SAHAI)<\/p>\n<p>1.<br \/>\n\tThe short question that arises for<br \/>\nconsideration in this Special Civil Application is that if the<br \/>\npetitioner is declared a deserter in State of Assam and his<br \/>\nrepresentation is rejected at Gaya (Bihar), whether the cause of<br \/>\naction to sue would be available to the petitioner to file Special<br \/>\nCivil Application, in Gujarat High Court on the ground that he is a<br \/>\nresident of State of Gujarat?\n<\/p>\n<p>2.<br \/>\n\tThe petitioner was enrolled in the Indian Army as a Constable on<br \/>\n18.11.1987. He was promoted on the post of Naik. While he was in<br \/>\nservice as Naik &#8216;C&#8217; Coy 521 ASC Battalion, Assam, he was granted<br \/>\nleave with effect from 11.4.2006 to 16.5.2006. He overstayed after<br \/>\n16.5.2006 and did not return for joining Army at Assam. Therefore, he<br \/>\nwas declared deserter as he was absent from duty from 16.6.2006. The<br \/>\npetitioner&#8217;s mother Dakha started claiming regularisation of debit<br \/>\nbalance of deserter before the ASC, Records (AT) (Paharpura), Gaya,<br \/>\nBihar. The aforesaid authority informed Dakha that the certificate<br \/>\nduly signed and counter-signed by District Soldiers Army Welfare<br \/>\nOffice be written, so that action may be taken.  Similar letters were<br \/>\nalso sent on 27.5.2008 and 30.11.2008.  The petitioner wrote a letter<br \/>\nto the aforesaid authority on 21.11.2008 claiming pension and other<br \/>\nretiral benefits. On 15.4.2010, the petitioner claimed pension and<br \/>\nother retiral benefits from the office at Gaya (Bihar).  He was<br \/>\ninformed on 18.4.2010 that those soldiers who are declared deserter<br \/>\nare not paid pension.  For other amounts he may write to the<br \/>\nPresident of India, Central Government. Thereafter, the petitioner<br \/>\nfiled Special Civil Application No.3223 of 2010 before this Court,<br \/>\nwhich was dismissed on 29.3.2010 as pre-mature. In this application<br \/>\nthe petitioner has prayed for quashing of the communication dated<br \/>\n28.4.2010 denying pension and has prayed for pension and other<br \/>\nterminal benefits.\n<\/p>\n<p>3.\tWe<br \/>\nhave heard Mr.Vaibhav A.Vyas, learned counsel holding the brief of<br \/>\nMr.Paresh Upadhyay, counsel for the petitioner.\n<\/p>\n<p>4.\tBy<br \/>\n15th Constitutional Amendment Act, 1963, Clause (1-A) was added to<br \/>\nArticle 226(1) which was re-numbered as Clause (2) by the 42nd<br \/>\nConstitutional Amendment, 1976. The effect of the amendment was that<br \/>\nwrit jurisdiction of the High Court was extended to those cases also<br \/>\nwhere only a part of cause of action had arisen within the<br \/>\nterritorial jurisdiction of a High Court. It is necessary to extract<br \/>\nClause (2) of Article 226 of the Constitution which reads as below:-\n<\/p>\n<p>&#8220;226(2)<br \/>\nPower of High Courts to issue certain writs.- The power conferred<br \/>\nby clause (1) to issue directions, orders or writs to any Government,<br \/>\nauthority or person may also be exercised by any High Court<br \/>\nexercising jurisdiction in relation to the territories within which<br \/>\nthe cause of action, wholly or in part, arises for the exercise of<br \/>\nsuch power, notwithstanding that the seat of such Government or<br \/>\nauthority or the residence of such person is not within those<br \/>\nterritories.&#8221;\n<\/p>\n<p>Section<br \/>\n20(c) of the Code of Civil Procedure and Article 226(2) being pari<br \/>\nmateria, it is necessary to extract Section 20(c) which reads as<br \/>\nunder:-\n<\/p>\n<p>&#8220;20.\n<\/p>\n<p>Other suits to be instituted where defendants reside or cause of<br \/>\naction arises.- Subject to the limitations aforesaid, every suit<br \/>\nshall be instituted in a Court within the local limits of whose<br \/>\njurisdiction-\n<\/p>\n<p>xxx<br \/>\nxxx xxx xxx<\/p>\n<p>(c)the<br \/>\ncause of action, wholly or in part, arises.&#8221;\n<\/p>\n<p>The<br \/>\nexpression &#8220;cause of action&#8221; has not been defined in any<br \/>\nStatute. Cause of action means that the person or authority to whom<br \/>\nthe High Court is empowered to issue must be within the territorial<br \/>\nlimits of the High Court and even a small fraction of right to sue<br \/>\naccrued within the jurisdiction of the High Court. In other words,<br \/>\nthe cause of action wholly or in part must had arisen within the<br \/>\nterritorial jurisdiction of the High Court. &#8220;Cause of action&#8221;<br \/>\nis the bundle of facts which taken with applicable to them, gives the<br \/>\npetitioner a right to relief against the respondent.\n<\/p>\n<p>5.\tThe<br \/>\nApex Court in <a href=\"\/doc\/1876565\/\">Kusum Ingots &amp; Alloys Ltd. vs. Union of India<br \/>\nand<\/a> another (2004) 6 SCC 254 held that the cause of action would<br \/>\naccrue at the place where the appellate\/revisional order was passed,<br \/>\neven though part of cause of action had arisen.\n<\/p>\n<p>6.\tIn<br \/>\nthe case of <a href=\"\/doc\/1293509\/\">Mosaraf Hossain Khan vs. Bhageeratha Engg.Ltd. and<br \/>\nothers<\/a> (2006) 3 SCC 658, the facts were that the appellant filed<br \/>\na complaint in West Bengal alleging dishonour of cheque issued by<br \/>\nrespondent Company which had registered at Head Office at Ernakulam<br \/>\nin Kerala for the amount due for supply of stone chip in connection<br \/>\nwith the construction work of major bridges in the State of West<br \/>\nBengal. Summons was issued by CJM, Birbhum, West Bengal. Kerala High<br \/>\nCourt in a writ petition stayed the proceedings before the CJM. The<br \/>\nSupreme Court held that the registered Head Office was at Kerala, the<br \/>\ncheque was issued from Kerala and payment of dishonoured cheque was<br \/>\nsent from Kerala were not relevant facts for holding that a part of<br \/>\ncause of action arose within the territorial jurisdiction of Kerala<br \/>\nHigh Court.  Similar view with regard to cause of action had been<br \/>\ntaken by the Apex Court in <a href=\"\/doc\/1382657\/\">Om Prakash Srivastava vs. Union of<br \/>\nIndia<\/a> (2006) 6 SCC 207, Alchemist Ltd. and another vs. State Bank of<br \/>\nSikkim and others (2007) 11 SCC 335, and<br \/>\n<a href=\"\/doc\/1638742\/\">Eastern Coalfields Ltd. and others vs. Kalyan Banerjee<\/a> (2008) 3 SCC\n<\/p>\n<p>456.<\/p>\n<p>7.\tThe<br \/>\nexpression &#8220;cause of action&#8221; is the entire set of facts<br \/>\nthat gives right to an enforceable claim. It is understood to mean a<br \/>\nsituation or facts that entitles a party to maintain an action in a<br \/>\nCourt. But whole or part of cause of action must arise within the<br \/>\nterritorial jurisdiction of the High Court. In order to entertain a<br \/>\nwrit petition or special civil application under Article 226(2), the<br \/>\nHigh Court has to be satisfied from the entire facts pleaded in<br \/>\nsupport of cause of action that those facts do constitute a cause so<br \/>\nas to empower the Court to decide a dispute which has, at least in<br \/>\npart, arisen within its jurisdiction. Facts which have no bearing<br \/>\nwith the dispute involved in the case would not confer territorial<br \/>\njurisdiction on the Court.\n<\/p>\n<p>8.<br \/>\n\tNow, we may examine as to whether residence of the petitioner in<br \/>\nState of Gujarat which confer jurisdiction on this Court wholly or<br \/>\npartly though the petitioner was declared a deserter while he was in<br \/>\nservice in State of Assam and his representation made to the<br \/>\nauthority at Gaya, State of Bihar was rejected at <a href=\"\/doc\/664771\/\">Gaya. In Daya<br \/>\nShankar Bhardwaj vs. Chief of the Air Staff, New Delhi and others<br \/>\n(AIR<\/a> 1988 All. 36, the Division Bench held,<\/p>\n<p>&#8220;A<br \/>\nright of action is the right to enforce a cause of action. A person<br \/>\nresiding anywhere in the country being aggrieved by an order of<br \/>\ngovernment Central or State or authority or person may have a right<br \/>\nof action at law but it can be enforced or the jurisdiction under<br \/>\nArt.226 can be invoked of that High Court only within whose<br \/>\nterritorial limits the cause of action wholly or in part arises. The<br \/>\ncause of action arises by action of the government or authority and<br \/>\nnot by residence of the person aggrieved.&#8221;\n<\/p>\n<p>9.\tThe<br \/>\ndecision of the Apex Court in Dinesh Chandra Gahotri vs. Chief of<br \/>\nArmy Staff and another (2001) 9 SCC 525 was considered by the<br \/>\nFull Bench of Allahabad High Court in <a href=\"\/doc\/1720770\/\">Rajendra Kumar Mishra vs.<br \/>\nUnion of India and others<\/a> (2005) 1 U.P.Local Bodies &amp; Education<br \/>\nCases 108. The Full Bench in paragraph 17 relied on the decision<br \/>\nof the Apex Court in <a href=\"\/doc\/93127\/\">Oil and Natural Gas Commission vs. Utpal<br \/>\nKumar Basu<\/a> (1994) 4 SCC 71, wherein it was held as under:-\n<\/p>\n<p>&#8220;Under<br \/>\nArticle 226 a High Court can exercise the power to issue directions,<br \/>\norders or writs for the enforcement of any of the fundamental rights<br \/>\nconferred by Part III of the Constitution or for any other purpose if<br \/>\nthe cause of action wholly or in part, had arisen within the<br \/>\nterritories in relation to which it exercises jurisdiction,<br \/>\nnotwithstanding that the seat of the Government or authority or the<br \/>\nresidence of the person against, whom the direction, order or writ is<br \/>\nissued is not within the said territories.  The expression &#8220;cause<br \/>\nof action&#8221; means that bundle of facts which the petitioner must<br \/>\nprove, if traversed, to entitle him to a judgment in his favour by<br \/>\nthe Court. Therefore, in determining the objection of lack of<br \/>\nterritorial jurisdiction the Court must take all the facts pleaded in<br \/>\nsupport of the cause of action into consideration albeit without<br \/>\nembarking upon an enquiry as to the correctness or otherwise of the<br \/>\nsaid facts. Thus, the question of territorial jurisdiction   must<br \/>\nbe decided on the facts pleaded  in the petition, the truth or<br \/>\notherwise of the averments made in the petition being immaterial&#8221;.\n<\/p>\n<p>10.\tThe<br \/>\nFull Bench came to the conclusion that place of residence of<br \/>\npetitioner at District Ballia in State of Uttar Pradesh  would not<br \/>\nconfer territorial jurisdiction on Allahabad High Court the<br \/>\npetitioner was dismissed from service in Court Martial proceedings in<br \/>\nState of West Bengal and as even part of cause of action had not<br \/>\narisen in State of Uttar Pradesh and the writ petition was not<br \/>\nmaintainable.\n<\/p>\n<p>11.\tIn<br \/>\nview of the discussions made above, we are of the considered opinion<br \/>\nthat since the petitioner was declared as deserter while he was in<br \/>\nservice at Assam, either the High Court at Guhati would have<br \/>\njurisdiction or where the petitioner&#8217;s representation was rejected,<br \/>\ni.e. at Gaya (Bihar), Patna High Court would have jurisdiction, but<br \/>\nHigh Court of Gujarat would not have territorial jurisdiction as no<br \/>\ncause of action wholly or in part has arisen in Gujarat. The argument<br \/>\nof counsel for the petitioner that since the petitioner was residing<br \/>\nin Gujarat State, therefore, on the ground of residence, he is<br \/>\nentitled to maintain this Special Civil Application, is liable to be<br \/>\nrejected.\n<\/p>\n<p>12.\tIn<br \/>\nthe case in hand, the petitioner was declared deserter in State of<br \/>\nAssam, his representation was rejected at Gaya in State of Bihar. No<br \/>\npart of cause of action had arisen in State of Gujarat, therefore,<br \/>\nthis Special Civil Application is dismissed with liberty to the<br \/>\npetitioner to approach the appropriate authority or legal Forum.<\/p>\n<pre>\n \n\n \n\n\n \n\n\t\t\t\t\t\t\t(V.M.Sahai,\nJ.)\n \n\n \n\n\n \n\nSreeram.\t\t\t\t\t\t(G.B.Shah,\nJ.)\n \n\n \n\n\n \n\n \n\n\n \n\n \n\n\n\n    \n\n \n\t   \n      \n      \n\t    \n\t\t   \u00a0\u00a0\u00a0\n\t   \n      \n\t  \t    \n\t\t   Top\n\t   \n      \n\n\n<\/pre>\n","protected":false},"excerpt":{"rendered":"<p>Gujarat High Court Sarjeet vs Union on 18 February, 2011 Author: V.
