S.J. MUKHOPADHAYA)<\/p>\n<p>The petitioner, who was registered as Self Help Group, applied<br \/>\nfor allotment of a Consumer Store under the Pandit Din Dayal Consumer<br \/>\nStores Scheme. Though, his name was included in serial no.1 of the<br \/>\nselect list and granted Consumer Store for village-Bhathan,<br \/>\nTaluka-Limbdi, District   Surendranagar, however, at the instance<br \/>\nof the 4th respondent, the matter was taken up by the<br \/>\nrespondent-State authorities which cancelled the said allotment and<br \/>\ngranted it in favour of the 4th respondent on the ground<br \/>\nthat the Self Help Group is no more recognized under the new<br \/>\nSwarnjayanti Gram Swarozgar Yojana [SGSY] Scheme. The appellate<br \/>\nauthority rejected the appeal, which having been  affirmed by the<br \/>\nlearned Single Judge, the present Appeal under Clause 15 of the<br \/>\nLetters Patent has been preferred.\n<\/p>\n<p>Learned counsel appearing<br \/>\non behalf of the appellant referred to second part of paragraph 3.7<br \/>\nof Swarnjayanti Gram Swarozgar Yojana guidelines issued by the<br \/>\nGovernment of India to suggest that a large number of Self Help<br \/>\nGroups under the different scheme, including DWCRA groups, NABARD and<br \/>\nother Banks, etc., have also been recognized under the new S.W.S.Y<br \/>\nScheme guidelines. In that view of the matter, learned counsel<br \/>\nappearing on behalf of the State sought for and is allowed time to<br \/>\nobtain instructions to state as why the Self Help Group under DWCRA<br \/>\ngroup Scheme is not declared to have been recognized under the new<br \/>\nS.W.S.Y Scheme and appellant be not given relief as was sought for in<br \/>\nthe writ petition.\n<\/p>\n<p>Appeal may be disposed of<br \/>\non the next date of hearing.
