Justice V.GIRI\n\n Dated :25\/03\/2009\n\n O R D E R\n                    V.GIRI, J\n                  -------------------\n              W.P.(C).32541\/2008\n                 --------------------\n     Dated this the 25th day of March, 2009\n\n                  JUDGMENT\n<\/pre>\n<p>    Petitioner applied           for an educational<\/p>\n<p>loan for the benefit of his son              who had<\/p>\n<p>secured  admission            to     the     Aircraft<\/p>\n<p>Maintenance Engineering Course (AME) in the<\/p>\n<p>July  2008 session.       Course is a three year<\/p>\n<p>&#8216;Professional    Licence Course stated to be<\/p>\n<p>approved by the Director General of             Civil<\/p>\n<p>Aviation.     The    total           expenses     for<\/p>\n<p>prosecuting the   course,         would be more than<\/p>\n<p>6 Lakhs, as is evidenced by Ext.P2 series.<\/p>\n<p>Petitioner  who   is     a     driver   of   a stage<\/p>\n<p>carriage   therefore had to seek assistance<\/p>\n<p>by way of an educational loan and according<\/p>\n<p>to him, he submitted an application before<\/p>\n<p>the Federal Bank, Vandanam Branch,State Bank<\/p>\n<p>of Travancore      Vandanam Branch          &amp;    The<\/p>\n<p>Punjab National Bank, Alappuzha,           the first<\/p>\n<p>and second    among them            are stated to be<\/p>\n<p>situated  within 200          meteres      from   the<\/p>\n<p>W.P.(C).32541\/2008<br \/>\n<span class=\"hidden_text\">                             2<\/span><\/p>\n<p>permanent residence       of the petitioner.    It<\/p>\n<p>seems      that the petitioner was asked        by<\/p>\n<p>these three Banks for        details  and it also<\/p>\n<p>seems that he approached the Bank authorities<\/p>\n<p>on more than       one occasion. But the loan was<\/p>\n<p>not   sanctioned.        In  these  circumstances,<\/p>\n<p>petitioner approached the respondent, Banking<\/p>\n<p>Ombudsman           with   Ext.P4       complaint.<\/p>\n<p>Complaint was taken on file.       But  ultimately<\/p>\n<p>by   Ext.P6,      it was rejected stating that two<\/p>\n<p>among the Banks are not situated near the<\/p>\n<p>residence of the petitioner and the third<\/p>\n<p>Bank informed the Banking Ombudsman           that<\/p>\n<p>since     the    course   in  relation  to   which<\/p>\n<p>educational loan was sought for,       was not   a<\/p>\n<p>Regular     Degree\/Diploma    course,     existing<\/p>\n<p>guidelines did not         permit the sanctioning<\/p>\n<p>of the educational loan.       Ext.P6  contains a<\/p>\n<p>further statement to the effect that non<\/p>\n<p>sanctioning of the loan is not a matter which<\/p>\n<p>is   otherwise     cognizable    by   the  Banking<\/p>\n<p>Ombudsman         under   the  Banking   Ombudsman<\/p>\n<p>Scheme, 2006.       Ext.P6  has been challenged in<\/p>\n<p>this writ petition.\n<\/p>\n<p>W.P.(C).32541\/2008<br \/>\n<span class=\"hidden_text\">                            3<\/span><\/p>\n<p>2.   Respondent       has entered     appearance.<\/p>\n<p>I heard learned counsel for the petitioner<\/p>\n<p>and learned counsel for the respondent.         I<\/p>\n<p>have perused the Banking Ombudsman      Scheme of<\/p>\n<p>2006.\n<\/p>\n<\/p>\n<p>3.   One     of   the  aspects which  forms   the<\/p>\n<p>subject the matter of a complaint       in terms<\/p>\n<p>of clause 8(2)(c) of the scheme           is the<\/p>\n<p>&#8220;non-acceptance      of  application  for   loans<\/p>\n<p>without furnishing valid reasons          to the<\/p>\n<p>applicant&#8221;.       A reading of  Ext.P4 complaint<\/p>\n<p>in   its    entirety,     would  show  that   the<\/p>\n<p>substratum of the       allegation raised by the<\/p>\n<p>petitioner is        the   unjustified denial of<\/p>\n<p>loan sought       for by the petitioner.  If the<\/p>\n<p>denial of such facility          was with valid<\/p>\n<p>reasons,      the same  must be furnished to the<\/p>\n<p>applicant      and if reasons  are not   afforded<\/p>\n<p>to the applicant,       same   affords   adequate<\/p>\n<p>reasons     to invoke   the jurisdiction  of the<\/p>\n<p>Banking Ombudsman.       In these circumstances,<\/p>\n<p>I am of the view      that a reconsideration   of<\/p>\n<p>W.P.(C).32541\/2008<br \/>\n<span class=\"hidden_text\">                             4<\/span><\/p>\n<p>Ext.P4      at the hands of the respondent is<\/p>\n<p>necessary.\n<\/p>\n<\/p>\n<p>4.   Accordingly,        Ext.P6    is set aside.<\/p>\n<p>Respondent is directed to consider Ext.P4<\/p>\n<p>complaint        afresh.   Petitioner    or    his<\/p>\n<p>authorized        representative    may be heard<\/p>\n<p>before      orders are passed and it shall be<\/p>\n<p>passed within three months from       the date of<\/p>\n<p>receipt of a copy of this judgment.
