Justice ANTONY DOMINIC\n\n Dated :01\/12\/2009\n\n O R D E R\n                       ANTONY DOMINIC, J.\n                      ================\n                  W.P.(C) NO. 31972 OF 2009 (N)\n                  =====================\n\n          Dated this the 1st day of December, 2009\n\n                          J U D G M E N T\n<\/pre>\n<p>      Petitioners are Assistant Executive Engineers in the Ground<\/p>\n<p>Water Department, who have completed 5 years of service.<\/p>\n<p>According to the petitioners, there are three vacancies in the<\/p>\n<p>cadre    of     Executive   Engineers    and    that   despite   the<\/p>\n<p>recommendation made by the Head of the Department, DPC has<\/p>\n<p>not been convened so far.       It is with this grievance, the writ<\/p>\n<p>petition is filed.\n<\/p>\n<p>      2.    If as stated by the petitioners, there are vacancies and<\/p>\n<p>there is already a recommendation by the Head of the<\/p>\n<p>Department for convening a DPC, there cannot be any justifiable<\/p>\n<p>reason for delaying the convening of DPC and this has to be done<\/p>\n<p>by the 2nd respondent.\n<\/p>\n<p>      3.    Having regard to the above, I dispose of this writ<\/p>\n<p>petition directing the 2nd respondent to convene the DPC for<\/p>\n<p>considering the candidates eligible for the post of Executive<\/p>\n<p>Engineer in the Ground Water Department. This shall be done, as<\/p>\n<p>expeditiously as possible at any rate within 4 weeks of production<\/p>\n<p>WPC 31972\/09<br \/>\n<span class=\"hidden_text\">                                :2 :<\/span><\/p>\n<p>of a copy of this judgment.\n<\/p>\n<p>     Petitioners shall produce a copy of this judgment before the<\/p>\n<p>respondents.
