SANKARAN, J.\n                     ---------------------------\n                      B.A. No. 695 of 2010\n                   -------------------------------\n             Dated this the 22nd day of February, 2010\n\n                            O R D E R\n<\/pre>\n<p>       This is an application for bail under Section 439 of the<\/p>\n<p>Code of Criminal Procedure. The petitioner is the accused in<\/p>\n<p>Crime No.6 of 2010 of Sasthamcotta Excise Range.<\/p>\n<p>       2. The offence alleged against the petitioner is under<\/p>\n<p>Section 55(i) of the Abkari Act.\n<\/p>\n<p>       3. The prosecution case is that on 5\/1\/2010, the petitioner<\/p>\n<p>was engaged in the sale of Indian Made Foreign Liquor. A<\/p>\n<p>quantity of two litres of Indian Made Foreign Liquor was seized<\/p>\n<p>from the possession of the petitioner. The petitioner was arrested<\/p>\n<p>on 5\/1\/2010 and he is in judicial custody since then.<\/p>\n<p>       4. The learned Public Prosecutor submitted that the<\/p>\n<p>petitioner is involved in two other Abkari cases in the year 2009<\/p>\n<p>and four abkari cases in 2008. It is also pointed out that while<\/p>\n<p>disposing of B.A. No.6818 of 2009, filed by the petitioner, on<\/p>\n<p>30\/11\/2009, the undertaking made by the petitioner that he will<\/p>\n<p>not commit any offence of similar nature while on bail in that<\/p>\n<p>case was recorded. The present crime was committed after the<\/p>\n<p>B.A. No. 695 \/2010<br \/>\n<span class=\"hidden_text\">                                  2<\/span><\/p>\n<p>date of disposal of B.A. No.6818 of 2009.<\/p>\n<p>        5. The petitioner had filed B.A. No.168\/2010 and that<\/p>\n<p>application was dismissed by the order dated 20\/1\/2010 in the<\/p>\n<p>light of the facts mentioned in paragraph 4 above. One month<\/p>\n<p>elapsed thereafter.\n<\/p>\n<p>        6. Taking into account the facts and circumstances of the<\/p>\n<p>case, the duration of the judicial custody undergone by the<\/p>\n<p>petitioner, the nature of the offence and the present stage of<\/p>\n<p>investigation, I am of the view that bail can be granted to the<\/p>\n<p>petitioner.\n<\/p>\n<p>        7. The petitioner shall be released on bail on his executing<\/p>\n<p>bond for Rs.25,000\/- with two solvent sureties each for the like<\/p>\n<p>amount to the satisfaction of the Judicial Magistrate of the First<\/p>\n<p>Class, Sasthamcotta subject to the following conditions:-<\/p>\n<blockquote><p>               A)  The petitioner shall report before the<br \/>\n                   Investigating Officer between 9 A.M. and<br \/>\n                   11 A.M. on all Mondays and Thursdays, till<br \/>\n                   the final report is filed or until further<br \/>\n                   orders;\n<\/p><\/blockquote>\n<blockquote><p>               B)  The petitioner shall    appear before the<br \/>\n                   Investigating Officer for interrogation as<br \/>\n                   and when required;\n<\/p><\/blockquote>\n<p>B.A. No. 695 \/2010<br \/>\n<span class=\"hidden_text\">                                   3<\/span><\/p>\n<p>               C) The petitioner shall not try to influence the<br \/>\n                   prosecution witnesses or tamper with the<br \/>\n                   evidence;\n<\/p>\n<p>               D) The petitioner shall not commit any offence<br \/>\n                   or indulge in any prejudicial activity while<br \/>\n                   on bail;\n<\/p>\n<p>               E)  In case of breach of any of the conditions<br \/>\n                   mentioned above, the bail shall be liable<br \/>\n                   to be cancelled.\n<\/p>\n<p>        The Bail Application is allowed as above.<\/p>\n<p>                                    K.T.
