The<br \/>\n\tclaims Tribunal has awarded Rs. 2,31,000\/-, Rs. 1,85,500\/- and Rs.<br \/>\n\t1,82,200\/- in MACP no. 73\/90, 72\/90 and 59\/90 respectively with 7.5%<br \/>\n\tinterest.\n<\/p>\n<p>These<br \/>\n\tthree cases are fatal and claimants have filed claim petitions for<br \/>\n\tcompensation of deceased who died in the said accident.\n<\/p>\n<p>Learned<br \/>\n\tadvocate Ms. Jani appearing for appellant raised contention before<br \/>\n\tthis Court that Tribunal has committed gross error in holding<br \/>\n\tliability upon appellant insurance company for paying compensation.\n<\/p>\n<p>She<br \/>\n\tsubmitted that Tribunal has failed to appreciate contention of<br \/>\n\tappellant to the effect that Jeep was plied for carriage of more<br \/>\n\tthan passengers then permissible.  As per policy, seating capacity<br \/>\n\tis stated to be 5 + 1.  As against this, as is mentioned in the FIR,<br \/>\n\t16 persons were traveling in the Jeep.  These 16 persons are named<br \/>\n\tin the FIR.  Not only that she submitted that depositions also<br \/>\n\tsupport the fact that on the day of accident 15 to 17 persons were<br \/>\n\ttraveling.\n<\/p>\n<p>She<br \/>\n\tsubmitted that Tribunal has not accepted contention of appellant<br \/>\n\tinsurance company to the effect that since Jeep was overloaded and<br \/>\n\twas used for carriage of 17 passengers as against 6, there is a<br \/>\n\tbreach of terms and conditions of policy and appellant insurance<br \/>\n\tcompany is not liable to indemnify the insured.\n<\/p>\n<p>She<br \/>\n\tsubmitted that even without prejudice to first contention liability<br \/>\n\tof company because of additional premium was paid by owner comes to<br \/>\n\tRs. 15,000\/- only per person as per policy, where Rs. 50\/- per<br \/>\n\tperson was paid by owner.  Therefore, it is beyond to policy as per<br \/>\n\tpremium paid by owner per person. Except that no other contention<br \/>\n\traised by learned advocate Ms. Jani before this Court.\n<\/p>\n<p>The<br \/>\n\taccident occurred on 5\/1\/1990 about 6.30 a.m. where persons were<br \/>\n\tcoming from Modasa in Taxi being a No. GRW 9838 where owner is<br \/>\n\trespondent no. 5 and driver is respondent no. 4.  Meanwhile, at<br \/>\n\tabout 7.30 a.m. when they reached to Modasa near Sabalpur Patia in<br \/>\n\tturning, Taxi driver has slow the Jeep.  At that occasion, opponent<br \/>\n\tno. 1 who was having ownership of Truck of opponent no. 2 No. CIO<br \/>\n\t9321 came from Modasa in rash and negligent manner carelessly<br \/>\n\twithout giving horn dashed to Taxi.  Because of dashed or impact<br \/>\n\tgiven by truck to Taxi, Taxi was dashed with tree and stand near<br \/>\n\ttree.  In the said accident, person those who are traveling in Taxi<br \/>\n\twere injured and three persons were died on the spot, for that,<br \/>\n\tclaim petition was filed by claimants.\n<\/p>\n<p>The<br \/>\n\treply was filed by insurance company and denying averments made in<br \/>\n\tclaim petition. The insurance company of Truck made allegation<br \/>\n\tagainst Jeep and Insurance company of Jeep made allegation against<br \/>\n\tTruck in their written statement.  The contention raised by present<br \/>\n\tappellant before claims Tribunal that Jeep was overloaded then<br \/>\n\tpermit under the Rules. So, as per terms and conditions of insurance<br \/>\n\tpolicy, insurance company is not liable.\n<\/p>\n<p>Before<br \/>\n\tclaims Tribunal vide exh 113 panchnama, vide exh 114 inquest<br \/>\n\tpanchnama of deceased Ambaben, vide exh 115 P.M. report of deceased<br \/>\n\tAmbaben, vide exh 116 inquest panchnama of Bhurabhai Damorbhai, vide<br \/>\n\texh 133 inquest panchnama of deceased Nathiben, vide exh 134 P. M.<br \/>\n\treport of Nathiben, vide exh 130 xerox of complain filed by<br \/>\n\tcomplainant, vide exh 126 P.M. report of Sukhabhai,  vide exh 112<br \/>\n\toral evidence of Dolabhai Manabhai Damor, vide exh 117 oral evidence<br \/>\n\tof Zalabhai Hajurbhai Damor and vide exh 109 oral evidence of<br \/>\n\tGaliben Bhurabhai Damor was produced.  Vide exh 123 Kantibhai<br \/>\n\tSamanbhai Patel was examined and vide exh 124 affidavit of Kantibhai<br \/>\n\tSamanbhai Patel were produced.  Vide exh 127 Laxmanbhai Masurbhai<br \/>\n\tDamor was examined and vide exh 122 he was produced an affidavit.<br \/>\n\tExcept that none was examined before claims Tribunal.\n<\/p>\n<p>All<br \/>\n\tthree persons were traveling in Jeep. After considering submissions<br \/>\n\tmade by three learned advocates and documentary evidence in para 16,<br \/>\n\tthe Tribunal has examined the question of negligence and also<br \/>\n\texamined liability of insurance company.\n<\/p>\n<p>The<br \/>\n\tinsurance company has raised contention for breach of terms and<br \/>\n\tconditions which was proved by  appellant, therefore, no liability<br \/>\n\tis passed on upon insurance company.  In respect to contention that<br \/>\n\tJeep was overloaded and premium for only six persons were paid, but<br \/>\n\tat the time of accident more than 15 to 17 persons were traveling,<br \/>\n\tit amounts to breach of terms and condition of insurance policy,<br \/>\n\tTribunal has considered that Owner has committed error in allowing<br \/>\n\t15 to 17 passengers in Jeep who was having insurance of only five<br \/>\n\tpersons by paying additional amount of Rs. 50\/- per person, but<br \/>\n\tliability of insurance company is remained to satisfy award, though<br \/>\n\tthere may be breached of terms and conditions of insurance policy<br \/>\n\tcommitted by insured.  The persons those who were traveling are<br \/>\n\tconsidered to be an occupants of Vehicle.  The Jeep is considered to<br \/>\n\tbe passenger vehicle not goods vehicle. In passenger vehicle,<br \/>\n\tliability of insurance company is to indemnify the owner in case if<br \/>\n\tany amount is to be paid as compensation to claimants.  This Jeep is<br \/>\n\tnot private vehicle. The Jeep was plied as Taxi, where passengers<br \/>\n\twere traveling.\n<\/p>\n<p>Therefore,<br \/>\n\tclaims Tribunal has examined issue that in case if owner has<br \/>\n\tcommitted any breach, remedy is available with insurance company to<br \/>\n\trecover from owner after paying amount to claimants.\n<\/p>\n<p>Therefore,<br \/>\n\tclaims Tribunal has decided entire liability upon insurance company<br \/>\n\tto satisfy award because an additional premium of Rs. 50\/- was paid<br \/>\n\tby insured for one passenger and it covers five passengers and Rs.<br \/>\n\t250\/- paid being an additional amount.  Whether risk of paid<br \/>\n\tpassenger is covered only Rs. 50\/- or more or not, for that,<br \/>\n\tinsurance company has not led any evidence before claims Tribunal.<br \/>\n\tThe terms and conditions of insurance policy not proved by insurance<br \/>\n\tcompany before claims Tribunal. None was examined by insurance<br \/>\n\tcompany before claims Tribunal.\n<\/p>\n<p>Therefore,<br \/>\n\ta moment, additional amount has been paid being premium for five<br \/>\n\tpassengers Rs. 250\/- then it is a duty of insurance company to<br \/>\n\tsatisfy award because insurance company has not led any evidence to<br \/>\n\tjustify their stands about limited liability.\n<\/p>\n<p>Therefore,<br \/>\n\tin absence of evidence from insurance company, conclusion of claims<br \/>\n\tTribunal is right that additional premium was paid by insured for<br \/>\n\tfive passengers plus driver then insurance company is liable to<br \/>\n\tsatisfy award passed by claims Tribunal.\n<\/p>\n<p>Therefore,<br \/>\n\taccording to my opinion, claims Tribunal has rightly examined issue<br \/>\n\tabout liability, which has been raised before this Court and looking<br \/>\n\tto the fact that in accident five passengers received injuries and<br \/>\n\tthree died, liability is upon insurance company to satisfy award.\n<\/p>\n<p>According<br \/>\n\tto my opinion, tribunal has not committed any error in deciding<br \/>\n\tissue of liability on the basis of insurance policy, which was on<br \/>\n\trecord. Therefore, finding given by claims Tribunal is just and<br \/>\n\tproper and can not considered to be contrary on record or baseless<br \/>\n\tand perverse.\n<\/p>\n<p>The<br \/>\n\tcontentions, raised by learned advocate Ms. Jani can not be accepted<br \/>\n\tand same are rejected in absence of evidence from insurance company.\n<\/p>\n<p>Hence,<br \/>\n\tthere is no substance in the present appeal. Accordingly, present<br \/>\n\tappeal is dismissed.\n<\/p>\n<p>The<br \/>\n\tamount which are deposited by insurance company before Registry of<br \/>\n\tthis Court are directed to be transmitted immediately to the concern<br \/>\n\tclaims Tribunal. The amount of compensation as directed by claims<br \/>\n\tTribunal together with costs and interest are deposited by insurance<br \/>\n\tcompany before claims Tribunal and out of that 40% amount is<br \/>\n\tdisbursed in favour of respondent claimants as per order passed by<br \/>\n\tthis Court and remaining amount is already invested in any<br \/>\n\tNationalized bank for a period of five years. In case, if, claimants<br \/>\n\tare required any amount then they may approach to claims Tribunal<br \/>\n\tand claims Tribunal will consider such application and pass<br \/>\n\tappropriate disbursement order in their favour, as and when such<br \/>\n\toccasion arise.\n<\/p>\n<p>Accordingly,<br \/>\n\ttoday, all three appeals are dismissed by this Court. Therefore, no<br \/>\n\torder is required to be passed in civil applications.
