The said petition was filed\n\n tn'\u00e9e;i:3eiiant contending that, wniie he was working as\n\ndriyv7e'r\u00e9i.5i:,2oo5 in Maxi Cab bearing Registration\n\n   and during the course of employment\n\n i-eitinm No.1, he met with an accident and\n\nit   grievous injuries to his right leg, left leg, nose\n\n  .\u00ab aii over the body. He took treatment as an in-patient\n\n Cat K.R.hospEtai, Mysore, for the injuries suitiinmi in the\n\nX\n\n\n\nearning capacity and consequentiy new that he is entitled\n\nto a compensation of Rs.49,915\/- togaher with ihtere;-\ufb01at.'\n\n12% p.a. from the date of accident from   \n\nrespondent Insurance Cornnany. through the  2 and the documents,<\/p>\n

 In assessing the loss of earning capacity at<\/p>\n
 the ioss of earning capacity should be<\/p>\n
  asseased atIe7'a\u00a7st't1'at 45% and the impugned award is iiabie<\/p>\n

was the_drive’r atrtrte met the accident occurred. The<\/p>\n

8. Appeiiant during the COUTSE Of I135 examination 35<\/p>\n
V i’ :PW.1 has stated about the injuries sustained i_ay'{iim in the<\/p>\n
accident, the treatment taken and the disabiiity  ‘\u00e9 <\/p>\n
he suffers. As per wound certi\ufb01cate, the ro:Iow::\u00a7g;.,,\u00a7n3t;r\u00a7e\u00a7 ” ‘ L<\/p>\n
were found by PW2.\n<\/p>\n
a. Rt. Leg, Rt. Knee swollen;\n<\/p>\n
b. Deformity of the Rtieg present; 3

\nd. Punctured wound   aspect,

Referring to “‘E,x.P9,V”i:heAV.X\u00bbrSye, PW2 has stated that, they<\/p>\n
. ‘show ct\u00a7rrimunited’AE.riter eondylar fracture of right tibia with<\/p>\n
of great toe. He has also stated that, on<\/p>\n
e)t’arri’i’nati6r\u00a7,’v_v\u00bb.or\u00a7.;,”i3.3.2006, he has found the foilowing<\/p>\n
 -injuries:\n<\/p>\n
V ” =a_. He had tenderness and sweiiinc of Rt. Knee;
\nV Knee movements are restricted to 70 degree
\nc. Movements are painfui;\n<\/p>\n
d. Various deformity of the Rt. Leg by 2 Cms.<\/p>\n

disability at 10% by the Commissioner,  _<\/p>\n
erroneous. There is misreading of the..,eyider3<\u00a7e'oi5'_iff*iiii.?t by u <\/p>\n
the Commissioner, leading to an i.iieg;aiity"a\u00a7:a<\/p>\n
substantial question has arisen 'for: <\/p>\n
Considering the nature of injurieie-:_as_V_vnotie.-.3g;[;,yvvVf%PW.2,
\nwhich are not in aispute,is_ i*.easovn'ebie.:'bto., ho-id that the<\/p>\n
percentage of total q.iAsei1ii:itv*  it 15% and<\/p>\n
consequently 'rthiereiitiiie ieesf'-of e_e'rn'ing capacity of 15%.
\nHence, the inwardVV'req\u00abQiresi'i*te'V.be modi\ufb01ed. The age and<\/p>\n
income of the"eppeiie~nt'hes~–been correctly assessed by the<\/p>\n
 t-ie'riee\u00ab," the appellant is entitled to be<\/p>\n
