Advocate\n\nHon'ble Ravindra Singh,J.\n<\/pre>\n<p>Heard learned counsel for the applicants and learned A.G.A.<br \/>\nThis application is filed by the applicants with a prayer that the charge<br \/>\nsheet of the case crime no. 614 of 2009, under Sections 323. 326, 504,<br \/>\n506 I.P.C., P.S. Thakurdwara, District Moradabad pending in the court<br \/>\nof Judicial Magistrate I, Thakurdwara, District Moradabad may be<br \/>\nquashed.\n<\/p>\n<p>From the perusal of the record it appears that on the basis of the<br \/>\nmaterial collected by the I.O. during investigation, prima facie aforesaid<br \/>\noffences are constituted. There is no illegality in submission of the<br \/>\ncharge sheet, therefore, the prayer for quashing the charge sheet is<br \/>\nrefused.\n<\/p>\n<p>However, considering the facts and circumstances of the case, it is<br \/>\ndirected that in case the applicants move application for<br \/>\nappearance\/surrender before the court concerned within 30 days from<br \/>\ntoday on which the court concerned shall fix the date of<br \/>\nsurrender\/appearance, in the meantime the court concerned shall seek<br \/>\nthe instructions from the prosecution side. In case the applicants move<br \/>\nthe application for bail on the day of the appearance or surrender, the<br \/>\nsame shall be heard and disposed of expeditiously if possible on the<br \/>\nsame day by the courts below.\n<\/p>\n<p>With the above direction the application is finally disposed of.<br \/>\nOrder Date :- 2.2.2010<br \/>\nSu\n <\/p>\n","protected":false},"excerpt":{"rendered":"<p>Allahabad High Court Madan Singh And Others vs State Of U.P.
