It was submitted on behalf of respondent No.1 by<br \/>\nMr.Munshaw that as the amount was not deposited by respondent No.2,<br \/>\nthe work has been delayed but now the amount of Rs.12 lac has been<br \/>\ndeposited. It has also been submitted that it is only after the level<br \/>\nof water goes down about 10 ft., the District Panchayat will be in a<br \/>\nposition to remove the hight raised of the earth nearby the reservoir<br \/>\nby respondent No.3. In the submission made by Mr.Munshaw in the<br \/>\naffidavit-in-reply that respondent No.3 has<br \/>\nunauthorizedly raised the level of earth work, he submitted that<br \/>\nadditional amount may also be required for leveling of the earth<br \/>\nwork.\n<\/p>\n<p>\tUnder<br \/>\nthe circumstances, following directions deserve to be passed:\n<\/p>\n<p>(i)\t\trespondent<br \/>\nNo.1 shall report to this Court time within which, after reduction of<br \/>\nthe water level, the earth work, which has been unauthorizedly done<br \/>\nby respondent No.3, can be removed;\n<\/p>\n<p>(ii)\t\trespondent<br \/>\nNo.3 shall deposit the additional amount, if it is so requisitioned<br \/>\nby respondent No.1, within 01 (one) week from such intimation by<br \/>\nrespondent No.1;\n<\/p>\n<p>(iii)\ttill<br \/>\nthen, as declared in the affidavit, the irrigation facility shall<br \/>\ncontinue.\n<\/p>\n<p>\tAfter<br \/>\nthe water level is reduced, within 01 (one) month, the earth work,<br \/>\nunauthorizedly undertaken by respondent No.3, shall be removed.\n<\/p>\n<p>\tIn<br \/>\nour view, the aforesaid directions will be required to be complied<br \/>\nwith. However, as the<br \/>\nmain matter is still pending, we find that any grievance further on<br \/>\nthe other incidental aspects can be raised in the substantive<br \/>\npetition which is pending before<br \/>\nthe Division Bench.
