 in S._C}}No.74\/2005 on the \ufb01le of learned Principal<\/p>\n
'    Judge, Bijapur (hereinafter referred to as the<\/p>\n
h K  ffsessions Judge\ufb02, have challenged the judgment and<\/p>\n
 '  order of conviction dated 8~\u00bb6–2006 passed in the said<\/p>\n
case convicting all these accused Nos.1 to 6 for the<\/p>\n
offences under Sections 148, 302, 506 Part-II read with<\/p>\n
perused the impugled judgment and  <\/p>\n

 Devareiizipparagi, District Bijapur is as under’:-<\/p>\n
(a) the complainant’s daughter
\nSmt.Bhagirathi(PW-3) was given in
\nmarriage to one Thammanna of
\nDevarallippawg villw, who is the
\ndeceased herein. There was some
\ncivil dispute between the deceased
\nand the accused herein in respect of
\nsome agicnltural land. Thenefoxe,
\nthe accused Neel to 6 on the em<\/p>\n
(b) On 27\/ 11\/2004 at about 8_.’f3G=

\nwith Sidanagcuda K__Basanagfc_uda'~
\nPatil (PW-9) and-another'  <\/p>\n
side and the deceased on the other, V. <\/p>\n
were not in good terms with

\n  the accused Nos.1<\/p>\n
 ‘ c~7rc9spcctivc1y Prabhu, Shivaputrappa
\nV and<\/p>\n
sticks; pickccbup quarrel with the<\/p>\n

MaJ]aPP3\u00a2 assaulted the
\ndeceased with stones on his back
\nand neck, consequently, the
\ndeceased fell to gonad saying
\n“Sathenecppa”, then, the accused
\nNcs.4 to 6, namely, Mahadevappa,
\nBasappa and Gumlingappa
\nassaulted him with wooden clubs
\n(sticks) and thereby all the accused
\ninflicted severe injuries on the
\ndeceased. On seeing the said
\nincident, Siddanagcuda and<\/p>\n
Malakalji (respectively PWs-9 and
\n1())went to rescue the deceased but
\nthey were threatened by all the   ”<\/p>\n
accused saying “ele soole  ‘    _
\nneevu munde bandare   ”\n<\/p>\n
kondu haakthivi”. ‘I’heref0re– \u00ab
\nkept quiet. Thereafter,’-. ail ,the . V
\naccused persons left the;-eai\ufb01 place; ” ”<\/p>\n

\n  dead. Thereafter the
\n“cemp1ai11a11t”~*Went to Alamel Pelice
\nSt\u00e9iiign  lodged his oonzlplaint as
\n‘per Ex.’Pf;.'”\n<\/p>\n

 strongly centended that PW–2 the<\/p>\n
 Nagappa, who is the fa1:her–in-law ef the<\/p>\n
   lodged his complaint Ex.P–2 on the basis of<\/p>\n
    information said to have been gven by Pws-9 and<\/p>\n
‘V 10 respectively Sicidanagouda and Malakalji as to the<\/p>\n
eccurance ef the alleged incident of assault en the<\/p>\n
deceased by the accused, but these two .,

 um though PWS 9 and 10 have turned<\/p>\n

 the evidence of PW—-2, to whom both the<\/p>\n
T   witnesses informed that it was these appellants-
\n‘ A. accused who actually assaulted the deceased and also<\/p>\n
the evidence of PWU5 the Head Constable, before whom<\/p>\n

also the said witnesses disclosed the J:

3. The \ufb02act   aieee homicidal
\ndeath as a. iesult of  him due to
\nthe assault ondihe   place is not
\ndisputed.   by the prosecution
\nbeyond’   the evidence of PW-4
\nthe  to  i’anehanamas and Ex-P4,<\/p>\n
the Aseenei””‘ef_ offeneeiij\ufb01anehanama; PW-13 the L0<\/p>\n
 the  Vii\u00e9nchanamas; and PW~–I the Medical<\/p>\n
issued  the post mortem examination report.<\/p>\n
 ‘Therefore, as rightly submitted by the learned ASPP,<\/p>\n
A   the learned Session Judge has not raised a
\ni   ..se1:>arate point for his determination as to the homicidal<\/p>\n
A V  death of the deceased, the same is not fatal to the<\/p>\n
prosecution mse. This submission is not opposed by the<\/p>\n
learned counsel for the appeliantvaecused. In order to<\/p>\n
connect these accused with the inflicting of ,<\/p>\n
on the deceased which resulted in his  V’  <\/p>\n
prosecution has re\ufb01ed upon the;v’6i;\u00a7a5l’  <\/p>\n
the complainant Nagappa, A.<\/p>\n
Bhoothalappa and P.Ws.9 axui ~10 siadamg\u00e9ugiae and A<\/p>\n
Malakaxji the two  .’V1 \u00bb;L0,.the ‘ vih\u00e9ident of<\/p>\n
assault on the    A\u00bb<\/p>\n
9. On’    averments in the
\ncomplairxt\ufb01f-\u00a7’;i\u00a7:,i!:   that the comp1a1nan’ t
\nhas   7-30 pm on that day while<\/p>\n
he was  Siddanagouda informed him<\/p>\n
 ”  _oveifj;’*p1}eI;eA at\u00a76ut——–tixe death of the d%sed in the<\/p>\n
  at Alamel while he was under treatment<\/p>\n
fer   sustained by him and also about the<\/p>\n
  ‘-\u00bb.i11cidei1\u00a7 1~of assault by the accused on the deceased at<\/p>\n
   L30 p.1n on that day near the agicultural land of<\/p>\n

  .\u00e9  complainant situate}! \u00e9t’ Ramnalli village. He has<\/p>\n
 further stated in his evidence that at about 7-30 pm on<\/p>\n
that day he received telephone call fmm the said<\/p>\n
Siddanagouda) (P.W-9) asking him to go to Govemment<\/p>\n

Hospital at Alamel and accordingly he Went there and<\/p>\n
saw that the deceased Thammanna was dead  9<\/p>\n
and 10 were present there. He has further   _<\/p>\n
on maldng inquiries with them, PW–9   V\u00bb D\u00bb <\/p>\n
him that accused Nos.I to 3 assiavultedn<\/p>\n
back and Waist with stones…    <\/p>\n
assaulted him with wooden hover.’ ‘  ldiee, back,
\nwaist etc. and conseqttentiy  fell on the
\ngound saying on the basis of
\nthe said   the police station and
\nlodged the 1*-=.o2;\n<\/p>\n

 ‘   could  that though they have stated in<\/p>\n
  both of them were together with the<\/p>\n
 time when he was assaulted by some<\/p>\n

A    on that day, they have further deposed that<\/p>\n
‘d    could not identify the assailants as the amused<\/p>\n
A V  herein. After they came to be treated hostite, the<\/p>\n
learned public prosecutor cross-examined both these<\/p>\n

witnesses. Duri;:1g the course of cross-examination both<\/p>\n
of them have denied the suggestions of the _4<\/p>\n
prosecutor that P’W~9 stated before the  ‘A <\/p>\n
investigation as per Exs.P-14 aad__P- f.-\u00a35″   dd” 2<\/p>\n
stated as per Ex.P-16. The of<\/p>\n
and 16 is only to the    3 ” L’<\/p>\n
assaulted the deceased   Nos.4
\nto 6 assaulted him   and thereby<\/p>\n

do not   either of these
\nPWs 9  J10 complainant over phone or<\/p>\n
when he ttie Vfiospital and saw the deceased<\/p>\n

  place. It is not even suggested to<\/p>\n

 him that these accused assaulted the<\/p>\n

V U of them so informed PW-2 when he saw the deceased in<\/p>\n
the hospital dead.\n<\/p>\n

12. Coming to the evidence of PW\u00ab5H  _  <\/p>\n
the H.C., he has stated that <\/p>\n

that time PW-9 Siddanagouda disclosed before him<\/p>\n

names of these accused as the assailants on the<\/p>\n
deceased. P\u00b0W–\u00bb5 has further deposed that while <\/p>\n
that information, the said Siddanagcuda  <\/p>\n
to accompany him and also to help hilt:   <\/p>\n
injured to the hospital and  ‘}_1.e:..: ‘gotu_’t};evi’<\/p>\n
injured admitted in GeneI’a1.i~\u00a3c.spit\u00a3J_.v.””*<\/p>\n
13. Though the fieendii\ufb01cnstablc
\nhas further stated  in L rite  that said<\/p>\n
Siddannagout1a’:cc;itafor3\u00a7tt\u00a7t;5;’   deceamd was<\/p>\n
assaulted  clues by the accused, he did
\nnot reccdxdhisd  (complaint) and register case<\/p>\n
 the    of the said incident For<\/p>\n
 the smtment (complaint) of PW-9 and not<\/p>\n
__ this witness has explained in his<\/p>\n

d d   his complaint, he told him that the relatives of the<\/p>\n
–‘   would come and lodge the complaint and<\/p>\n

14. The above evidence of 1391-5 goes to show that<\/p>\n
though the incident occurred at about 1-30 pm on that<\/p>\n

day, the complaint came to be registered <\/p>\n
about 930 13.11: on that day. Though   <\/p>\n
