Justice M.SASIDHARAN NAMBIAR\n\n Dated :29\/11\/2010\n\n O R D E R\n             M.Sasidharan Nambiar, J.\n            --------------------------\n              Crl.M.C.No.4179 of 2010\n            --------------------------\n\n                       ORDER\n<\/pre>\n<p>    Petitioners were accused 2 and 5 in C.C.No.<\/p>\n<p>476\/2003  on  the  file  of  Judicial  First  Class<\/p>\n<p>Magistrate&#8217;s Court-I, Palakkad. As accused 2, 3 and<\/p>\n<p>5 were absconding, case against them was split up<\/p>\n<p>and re-filed as C.C.No.133\/2005. Accused 1 and 4<\/p>\n<p>were  tried  and  by  Annexure-B  judgment,   those<\/p>\n<p>accused were acquitted. Subsequently, when presence<\/p>\n<p>of the third accused was procured, he was tried and<\/p>\n<p>by Annexure-B judgment, he was acquitted. The case<\/p>\n<p>against accused 2 and 5 was split up and re-filed<\/p>\n<p>as C.C.No.180\/2009. This petition is filed under<\/p>\n<p>Section 482 of Code of Criminal Procedure to quash<\/p>\n<p>the case contending that in view of the order of<\/p>\n<p>acquittal of the remaining accused and when there<\/p>\n<p>is no investigation as provided under Section 4 of<\/p>\n<p>Arms Act, prosecution for the offence under Section<\/p>\n<p>20  read  with  Section  27  of  Arms  Act  is  not<\/p>\n<p><span class=\"hidden_text\">CRMC 4179\/10             2<\/span><\/p>\n<p>sustainable and hence, in the interest of justice,<\/p>\n<p>the prosecution is to be quashed.\n<\/p>\n<p>    2. Learned senior counsel appearing for the<\/p>\n<p>petitioners   and learned  Public  Prosecutor  were<\/p>\n<p>heard.\n<\/p>\n<p>    3. Prosecution case is that on 15.3.2003 at<\/p>\n<p>about 2.30 p.m., the five accused were found in a<\/p>\n<p>motor car bearing Reg.No.KL-01\/A 2266 along with<\/p>\n<p>swords and iron rods, with an intention to commit<\/p>\n<p>robbery of vehicles passing through the National<\/p>\n<p>Highway. Annexures-B and C judgments show that out<\/p>\n<p>of the five accused, three were already acquitted<\/p>\n<p>after    trial. It  also  establish  that   learned<\/p>\n<p>Magistrate acquitted those accused finding that<\/p>\n<p>there is no evidence to prove that the area was<\/p>\n<p>notified as provided under Section 4 of Arms Act<\/p>\n<p>and when evidence was recorded, Circle Inspector of<\/p>\n<p>Police deposed that he is not aware whether there<\/p>\n<p>is any notification or not. Learned senior counsel<\/p>\n<p>pointed out that in view of that finding, which is<\/p>\n<p><span class=\"hidden_text\">CRMC 4179\/10             3<\/span><\/p>\n<p>not disputed, even if petitioners are to be tried,<\/p>\n<p>there is no likelihood of a successful prosecution<\/p>\n<p>and therefore, the case is to be quashed. Learned<\/p>\n<p>Public Prosecutor also submitted that there is no<\/p>\n<p>notification.\n<\/p>\n<p>     4. When there is admittedly no notification<\/p>\n<p>issued     by the  Central Government,  regulating<\/p>\n<p>possession of arms in the area, an offence under<\/p>\n<p>Section 20 read with Section 27 of Arms Act is not<\/p>\n<p>attracted. In such circumstances, when there is no<\/p>\n<p>likelihood of a successful prosecution, even if<\/p>\n<p>petitioners are to be directed to undergo the<\/p>\n<p>ordeal of a trial, it is not in the interest of<\/p>\n<p>justice to continue the prosecution.<\/p>\n<p>     Petition is allowed.
