\n<\/p>\n
(c)
\n \tnot act in a manner injurious to the interest of the prosecution;\n<\/p>\n
(d)\tsurrender
\nhis passport, if any, to the Lower Court within a week;\n<\/p>\n
(e)\tshall
\nmark his presence before the concerned Police Station in a month of
\nevery 4th
\nSunday between 10:00 A.M. and 5:00 P.M.\n<\/p>\n
(f)\tnot
\nleave the local limits of the State of Gujarat without prior
\npermission of the Sessions Judge concerned;\n<\/p>\n
(g)\tfurnish
\nthe address of their residence at the time of execution of the bond
\nand shall not change the residence without prior permission of this
\nCourt.\n<\/p>\n
\tThe
\nauthorities will release the applicants only if he is not required in
\nconnection with any other offence for the time being.\n<\/p>\n
\tIf
\nbreach of any of the above conditions is committed, the Sessions
\nJudge concerned will be free to issue warrant or take appropriate
\naction in the matter.\n<\/p>\n
\tBail
\nbond to be executed before the Lower Court having jurisdiction to try
\nthe case. This application is allowed.\n<\/p>\n
\tRule
\nis made absolute. Direct Service permitted today.\n<\/p>\n
