       The petitioner who is the accused in C.C No. 798\/2003 in the file<\/p>\n
of Judicial First Class Magistrate’s Court, Parappanangadi with respect<\/p>\n
to the offence under Section 498-A of IPC, has sought for a direction<\/p>\n
to   the   court   below   that   there   may   not   be   an   order   of   pre-trial<\/p>\n
detention   at   the   time   of   his   appearance.     It   was   submitted   that   he<\/p>\n
could not appear before the court  as no summons was received.<\/p>\n
       2.   In the circumstances, the petitioner is directed to surrender<\/p>\n
before   the   court   below   within   two   weeks   from   today   and   file   an<\/p>\n
application for bail.   Non bailable warrant is not to be executed in the<\/p>\n
meantime.   Pre-trial detention is not required.   The court below shall<\/p>\n
as far as possible dispose of the application for bail, to be filed on the<\/p>\n
date of appearance of the petitioner itself.<\/p>\n
       The Crl. M.C is disposed of accordingly.\n<\/p>\n<\/p>\n
