(ORAL)\n<\/pre>\n<p>             Counsel for the petitioner prays that he be permitted to<\/p>\n<p>withdraw the present petition with liberty to approach the appellate<\/p>\n<p>authority to seek review of the observation made &#8220;it is not disputed that<\/p>\n<p>the land in question is classified as B-3 owned by the Cantonment Board&#8221;.<\/p>\n<p>Learned counsel further submits that in the grounds of appeal, he had<\/p>\n<p>taken following specific stand:\n<\/p>\n<blockquote><p>             &#8220;7.   That no proper opportunity of being heard was<br \/>\n      given to the appellant by the learned lower Court, which has<br \/>\n      resulted into miscarriage of justice. It is worth to mention here<br \/>\n      that the appellant got recorded his statement in examination in<br \/>\n      chief and the case was adjourned for cross examination as<br \/>\n      counsel for the respondent was not present and there after the<br \/>\n      case was adjourned for several dates for the respondent. But<br \/>\n      on the date, when the counsel for the appellant was not<br \/>\n      feeling well and the appellant made a request for adjournment<br \/>\n<span class=\"hidden_text\"> Civil Writ Petition No.231 of 2008                                           2<\/span><\/p>\n<p>       of case as his counsel was not present on that day, the<br \/>\n       learned lower Court inspite of adjournment of case, closed the<br \/>\n       evidence of the appellant by order, which is a hard step taken<br \/>\n       by the learned lower Court against the appellant. Moreover,<br \/>\n       the appellant had also moved an application for summoning<br \/>\n       the witnesses, but no order was passed on the said<br \/>\n       application for summoning the witnesses of the appellant and<br \/>\n       hence the appellant has condemned unheard and in case the<br \/>\n       appellant would have been given proper opportunity to lead<br \/>\n       evidence, the result of the case would have been different and<br \/>\n       thus the impugned order is liable to be set aside in view of the<br \/>\n       facts submitted in this para.&#8221;\n<\/p><\/blockquote>\n<blockquote><p>               Learned counsel submits that even this argument has not<\/p>\n<p>been dealt with by the appellate authority.<\/p><\/blockquote>\n<p>               A perusal of the order passed by the appellate authority<\/p>\n<p>shows that this argument was never raised.
