Justice R.BASANT\n\n Dated :16\/03\/2009\n\n O R D E R\n                             R.BASANT, J\n                          ----------------------\n                      Crl.R.P.No.576 of 2002\n                    ----------------------------------------\n               Dated this the 16th day of March 2008\n\n                               O R D E R\n<\/pre>\n<p>      This revision petition is directed against a concurrent<\/p>\n<p>verdict of guilty, conviction and sentence in a prosecution under<\/p>\n<p>Section 138 of the Negotiable Instruments Act.<\/p>\n<p>      2.     The cheque was for an amount of Rs.70,000\/-.<\/p>\n<p>Signature in the cheque is admitted. Handing over of the cheque<\/p>\n<p>in connection with creation of a financial liability is also<\/p>\n<p>admitted.    But contention is raised that the cheque was not<\/p>\n<p>issued for the due discharge of any legally enforcible debt or<\/p>\n<p>liability; but was issued as security when the accused entered<\/p>\n<p>into a financial transaction with the father-in-law of the<\/p>\n<p>complainant. That cheque is being misused, it is alleged.<\/p>\n<p>      3.      Notice of demand though duly received and<\/p>\n<p>acknowledged did not evoke any response.                    The complainant<\/p>\n<p>examined PWs 1 to 4 and proved Exts.P1 to P7. The accused<\/p>\n<p>examined a witness as DW1. PW1 is the complainant. PWs 2<\/p>\n<p>and 3 are the Managers of the drawing and collecting banks.<\/p>\n<p>DW1 claims to have seen the real transaction between the<\/p>\n<p>accused and the father-in-law of the complainant.                The courts<\/p>\n<p><span class=\"hidden_text\">Crl.R.P.No.576\/02                2<\/span><\/p>\n<p>below concurrently came to the conclusion that the evidence on<\/p>\n<p>the side of the complainant can be safely believed and that<\/p>\n<p>shows that there was a legally enforcible debt\/liability and for<\/p>\n<p>discharge of the same, the cheque was issued. Accordingly, the<\/p>\n<p>courts below proceeded to pass the impugned concurrent<\/p>\n<p>judgments.\n<\/p>\n<p>        4. Called upon to explain the nature of the challenge<\/p>\n<p>which the petitioner wants to mount against the impugned<\/p>\n<p>concurrent judgments, the learned counsel for the petitioner<\/p>\n<p>reiterates the contention that the cheque was not issued by the<\/p>\n<p>accused to the complainant for the due discharge of any legally<\/p>\n<p>enforcible debt\/liability. It was issued as a blank signed cheque<\/p>\n<p>as security when the accused entered into a transaction with the<\/p>\n<p>complainant&#8217;s father-in-law. The evidence of DW1 should have<\/p>\n<p>been believed by the courts, it is contended.<\/p>\n<p>      5.     I have rendered my anxious consideration to the<\/p>\n<p>contentions raised.     I am unable to agree with the learned<\/p>\n<p>counsel for the petitioner. The oral evidence of PW1 clearly<\/p>\n<p>shows the circumstances under which the cheque was received<\/p>\n<p>by the complainant.        That version of the complainant is<\/p>\n<p>eminently supported by the absence of a response to the notice<\/p>\n<p><span class=\"hidden_text\">Crl.R.P.No.576\/02                  3<\/span><\/p>\n<p>of demand which was duly served on the accused.                 The<\/p>\n<p>presumption under Section 139 of the N.I.Act stares at the<\/p>\n<p>accused. The evidence of DW1 was found by the courts below to<\/p>\n<p>be not convincing for acceptance. I am unable to agree that<\/p>\n<p>there are any circumstances justifying interference with the<\/p>\n<p>findings of fact rendered concurrently by the court below.<\/p>\n<p>      6.     The learned counsel finally submits that the petitioner<\/p>\n<p>is entitled for leniency.     The sentence imposed is S.I for six<\/p>\n<p>months and compensation of Rs.50,000\/-.              I have already<\/p>\n<p>adverted to the principles governing imposition of sentence in a<\/p>\n<p>prosecution under Section 138 of the N.I.Act in the decision in<\/p>\n<p>Anilkumar vs.Shammi [2002(3)KLT 852]. I am satisfied that<\/p>\n<p>leniency can be shown to the petitioner\/accused. Substantive<\/p>\n<p>sentence of imprisonment can be modified.             An appropriate<\/p>\n<p>modification of payment of the direction for compensation<\/p>\n<p>coupled with a default sentence can be imposed.<\/p>\n<p>      7.     In the result:\n<\/p>\n<p>      a)      This revision petition is allowed in part.<\/p>\n<p>      b)      The impugned verdict of guilty and conviction of the<\/p>\n<p>petitioner under Section 138 of the N.I.Act are upheld.<\/p>\n<p><span class=\"hidden_text\">Crl.R.P.No.576\/02                  4<\/span><\/p>\n<p>      c)     But the sentence imposed is modified and reduced. In<\/p>\n<p>supersession of the sentence imposed on the petitioner by the<\/p>\n<p>courts below, he is sentenced to undergo imprisonment till rising<\/p>\n<p>of court. He is further directed under Section 357(3) Cr.P.C to<\/p>\n<p>pay an amount of Rs.70,000\/- (Rupees seventy thousand only) as<\/p>\n<p>compensation and in default, to undergo S.I for a period of two<\/p>\n<p>months. If realised, the entire amount shall be released to the<\/p>\n<p>complainant as compensation.\n<\/p>\n<p>      8.     The petitioner shall have time till 30\/04\/2009 to make<\/p>\n<p>the payment. The impugned sentence shall not be executed till<\/p>\n<p>that date.
