Justice R.BASANT\n\n Dated :14\/01\/2008\n\n O R D E R\n                              R.BASANT, J\n                      ------------------------------------\n                        B.A.No.184 of 2008\n                      -------------------------------------\n             Dated this the 14th day of January, 2008\n\n                                  ORDER\n<\/pre>\n<p>     Application for anticipatory bail. Petitioner faces allegations<\/p>\n<p>under   Section   138     of     the      Negotiable Instruments Act.<\/p>\n<p>Cognizance has been taken.               The petitioner has not so far<\/p>\n<p>appeared before the learned Magistrate.                    Coercive processes<\/p>\n<p>have been issued against the petitioner by the learned<\/p>\n<p>Magistrate. The petitioner finds such processes chasing him.<\/p>\n<p>     2.    According to the petitioner, he is absolutely innocent.<\/p>\n<p>His absence earlier was not wilful or deliberate. He is willing to<\/p>\n<p>surrender before the learned Magistrate and apply for bail. But<\/p>\n<p>he apprehends that his application for regular bail may not be<\/p>\n<p>considered by the learned Magistrate on merits, in accordance<\/p>\n<p>with law and expeditiously. It is therefore prayed that directions<\/p>\n<p>under Section 438 and\/or 482 Cr.P.C may be issued in favour of<\/p>\n<p>the petitioner.\n<\/p>\n<p>     3.    It is for the petitioner to appear before the learned<\/p>\n<p>Magistrate   and    explain       to     the       learned   Magistrate  the<\/p>\n<p><span class=\"hidden_text\">B.A.No.184 of 2008               2<\/span><\/p>\n<p>circumstances under which he could not earlier appear before the<\/p>\n<p>learned Magistrate. I have no reason to assume that the learned<\/p>\n<p>Magistrate would not consider such application on merits, in<\/p>\n<p>accordance with law and expeditiously. Every court must do the<\/p>\n<p>same. No special or specific direction appears to be necessary.<\/p>\n<p>Sufficient general directions have already been issued in <a href=\"\/doc\/147290035\/\">Alice<\/p>\n<p>George v. The Deputy Superintendent of Police<\/a> [2003(1)<\/p>\n<p>KLT 339].\n<\/p>\n<p>      4.   This bail application is, in these circumstances,<\/p>\n<p>dismissed, but with the specific observation that if the petitioner<\/p>\n<p>appears before the learned Magistrate and applies for bail after<\/p>\n<p>giving sufficient prior notice to the Prosecutor in charge of the<\/p>\n<p>case, the learned Magistrate must proceed to pass appropriate<\/p>\n<p>orders on merits and expeditiously &#8211; on the date of surrender<\/p>\n<p>itself.\n<\/p>\n<\/p>\n<p>                                           (R.BASANT, JUDGE)<br \/>\nrtr\/-<\/p>\n","protected":false},"excerpt":{"rendered":"<p>Kerala High Court Ranjan.V. vs The State Of Kerala Rep.
