LTD - Appellant(s)\n \n\nVersus\n \n\nPRITESH\nNARENDRASINH BHATI &amp; 2 - Defendant(s)\n \n\n=========================================================\n \nAppearance\n: \nMS\nAVANI S MEHTA for\nAppellant(s) : 1, \nMR SP MAJMUDAR for Defendant(s) : 1, \nRULE\nUNSERVED for Defendant(s) : 2, \nMR MAHENDRA K PATEL for\nDefendant(s) :\n3, \n=========================================================\n\n\n \n\t  \n\t \n\t  \n\t\t \n\t\t\t \n\nCORAM\n\t\t\t: \n\t\t\t\n\t\t\n\t\t \n\t\t\t \n\nHONOURABLE\n\t\t\tMR.JUSTICE JAYANT PATEL\n\t\t\n\t\n\n \n\n \n \n\n\n \n\nDate\n: 13\/07\/2007 \n\n \n\n \n \nORAL\nORDER<\/pre>\n<p>Upon<br \/>\n\thearing Ms. Mehta, learned Counsel for the appellant and Mr.<br \/>\n\tMajmudar, learned Counsel for the original claimant, it appears that<br \/>\n\tthe contention raised in the appeal as such covered the decision of<br \/>\n\tthis Court dated 30.03.2007 passed in First Appeal No. 1768 of 2007.<br \/>\n\tTherefore in view of the same similar direction deserves to be<br \/>\n\tissued. In the said decision this Court observed as under:\n<\/p>\n<p>?SIt<br \/>\n\tmay be recorded that essential purpose of fixing the payment under<br \/>\n\tSection 140 of the Motor Vehicles Act is to provide immediate<br \/>\n\tcompensation by way of an interim measure to the injured or the<br \/>\n\tvictim of the accident or the dependents, as the case may be. The<br \/>\n\tdetailed examination of the contention may be at the time when final<br \/>\n\taward is passed and such an interim order is subject to the final<br \/>\n\taward.  It may be that in very very rare case, this Court may<br \/>\n\texamine the question of jurisdiction, if it touches to the root of<br \/>\n\tthe matter. However, normally the defence of the Insurance Company<br \/>\n\tcan better be examined at the final award.  If such an approach is<br \/>\n\tnot taken and the exercise of power under Section 140 is read to<br \/>\n\tleave room for a full fledge detailed inquiry, it may frustrate the<br \/>\n\tvery purpose of the interim measure to be provided to the claimant.<br \/>\n\tSuffice  it to say that the Tribunal has to exercise the judicial<br \/>\n\tdiscretion at the prima facie stage after considering the material<br \/>\n\tprima facie.  As such, the exercise is undertaken by the concerned<br \/>\n\tTribunal in the impugned order hence, I find that the present case<br \/>\n\tis not such, which may fall in the exceptional category  for<br \/>\n\tinterference qua ordering for interim payment by way of an interim<br \/>\n\tmeasure.\n<\/p>\n<p>However,<br \/>\n\tthe grievance on the part of the Insurance Company against the<br \/>\n\tclaimant for refund of the amount in the event it succeeds in the<br \/>\n\tclaim petition, consequently resulting into a situation of no<br \/>\n\tliability on the part of the Insurance Company, can be sufficiently<br \/>\n\ttaken care of if the claimant at the time of withdrawal of the<br \/>\n\tamount furnishes the security or surety to the satisfaction of the<br \/>\n\tTribunal and even otherwise also, the payment is subject to the<br \/>\n\tfinal award.  Even on the aspects of abandonment of the claim by the<br \/>\n\tclaimant after having withdrawn the amount or after having received<br \/>\n\tthe interim payment, may not be permissible and therefore, the<br \/>\n\tgrievance raised on behalf of the appellant to the extent of putting<br \/>\n\tcondition upon the claimant to file an undertaking appears to be<br \/>\n\treasonable.\n<\/p>\n<p>It<br \/>\n\tappears that the above referred decisions of different Benches of<br \/>\n\tthis Court, in certain cases, withdrawal of the payment is permitted<br \/>\n\tto the extent of 50%, whereas in certain case, the amount is ordered<br \/>\n\tto be deposited in the Fixed Deposit Receipt and the interest is<br \/>\n\tmade payable.  In the impugned orders, the Tribunal has permitted<br \/>\n\twithdrawal to the extent of 30%, so far as First Appeal No. 1768\/07<br \/>\n\tis concerned and so far as First Appeal No. 1769\/07 is concerned,<br \/>\n\tthe Tribunal has permitted 50% of withdrawal and the remaining<br \/>\n\tamount in both the cases are even otherwise ordered to be invested<br \/>\n\tto the Tribunal.\n<\/p>\n<p>Under<br \/>\n\tthe above circumstances, I find that if the withdrawal as ordered by<br \/>\n\tthe Tribunal is permitted on furnishing of solvent surety\/security<br \/>\n\tto the satisfaction of the Tribunal, the same would not prejudice<br \/>\n\tthe rights of the claimant.  Similarly, if the undertaking is<br \/>\n\tordered to be filed by the claimant as per the decision, the same<br \/>\n\talso would not be prejudicial to the rights of the claimants since<br \/>\n\tin any case, the claimant is to proceed with the claim petition for<br \/>\n\tfurther compensation.??\n<\/p>\n<p>Hence,<br \/>\n\tdirections given in the said decision deserves to be granted in the<br \/>\n\tpresent appeal.\n<\/p>\n<p>Hence,<br \/>\n\tthe impugned order of the Tribunal is not required to be interfered<br \/>\n\twith at this stage.  However, the order of the Tribunal shall<br \/>\n\tcontinue with the further following directions:\n<\/p>\n<blockquote><p>\t\t\tThe<br \/>\n\t\t\tTribunal shall permit withdrawal of the amount upon the furnishing<br \/>\n\t\t\tof solvent surety\/security of the equal amount  by the claimants.\n<\/p><\/blockquote>\n<blockquote><p>\t\t\tThe<br \/>\n\t\t\tclaimants shall also file an undertaking before the Tribunal prior<br \/>\n\t\t\tto the withdrawal of the order to the effect that the main claim<br \/>\n\t\t\tpetition shall not be abandoned or shall not be withdrawn or shall<br \/>\n\t\t\tnot be permitted to be dismissed in default or for any other cause<br \/>\n\t\t\tby him and the claimants shall pursue the main claim petition on<br \/>\n\t\t\tmerits.\n<\/p><\/blockquote>\n<p>5.\tSubject<br \/>\nto the aforesaid observations and \tdirections, the appeal is<br \/>\ndismissed.  The amount \tdeposited by the Insurance Company of<br \/>\n              \tRs.12,500\/- shall be \ttransmitted forthwith to<br \/>\n\tthe \tTribunal.
