SHAH\n\t\t\n\t\n\n \n\nDate\n: 09\/05\/2011 \n\n \n\nORAL\nORDER<\/pre>\n<p>1.\t\tThe<br \/>\npresent application has been preferred by the applicant herein &#8211;<br \/>\noriginal Opponent No.3 &#8211; Insurance Company to stay the impugned<br \/>\njudgement and award dated 20\/05\/2010 passed by learned Motor Accident<br \/>\nClaims Tribunal (Main), Dahod in MACP No.7299\/2004.\n<\/p>\n<p>2.\t\tThough<br \/>\nserved, nobody appears on behalf of the respondents.\n<\/p>\n<p>3.\t\tHeard<br \/>\nMr.Mazmudar, learned advocate appearing on behalf of the applicant.\n<\/p>\n<p>4.\t\tWhile<br \/>\nadmitting the aforesaid appeal and issuing Rule in the  Civil<br \/>\nApplication, learned Single Judge has granted ad-interim relief in<br \/>\nterms of Para-7(A) vide order dated 24\/02\/2011 and passed the<br \/>\nfollowing order:\n<\/p>\n<p>&#8220;Heard. Rule<br \/>\nreturnable on 5th April 2011.\n<\/p>\n<p>There<br \/>\nwill be ad interim relief in terms of paragraph 7(A) on condition<br \/>\nthat the applicant will deposit the entire awarded amount with the<br \/>\nTribunal before the returnable date. On the deposit being made, 70%<br \/>\nof the same will be invested by way of F.D.R. in a nationalized Bank<br \/>\ninitially for a period of three years and on maturity shall be<br \/>\nrenewed by one year at a time till the disposal of the appeal.<br \/>\nThe quarterly Interest accruing on such deposit will be<br \/>\npaid to the  claimants.\n<\/p>\n<p>The said FDR shall be retained with the Nazir of the Tribunal. The<br \/>\nfurther orders as to disbursement of the balance 30% amount will be<br \/>\npassed on the returnable date.&#8221;\n<\/p>\n<p>5.\t\tUnder<br \/>\nthe circumstances and considering the above, ad-interim relief<br \/>\ngranted earlier by this Court vide order dated 24\/02\/2011 is hereby<br \/>\nmade absolute and is directed to be continued till final disposal of<br \/>\nthe main First Appeal on the same terms and conditions. Rule is made<br \/>\nabsolute accordingly.
