Justice P.R.RAMACHANDRA MENON\n\n Dated :24\/06\/2009\n\n O R D E R\n                  P.R.RAMACHANDRA MENON J.\n               --------------------------------------------------\n            WP(C) No.37653\/2004 &amp; WP(C)15432\/2006\n           -----------------------------------------------------------\n            DATED THIS THE 24th DAY OF JUNE 2009\n\n\n                             JUDGEMENT\n<\/pre>\n<p>     Whether the vehicles owned,possessed and used by the<\/p>\n<p>Postal Department are liable to pay the tax leviable under<\/p>\n<p>Section 3 of the Kerala Motor Vehicles (Taxation) Act 1976,<\/p>\n<p>is the moot point in both these Writ Petitions.<\/p>\n<p>2.   For the purpose of proper adjudication, sequence of<\/p>\n<p>events or the factual controversy is not a matter to be<\/p>\n<p>looked into, as the contention is mainly based on the legal<\/p>\n<p>prepositions referring to Article 285 of the Constitution of<\/p>\n<p>India, whereby it has been specifically provided that the<\/p>\n<p>property of the Union shall, save in so far as the Parliament<\/p>\n<p>may by law otherwise provide, be exempt from all taxes<\/p>\n<p>imposed by a State or by any authority within a State.<\/p>\n<p>3.   Placing reliance on the constitutional mandate, the<\/p>\n<p>learned Counsel for the petitioner submits that, since there<\/p>\n<p>is total exemption from all taxes&#8217;, the vehicles belonging to<br \/>\n                               &#8216;<\/p>\n<p>      WP(C) No.37653\/2004 &amp; WP(C)15432\/2006<\/p>\n<p><span class=\"hidden_text\">                         2<\/span><\/p>\n<p>the Postal Department, being a property of the Union, are<\/p>\n<p>not liable to suffer any tax liability imposed by the State<\/p>\n<p>under S.3 of the Kerala Motor Vehicles Taxation Act 1976.<\/p>\n<p>Reference is also made to the reciprocal provision as it<\/p>\n<p>appears under the Article 289 of the Constitution of India,<\/p>\n<p>whereby a similar exemption from the taxation by the Union<\/p>\n<p>is provided in respect of the property and income of the<\/p>\n<p>State as well. Viewed in such circumstances, the learned<\/p>\n<p>Counsel submits, that the course and proceedings pursued<\/p>\n<p>by the respondents imposing tax under the Act for the<\/p>\n<p>vehicles being used by the Postal Department is not correct<\/p>\n<p>or sustainable under any circumstance. The learned<\/p>\n<p>Counsel for the petitioner also placed reliance on the<\/p>\n<p>decision rendered by the High Court of Punjab and<\/p>\n<p>Hariyana reported in A.I.R 1990 (Punjab &amp; Hariyana)<\/p>\n<p>183 to contend that the event of taxation will not be<\/p>\n<p>attracted to the case in hand.\n<\/p>\n<p>      WP(C) No.37653\/2004 &amp; WP(C)15432\/2006<\/p>\n<p><span class=\"hidden_text\">                         3<\/span><\/p>\n<p>4.   The   learned   Govt.pleader,    in   response   to  the<\/p>\n<p>contentions taken by the petitioner, submits that the<\/p>\n<p>reliance placed on Article 285 of the Constitution is<\/p>\n<p>thoroughly wrong and misconceived. It is pointed out that<\/p>\n<p>the source of power is very much available in view of &#8216;entry<\/p>\n<p>No.57&#8217; of the 2nd list under the 7th Schedule of the<\/p>\n<p>Constitution of India; which undisputedly is a &#8216;State subject&#8217;<\/p>\n<p>and as such, no challenge can be raised against the<\/p>\n<p>charging provision. It is also pointed out that, as per the<\/p>\n<p>law declared by the Apex Court reported in [2004] 136<\/p>\n<p>STC 641 SC, it has been clearly held that the protection<\/p>\n<p>under Article 285(1) is available only in respect of &#8220;direct<\/p>\n<p>taxes&#8221; and that, it is having absolutely no application with<\/p>\n<p>regard to the &#8220;indirect taxes&#8221; as in the instant case.<\/p>\n<p>5.    In the Sea Customs Act case (AIR 1963 SC 1760), a &#8216;9-<\/p>\n<p>Judges&#8217; Bench of the Apex Court opined , by a majority,<\/p>\n<p>that article 285 envisaged immunity from &#8216;direct taxes&#8217; and<\/p>\n<p>       WP(C) No.37653\/2004 &amp; WP(C)15432\/2006<\/p>\n<p><span class=\"hidden_text\">                          4<\/span><\/p>\n<p>not from &#8216;indirect taxes&#8217; such as sales tax. The decision in<\/p>\n<p>Sea Customs Act case [1964] 3 SCR 787 was considered by<\/p>\n<p>another &#8216;9-Judges Bench&#8217; in the case of <a href=\"\/doc\/821538\/\">New Delhi<\/p>\n<p>Municipal Committee v. State of Punjab<\/a> (1997) 7 SCC 339,<\/p>\n<p>and was affirmed. Both the above verdicts were considered<\/p>\n<p>and relied on in 136 STC 641.\n<\/p>\n<p>     From the above judgments, it is clear that Union is not<\/p>\n<p>exempted from the levy of &#8216;indirect tax&#8217; under Article 285 of<\/p>\n<p>the Constitution.\n<\/p>\n<p>6.   It is brought to the notice of this Court, that the stand<\/p>\n<p>being taken by the departmental authorities as clearly<\/p>\n<p>reflected in Ext.p4 demand notice is that the petitioners, if<\/p>\n<p>aggrieved, had to approach the           Government\/State,for<\/p>\n<p>obtaining &#8216;exemption&#8217; as provided under Section 22 of the<\/p>\n<p>Kerala Motor Vehicles (Taxation) Act.\n<\/p>\n<p>7.   The learned Standing Counsel appearing for the<\/p>\n<p>petitioners submits that the &#8216;entry 57&#8217; of &#8216;list 2&#8217; of the 7th<\/p>\n<p>       WP(C) No.37653\/2004 &amp; WP(C)15432\/2006<\/p>\n<p><span class=\"hidden_text\">                          5<\/span><\/p>\n<p>schedule is only a general provision, which is applicable to<\/p>\n<p>all vehicles. In the instant case, the vehicles belonging to<\/p>\n<p>the Postal Department being a property owned by the<\/p>\n<p>Union, it clearly comes within the sphere of Article 285(1)<\/p>\n<p>and hence that the stand taken by the respondents is not<\/p>\n<p>correct and is liable to be interfered with. It is further<\/p>\n<p>added that the tax imposed\/levied under S.3 of the Kerala<\/p>\n<p>Motor Vehicles Act 1976 is actually on the vehicles ie. on<\/p>\n<p>the property of the Union and hence it is having all the<\/p>\n<p>colour and characteristics of a &#8216;direct tax&#8217; .<\/p>\n<p>8.   It is very much relevant to note that the very scheme of<\/p>\n<p>the statute ie. Kerala Motor Vehicles Taxation Act is never<\/p>\n<p>to tax the vehicle as such, but is only to impose the tax for<\/p>\n<p>the &#8216;user&#8217; of the road in the State. This being the position, it<\/p>\n<p>cannot be said that the tax is actually imposed on the<\/p>\n<p>vehicle, so as to make it a direct tax, to attract Article 285.<\/p>\n<p>In short, the legal position that the benefit of Article 285(1)<\/p>\n<p>       WP(C) No.37653\/2004 &amp; WP(C)15432\/2006<\/p>\n<p><span class=\"hidden_text\">                          6<\/span><\/p>\n<p>can be availed of only with respect to &#8216;direct tax&#8217; stands<\/p>\n<p>settled and is no more open to challenge.\n<\/p>\n<p>9.   It is to be noted that the stand of the respondents, right<\/p>\n<p>from the beginning, was never that the vehicles belonging<\/p>\n<p>to the petitioner can&#8217;t be given the benefit of exemption<\/p>\n<p>under any circumstances and on other hand, it was being<\/p>\n<p>let known that the remedy was only to approach the<\/p>\n<p>Government\/State claiming exemption as pointed out in<\/p>\n<p>Exhibit P4; the power being actually vested with the<\/p>\n<p>Government under S.22 of the above Act which is extracted<\/p>\n<p>below:\n<\/p>\n<p>     S.22 of the K.M.V. Act deals with exemption from or<\/p>\n<p>reduction of tax.\n<\/p>\n<p>         &#8220;The Government may, if they are satisfied that it<\/p>\n<p>   is necessary in the public interest so to do , by<\/p>\n<p>   notification in the gazette make an exemption or<\/p>\n<p>   reduction in the rate or other modification either<\/p>\n<p>   prospective or retrospective, in regard to the tax<\/p>\n<p>       WP(C) No.37653\/2004 &amp; WP(C)15432\/2006<\/p>\n<p><span class=\"hidden_text\">                          7<\/span><\/p>\n<p>    payable under this Act or under the Kerala Motor<\/p>\n<p>    Vehicles Taxation Act,1963 (24 of 1963) or the Kerala<\/p>\n<p>    Motor Vehicles (Taxation of Passengers &amp; Goods) Act<\/p>\n<p>    1963 (25 of 1963):\n<\/p>\n<p>     (i)  by any person or class of person;or<\/p>\n<p>    (ii) in respect of any motor vehicles or class of motor<\/p>\n<p>    vehicles;\n<\/p>\n<p>   (iii) in respect of any motor vehicles or class of motor<\/p>\n<p>   vehicles using a specified route subject to such terms and<\/p>\n<p>   conditions as they may deem fit&#8221;.\n<\/p>\n<p>This being the position, it is for the petitioners to approach<\/p>\n<p>the   1st  respondent\/Government       of   Kerala   by   filing<\/p>\n<p>appropriate representation, claiming exemption under S.22<\/p>\n<p>of the Act and it is for the first respondent to look into the<\/p>\n<p>same and to pass appropriate orders thereon, particularly<\/p>\n<p>taking note of the reciprocal provisions in this regard.<\/p>\n<p>10.      In the above circumstances the petitioners are<\/p>\n<p>permitted to file appropriate representation before the 1st<\/p>\n<p>      WP(C) No.37653\/2004 &amp; WP(C)15432\/2006<\/p>\n<p><span class=\"hidden_text\">                        8<\/span><\/p>\n<p>respondent\/State within one month and on such an event,<\/p>\n<p>the 1st respondent is directed to consider the same as<\/p>\n<p>aforesaid and pass     appropriate orders after giving an<\/p>\n<p>opportunity of   being heard to the petitioners within 2<\/p>\n<p>months thereafter. Since there was an interim order in<\/p>\n<p>both the cases, the same will continue, till final orders are<\/p>\n<p>passed by the 1st respondent as above.
