Civil Application No. 3016 of 2003\n          MR ND SONGARA for Petitioner No. 1\n          MR ASHISH M DAGLI for Respondent No. 1\n\n\n     --------------------------------------------------------------\n\n\n                CORAM : MR.JUSTICE H.K.RATHOD\n\n\n                Date of Order: 02\/05\/2003\n\n\n ORAL ORDER<\/pre>\n<p>Heard learned advocate Mr.N.D.Songara appearing<br \/>\n      on behalf of the applicant &#8211; original respondent and<br \/>\n      learned advocate Mr.A.M.Dagali    on  behalf of  the<br \/>\n      respondent &#8211; original petitioner.\n<\/p>\n<p>     The original petitioner has challenged the award<br \/>\n     passed by the Labour Court in Reference No.1319 \/ 1999<br \/>\n     dated 5th April, 2002 wherein the labour court has<br \/>\n     granted reinstatement with continuity of service without<br \/>\n     backwages   of   the interim period and also awarded<br \/>\n     punishment of stoppage of two increments with permanent<br \/>\n     effect.   In the main petition, this Court has passed the<br \/>\n     order on 29th October, 2002 issued Rule and granted<br \/>\n     ad-interim relief in terms of Para-7[C] of the prayer<br \/>\n     clause, meaning thereby, stayed the operation of the<br \/>\n     award impugned and thereby stayed reinstatement of the<br \/>\n     workman concerned and therefore,      civil   application<br \/>\n     No.1209 \/ 2003 preferred by the original respondent<br \/>\n     workman with prayer to grant relief under Section 17-B of<br \/>\n     the I.D.Act but as such, this Court was not inclined to<br \/>\n     pass any order in that civil application in this behalf<br \/>\n     and therefore, this civil application is filed with two<br \/>\n prayers, first, to vacate the ad-interim relief granted<br \/>\nby this Court   or alterantively, to direct the opponent<br \/>\nCorporation to pay the wages last drawn as provided under<br \/>\nSection 17-B of the I.D.Act.\n<\/p>\n<p>It may be noted that the workman concerned has<br \/>\nspecifically averred that that he is unemployed and not<br \/>\ngainfully employed during the interim period.         The<br \/>\nworkman has also stated that he is not employed in any<br \/>\nestablishment and not receiving adequate remuneration<br \/>\nfrom the employer.     He, however, made it clear that in<br \/>\nthe affidavit, unemployment is shown from the date of the<br \/>\naward.\n<\/p>\n<p>Learned advocate Mr.A.M.Dagali for the petitioner<br \/>\nCorporation has submitted that today is the first date of<br \/>\nhearing and the copy of this civil application is<br \/>\nreceived yesterday only and therefore, the original<br \/>\npetitioner needs some time to make inquiry as to gainful<br \/>\nemployment of the workman.\n<\/p>\n<p>This Court has considered the request made by the<br \/>\nlearned advocate Mr.Dagali on behalf of the petitioner<br \/>\ncorporation. In my opinion, once stay has been granted<br \/>\nby this Court staying operation of the award granting<br \/>\nreinstatement, the workman is entitled to benefits under<br \/>\nSection 17-B of the I.D.Act, 1947.        It may also be<br \/>\nappreciated that the affidavit has already been filed by<br \/>\nthe workman before this Court and a copy thereof has been<br \/>\nserved on the other side. Therefore, at this stage, the<br \/>\nworkman is entitled to benefits under Section 17-B of the<br \/>\nI.D.Act.   However, this Court is inclined to grant<br \/>\nliberty to the petitioner Corporation to the effect that<br \/>\nin case if the petitioner Corporation finds any material<br \/>\nto satisfy this Court that the workman has been employed<br \/>\nin any establishment and receiving adequate remuneration<br \/>\nfrom the employer, in that case, it will be open to the<br \/>\npetitioner to file necessary application for modification<br \/>\nof the order that is being passed by this Court.
