( W ) DIVISION- JHANJHARPUR,\nDISTT.- MADHUBANI\n\nFor the Petitioner: Mr. Chitranjan Sinha, Sr. Adv.\n                    Mr. Arun Kumar, Adv.\nFor the Zila Parishad: Mr. Mithilesh Kumar, Adv.\nFor the State     : Mrs. Nilu Agrawal, Adv.\n                                  -----------\n<\/pre>\n<p>4\/   26\/10\/2010              Heard learned counsel for the petitioner,<\/p>\n<p>                  learned counsel for the Jila Parishad, Madhubani.<\/p>\n<p>                             The petitioner while working as a Junior<\/p>\n<p>                  Engineer was subjected to a departmental proceeding.<\/p>\n<p>                  The   enquiry   officer   recommended     warning.    The<\/p>\n<p>                  disciplinary authority on 17.8.2009 differing with the<\/p>\n<p>                  same imposed major punishment of stoppage of two<\/p>\n<p>                  increments with cumulative effect and entry in the<\/p>\n<p>                  service book.\n<\/p>\n<p>                             Learned counsel for the petitioner made a<\/p>\n<p>                  short submission that warning is not a punishment and<\/p>\n<p>                  therefore there was virtually an exoneration by the<\/p>\n<p>                  enquiry officer. If the disciplinary authority proposed to<br \/>\n<span class=\"hidden_text\">                        -2-<\/span><\/p>\n<p>     differ with the same he was required to follow the<\/p>\n<p>     procedure of a second show cause notice indicating the<\/p>\n<p>     reasons why on the same materials collected during<\/p>\n<p>     enquiry he proposed to arrive at a different conclusion<\/p>\n<p>     along with tentative reasons for the same to enable the<\/p>\n<p>     petitioner to meet it. Failure to follow this procedure<\/p>\n<p>     vitiates the punishment.\n<\/p>\n<p>                Learned counsel for the Jila Parishad has<\/p>\n<p>     placed the original records of the proceedings before the<\/p>\n<p>     Court as directed earlier. From the original records it is<\/p>\n<p>     manifest that the disciplinary authority proceeded to<\/p>\n<p>     impose the punishment differing with the enquiry report<\/p>\n<p>     without issuance of a second show cause notice.<\/p>\n<p>                The order of punishment dated 17.8.2009 is<\/p>\n<p>     accordingly set aside.
