No.322\/2011-M\n              ~~~~~~~~~~~~~~~~~~~~~~~~~~~\n          Dated this the 5th day of January, 2011\n\n                    J U D G M E N T\n<\/pre>\n<p>    The petitioner is working as an Upper Primary<\/p>\n<p>School Assistant in Muslim Higher Secondary School,<\/p>\n<p>Kangazha  which is   an  aided  school.     Her  initial<\/p>\n<p>appointment was approved from 08\/06\/2001 as evidenced<\/p>\n<p>by Ext.P1 order.   In that school, a leave vacancy of<\/p>\n<p>H.S.A (Maths) arose consequent on the availing of leave<\/p>\n<p>by Smt.Jyothi K.Nair, and the petitioner was promoted<\/p>\n<p>for the period from 05\/07\/2001 to 06\/11\/2001.     It is<\/p>\n<p>stated that the said appointment was also approved and<\/p>\n<p>salary  was  paid  which  resulted  in   the  petitioner<\/p>\n<p>becoming a claimant under Rule 51A of Chapter XIV A<\/p>\n<p>K.E.R.\n<\/p>\n<\/p>\n<p>    2.   In the school, the Manager has made certain<\/p>\n<p>accommodations in favour of respondents 4 and 5 and,<\/p>\n<p>finally, the District Educational Officer passed an<\/p>\n<p>order as per Ext.P9, which according to the petitioner<\/p>\n<p>is not sustainable.  It is in these circumstances, the<\/p>\n<p>petitioner has filed a revision petition before the<\/p>\n<p>Director of Public Instructions as per Ext.P10.      The<\/p>\n<p>W.P.(C). No.322\/2011<br \/>\n<span class=\"hidden_text\">                         -:2:-<\/span><\/p>\n<p>main prayer raised by the petitioner therein is to<\/p>\n<p>reject the appointment of the fourth respondent and to<\/p>\n<p>direct the Manager to promote the petitioner as H.S.A<\/p>\n<p>(English).\n<\/p>\n<\/p>\n<p>    3.   The  learned   counsel   for  the   petitioner<\/p>\n<p>submitted  that  urgent  orders  are  required  in  the<\/p>\n<p>revision petition and, therefore, the same may be<\/p>\n<p>directed to be disposed of expeditiously and within a<\/p>\n<p>time limit.\n<\/p>\n<\/p>\n<p>    4.   There  will  be  a  direction   to  the  sixth<\/p>\n<p>respondent to take a decision on Ext.P10 revision<\/p>\n<p>petition after hearing the petitioner and respondent<\/p>\n<p>Nos.3 to 5 within three months.    The petitioner will<\/p>\n<p>produce a copy of the writ petition along with a copy<\/p>\n<p>of  the  Judgment  before  the   sixth  respondent  for<\/p>\n<p>compliance.  If the petitioner seeks for any interim<\/p>\n<p>order before the sixth respondent, the application will<\/p>\n<p>be disposed of expeditiously after hearing the parties<\/p>\n<p>concerned within three weeks from the date of receipt<\/p>\n<p>of  the  application  for  interim  order.    The  writ<\/p>\n<p>petition is disposed of as above.  No costs.<\/p>\n<p>                       (T.R.
