He is aggrieved by the order<br \/>\ndated 31.07.2009, passed by the Judicial Magistrate First Class,<br \/>\nDeesa, below application Exhibit-49 in Criminal Case No. 1236 of<br \/>\n2004, as is upheld by the learned Additional Sessions Judge, by order<br \/>\ndated 09.07.2010, passed in Criminal Revision Appeal No. 80 of 2009.\n<\/p>\n<p>2.\t\tBy the said<br \/>\napplication, the petitioner herein, desired that the cheque as well<br \/>\nas certain documents produced by the complainant, be sent for<br \/>\nhand-writing expert&#8217;s opinion.  That was on the premise that, though,<br \/>\naccording to the petitioner, the cheque contained his signature, the<br \/>\ndetails filled up in the cheque as well as  other documents produced<br \/>\nby the complainant along with the cheque, were not in his<br \/>\nhand-writing.\n<\/p>\n<p>3.\t\tThe learned<br \/>\nMagistrate passed the impugned order, dismissing the application,<br \/>\nobserving that the petitioner has admitted his signature on the<br \/>\ncheque.  Previously also such an application was rejected on<br \/>\n09.04.2007, against which revision was preferred, which was came to<br \/>\nbe dismissed on 27.07.2007. Against that, the petitioner has not<br \/>\napproached this Court. The statement of the petitioner under Section<br \/>\n313 of the Criminal Procedure Code was recorded on 11.08.2008.<br \/>\nThereafter, he has examined three more witnesses. In this context,<br \/>\nthe learned Judge was of the opinion that the petitioner is trying to<br \/>\ndelay the proceedings and only with that purpose, these applications<br \/>\nwere given.\n<\/p>\n<p>4.\t\tThe learned Sessions<br \/>\nJudge did not find any reason to interfere and confirmed the order of<br \/>\nthe Magistrate.\n<\/p>\n<p>5.\t\tI have heard learned<br \/>\nCounsel for the petitioner and the learned APP, I do not see any<br \/>\nreason to take a different view. Significantly, for this very<br \/>\npurpose, the petitioner had previously approached the learned<br \/>\nMagistrate, who had passed the order dated 09.04.2007, rejecting the<br \/>\nsaid prayer, observing inter alia that the application is<br \/>\nfiled only for delaying the proceedings. Documents Exhibits-12, 13<br \/>\nand 14, on which the petitioner disputes his signature have been<br \/>\nproduced since long.\n<\/p>\n<p>6.\t\tThe learned<br \/>\nAdditional Sessions Judge, in the Revision Application, upheld the<br \/>\norder of the Magistrate once again, observing that the petitioner is<br \/>\ntrying to delay the proceedings.\n<\/p>\n<p>7.\t\tThe learned Counsel<br \/>\nfor the petitioner has submitted that, after the above-mentioned<br \/>\norders are passed in the first round of litigation, the petitioner<br \/>\nhas been able to produce further material and would be in a position<br \/>\nto make out a case for sending the disputed documents for<br \/>\nhand-writing expert&#8217;s opinion and such a request, therefore, ought to<br \/>\nhave been granted.\n<\/p>\n<p>8.\t\tHowever, in the<br \/>\npresent case, in the previous applications no such stage was left<br \/>\nopen and the learned Magistrate as well as the learned Sessions<br \/>\nJudge, finally and conclusively rejected his request for sending the<br \/>\ndocuments for hand-writing expert&#8217;s opinion.  Both the courts were<br \/>\nalso of the opinion that the petitioner is trying to delay the<br \/>\nproceedings.\n<\/p>\n<p>9.\t\tThe learned Counsel<br \/>\nfor the petitioner has relied upon a decision in  Madhubhai<br \/>\nGandabhai Patel Vs. Joitaram Jividas Patel &amp; Another<br \/>\nreported in 2005(3)GLH 535.  However, in the present case, in view of<br \/>\nthe above discussion, it is not possible to grant a fresh inning.\n<\/p>\n<p>10.\t\tIn view of the<br \/>\nabove, the petition is required to be dismissed.
