3.   11.11.2011                Heard learned counsel for the petitioner and<\/p>\n
                  the State.\n<\/p>\n
                               The writ application was filed on 13.7.2010<\/p>\n
                  after serving two copies in the office of the Advocate<\/p>\n
                  General. Despite a passage of nearly one and a half<\/p>\n
                  year no counter affidavit has been filed by the<\/p>\n
                  respondents. The Court is not inclined to accede to<\/p>\n
                  the prayer for adjournment for that purpose so<\/p>\n
                  belatedly.     The respondents have had more than<\/p>\n
                  reasonable time from the date of filing of the writ<\/p>\n
                  application to assist this Court in dispensation of<\/p>\n
                  justice, a constitutional obligation under Chapter-4 of
\n                   2<\/span><\/p>\n
the Constitution, by filing a counter affidavit.<\/p>\n
          The petitioner is aggrieved by the order<\/p>\n
dated 11.5.2010 of the Anchal Adhikari, Khizarsarai<\/p>\n
cancelling his own earlier order dated 20.4.2010<\/p>\n
appointing the petitioner as Sachiv, Gram Katchery<\/p>\n
after cancelling the appointment of Shree Mewalal<\/p>\n
Das. The ground mentioned in the impugned order is<\/p>\n
that the Anchal Adhikari had no authority to issue<\/p>\n
such an order.\n<\/p>\n
          Learned counsel for the petitioner submits<\/p>\n
that in pursuance of the orders of this Court in<\/p>\n
C.W.J.C. No. 11063 of 2008 preferred by the petitioner<\/p>\n
against wrong denial of appointment, the matter was<\/p>\n
enquired into and on 28.2.2010 the Anchal Adhikari-<\/p>\n
cum-Block Development Officer concluded that the<\/p>\n
petitioner had higher marks than Shree Mewalal Das<\/p>\n
and was therefore entitled to appointment leading to<\/p>\n
the order dated 20.4.2010. Under the Bihar Gram<\/p>\n
Katchery Secretary (Employment, Service Condition<\/p>\n
and Duty) Rules, 2007 the Block Development Officer<\/p>\n
as the Nodal authority was statutorily empowered to<\/p>\n
examine eligibility for appointment, verification of<\/p>\n
documents and to issue appointment orders.<\/p>\n
          Counsel for the State submits that the<\/p>\n
Anchal   Adhikari     has   opined   that   he     was   not
\n                                     3<\/span><\/p>\n
           competent to issue the appointment order and even<\/p>\n
           according     to    the         petitioner      it        was    the     Block<\/p>\n
           Development Officer who alone could do so.<\/p>\n
                       To examine the matter substantively the<\/p>\n
           Court finds that his eligibility was examined at a point<\/p>\n
           of time when the Anchal Adhikari de facto possessed<\/p>\n
           the power of the Block Development Officer. Applying<\/p>\n
           the principles of de facto exercise of power on the date<\/p>\n
           that he was held validly entitled to appointment i.e.,<\/p>\n
           28.2.2010, the power was exercised by the Anchal<\/p>\n
           Adhikari in duality in that of the Block Development<\/p>\n
           Officer.    Once the statutory authority came to the<\/p>\n
           conclusion     about           the   validity        of    his     claim    for<\/p>\n
           appointment, other matters become procedural.<\/p>\n
                       In absence of any counter affidavit and the<\/p>\n
           lack of information available whether Shree Mewalal<\/p>\n
           Das finally accepted the order dated 20.4.2010 of his<\/p>\n
           termination or whether he questioned the same<\/p>\n
           successfully       or     unsuccessfully,            the        order    dated<\/p>\n
           11.5.2010 with regard to the petitioner is set aside<\/p>\n
           subject to that condition.\n<\/p>\n
