AGRAWAL, J.\n<\/p>\n<p>     Special leave granted.\n<\/p>\n<p>     Both these appeals are directed against the judgment of<br \/>\nthe  Andhra  Pradesh  Administrative  Tribunal\t(hereinafter<br \/>\nreferred to  as &#8220;the  Tribunal&#8221;)  dated\t April\t4,  1996  in<br \/>\nOriginal Application  No. 1621 of 1994 filed by M. Goverdhan<br \/>\nRao, respondent\t No. 1\tin  both  the  appeals\t(hereinafter<br \/>\nreferred to  as `the  applicant&#8217;).  The\t matter\t relates  to<br \/>\nappointment  on\t  the  post   of  Assistant  Motor  Vehicles<br \/>\nInspector  in\tthe  Andhra  Pradesh  Transport\t Subordinate<br \/>\nService.\n<\/p>\n<p>     In 1992  the Andhra  Pradesh Public  Service Commission<br \/>\n(hereinafter  referred\tto  as\t`the  Commission&#8217;)  notified<br \/>\nvacancies of  Assistant Motor Vehicles Inspector and invited<br \/>\napplications for  the said  post. In  response to  the\tsaid<br \/>\nnotification the  applicant submitted  his application.\t The<br \/>\napplicant belongs  to a\t backward class in Group `D&#8217; and his<br \/>\napplication was\t entertained as a local candidate of Zone V.<br \/>\nAmong  the   qualifications  prescribed\t  for  the  post  of<br \/>\nAssistant Motor\t Vehicles Inspector  is Degree in Mechanical<br \/>\nEngineering of\tAutomobile Engineering\tof a  University  in<br \/>\nIndia  or   an\tequivalent   qualification.  The   applicant<br \/>\npossesses a  degree in\tMaster of  Sciences  in\t Engineering<br \/>\nawarded by  the State Commission of USSR. For the purpose of<br \/>\nselection a  candidate has  to take a written test and those<br \/>\nwho are\t short-listed after  the written test are called for<br \/>\nan oral\t test. The  selection is  made on  the basis  of the<br \/>\nmarks obtained\tin the\toral test. The applicant appeared in<br \/>\nthe written  test and on the basis of his performance in the<br \/>\nwritten test  by Memo dated January 27, 1994 he was asked to<br \/>\nbe present  along with his certificates on February 13, 1994<br \/>\nat 10.30 A.M. He reported on February 13, 1994 and was given<br \/>\na card\tfor oral  test scheduled  to be held on February 14,<br \/>\n1994. The name of the applicant was shown at serial No. 3 in<br \/>\nthe list  of candidates\t called for oral test. When the name<br \/>\nof the\tapplicant was called for the purpose of oral test on<br \/>\nFebruary 14, 1994 he was asked to wait and was told that the<br \/>\nquestion of  his eligibility  was under consideration. After<br \/>\nall the\t candidates had\t been interviewed  the applicant was<br \/>\ncalled for  interview.\tIn  the\t final\tlist  of  candidates<br \/>\nselected by the Commission the name of the applicant was not<br \/>\nincluded.  He,\ttherefore,  moved  the\tTribunal  by  filing<br \/>\nO.A.No.1621\/94. In  the said petition the Tribunal, on April<br \/>\n12, 1994,  gave an interim direction that the applicant will<br \/>\nbe treated  as eligible\t and included  in the  ranking\tlist<br \/>\naccording to  the marks\t obtained by  him and  if  he  comes<br \/>\nwithin the  list  of  selected\tcandidates  a  revised\tlist<br \/>\nincluding his  name at\tappropriate place  should be sent to<br \/>\nthe  Government\t  and  appointing   authority  who  may,  if<br \/>\nnecessary, adjust  the last  person in\tthe list against any<br \/>\nadditional vacancy  or remove  him from the list. Even after<br \/>\nthe said  direction  the  name\tof  the\t applicant  was\t not<br \/>\nincluded in the list of selected candidates.\n<\/p>\n<p>     The stand\tof the\tCommission before  the Tribunal\t was<br \/>\nthat  since  there  was\t doubt\tas  to\twhether\t the  degree<br \/>\npossessed by the applicant was recognised as equivalent to a<br \/>\ndegree in  Mechanical Engineering  or Automobile Engineering<br \/>\nof the\tuniversities in\t India,\t a  clarification  regarding<br \/>\nequivalence was\t sought from the Osmania University and that<br \/>\nthe Registrar  of Osmania University replied that the Degree<br \/>\nof  Master   of\t Science   awarded  by\tKhorzov\t Polytechnic<br \/>\nInstitute USSR\tis not\trecognised by the Osmania University<br \/>\nso far\tand  that  the\tmatter\tis  being  referred  to\t the<br \/>\nAssociation of\tIndia Universities, New Delhi for indicating<br \/>\nthe equivalence\t of the\t said degree  and that further reply<br \/>\nwas awaited  from Osmania University. Before the Tribunal it<br \/>\nwas further  stated on\tbehalf of  the Commission  that\t the<br \/>\napplicant had  secured 63  marks whereas  the last  selected<br \/>\ncandidate belonging  to the  backward class  Group `D&#8217;\tfrom<br \/>\nZone V had secured 65 marks and that the applicant could not<br \/>\nalso come  up for selection as Non-Local as the cut off mark<br \/>\nfor selection  for Backward  Class Group  `D&#8217; Non-Local\t was<br \/>\nalso 65\t marks. The  applicant thus  did not fall within the<br \/>\nzone of\t consideration for  selection either  as a  local to<br \/>\nzone V\tor non-local  due to  his low  marks and, therefore,<br \/>\neven if\t it is assumed that the applicant&#8217;s qualification is<br \/>\nequivalent to  B.E. Degree,  it would not alter the position<br \/>\nof the applicant in so far as this recruitment was concerned<br \/>\nas he is not within the zone of consideration for selection.\n<\/p>\n<p>     In the  impugned judgment\tthe Tribunal has referred to<br \/>\nthe  communication   dated  June  27,  1967  issued  by\t the<br \/>\nGovernment of  India, in  consultation that the Union Public<br \/>\nService\t Commission,   regarding  the\trecognition  of\t the<br \/>\nDegree\/Diplomas awarded\t by the\t Universities in USSR and as<br \/>\nper that communication the Degree possessed by the applicant<br \/>\nfrom  USSR   was  one  of  the\tdegrees\t recognised  by\t the<br \/>\ngovernment of  India. The  Tribunal has\t observed that it is<br \/>\nnot a  recent recognition  and that  the Commission  must be<br \/>\nhaving the  required information  as to\t the equivalence  of<br \/>\nthe    qualifications\t particularly\t in    respect\t  of<br \/>\nDegrees\/Diplomas obtained from foreign universities and that<br \/>\nthe Commission\tshould be  having this material with them as<br \/>\notherwise they\twould net  have\t allowed  the  applicant  to<br \/>\nappear for  the written test. The Tribunal has also observed<br \/>\nthat memos  were issued\t in January  1994 to  the candidates<br \/>\nshort-listed for  oral interview,  including the  applicant,<br \/>\ncalling upon  them to  appear along  with their certificates<br \/>\nbefore the Commission on February 13, 1994 and at that stage<br \/>\nthe Commission\twas satisfied and directed him to appear for<br \/>\noral test  on February\t14, 1994 and an objection was raised<br \/>\nfor the first time when he was to be interviewed in his turn<br \/>\nthat the  Degree obtained  by him from an university in USSR<br \/>\nwas not\t recognised and the matter was under correspondence.<br \/>\nAccording to  the  Tribunal,  this  itself  shows  that\t the<br \/>\napplicant was not given a fair treatment. The Tribunal found<br \/>\nforce in  the contention  raised on  behalf of the applicant<br \/>\nthat if\t the Commission had interviewed the applicant in his<br \/>\nturn and  put questions along with other candidates he could<br \/>\nhave certainly\tsecured very high marks in the oral test and<br \/>\nhe might  have stood first among the candidates belonging to<br \/>\nthe same  group to  which he belongs and secured appointment<br \/>\nand that  this aspect  should not have been brushed aside in<br \/>\nthe circumstances,  The Tribunal has held that the applicant<br \/>\nwas not\t given a  fair\ttreatment  and\this  merit  was\t not<br \/>\nassessed objectively  and for that reason he was deprived of<br \/>\nappointment. The  appellants have  been directed  to appoint<br \/>\nthe applicant  as Assistant  Motor Vehicles Inspector in one<br \/>\nof the\texisting vacancies  and\t if  there  is\tno  existing<br \/>\nvacancy in  the next  vacancy that  may arise in the unit of<br \/>\nappointment. Feeling  aggrieved by  the said decision of the<br \/>\nTribunal the  Commission as well as the Government of Andhra<br \/>\nPradesh have filed these appeals.\n<\/p>\n<p>     Shri Ram  Kumar, the  learned counsel appearing for the<br \/>\nappellants in  both the\t appeals,  has\tsubmitted  that\t the<br \/>\nTribunal was  in error in holding that the applicant was not<br \/>\ngiven a\t fair and objective treatment in assessing his merit<br \/>\nand in\tgiving the  direction regarding\t appointment of\t the<br \/>\napplicant on the post of Assistant Motor Vehicles Inspector.<br \/>\nThe learned  counsel has  urged that since there was a doubt<br \/>\nabout  the  equivalence\t of  the  degree  possessed  by\t the<br \/>\napplicant with\tthe B.E.  Degree of  an Indian University, a<br \/>\nclarification  was   sought  by\t  the  Commission  from\t the<br \/>\nRegistrar of Osmania University and that the applicant, when<br \/>\nhe appeared  for the  oral test\t on February  14, 1994,\t was<br \/>\nasked to  wait till  the clarification was received and that<br \/>\non the\tsame day the applicant was interviewed at the end of<br \/>\nthe interview  of other\t candidates. The  submission is that<br \/>\nmerely because\tthe oral  interview  of\t the  applicant\t was<br \/>\npostponed till the end does not mean that there has not been<br \/>\na  fair\t and  objective\t assessment  of\t the  merit  of\t the<br \/>\napplicant. It  has been\t submitted that having regard to the<br \/>\nfact that  the applicant  has secured  63 marks and that the<br \/>\nlast candidates\t belonging to  the Backward  Class `D&#8217; Group<br \/>\nwho have  been selected\t from Zone  V local  as well as non-<br \/>\nlocal had  secured 65  marks, the  Tribunal was\t in error in<br \/>\ngiving direction  regarding appointment\t of the applicant on<br \/>\nthe post of Assistant Motor Vehicles Inspector.\n<\/p>\n<p>     Shri Nageshwara  Rao, the learned counsel appearing for<br \/>\nthe applicant,\twas unable to justify the direction given by<br \/>\nthe Tribunal  regarding appointment  of the applicant on the<br \/>\npost of\t Assistant Motor  Vehicles Inspector.  Shri Rao has,<br \/>\nhowever, submitted  that the  Tribunal has rightly taken the<br \/>\nview that there has not been a fair and objective assessment<br \/>\nof the\tmerit of  the applicant\t on  account  of  his  being<br \/>\ninformed that  there was doubt about his eligibility and the<br \/>\nmatter was  under consideration\t and on account of his being<br \/>\ninterviewed after  all the  candidates had been interviewed.<br \/>\nThe submission\tof the\tlearned counsel\t is that  telling  a<br \/>\ncandidate that\tthere is  doubt about  his eligibility\tmust<br \/>\nhave had  psychological\t impact\t and  would  have  certainly<br \/>\naffected his  performance in  the oral\ttest and, therefore,<br \/>\nthis is\t a fit case in which a special oral test may be held<br \/>\nin so far as the applicant is concerned.\n<\/p>\n<p>     We find  it difficult  to subscribe to the view that on<br \/>\naccount his  being asked  to wait  for the reason that there<br \/>\nwas some  doubt about his eligibility and the equivalence of<br \/>\nthe degree possessed by him and his being interviewed at the<br \/>\nend after  all the  candidates\thad  been  interviewed,\t the<br \/>\napplicant has been denied a fair and objective assessment of<br \/>\nhis merit.  A fair and objective assessment of merit is made<br \/>\non the\tbasis of  performance at  the oral test and there is<br \/>\nnothing on  record to  show  that  the\tperformance  of\t the<br \/>\napplicant at the oral test was adversely affected on account<br \/>\nof  his\t being\ttold  that  there  was\ta  doubt  about\t his<br \/>\neligibility and\t the equivalence  of his  degree, We find no<br \/>\nbasis whatsoever  for the  observation of  the Tribunal that<br \/>\nhad the Commission interviewed the applicant in his turn and<br \/>\nput questions  along with  other candidates  he\t could\thave<br \/>\ncertainly secured  very high  marks in\tthe oral test and he<br \/>\nmight have stood first among the candidates belonging to the<br \/>\nsame group  to which  he belongs and secured appointment. It<br \/>\nis mere\t speculation for  which there  is no  basis. We are,<br \/>\ntherefore, unable  to uphold  the view\tof the Tribunal that<br \/>\nthe applicant  was not\tgiven a fair treatment and his merit<br \/>\nwas not\t assessed objectively.\tIn  the\t circumstances,\t the<br \/>\nimpugned judgment  of the  Tribunal cannot be upheld and has<br \/>\nto be set aside.\n<\/p>\n<p>     The appeals are, therefore, allowed and the judgment of<br \/>\nthe Tribunal dated April 4, 1996 passed in O.A.No.1621\/94 is<br \/>\nset aside  and the  said O.A.  filed  by  the  applicant  is<br \/>\ndismissed.
