The State of Rajasthan\n\nDATE OF ORDER            :     4th December 2009\n\n      HON'BLE MR.JUSTICE DINESH MAHESHWARI\n\nMr.Sandeep Mehta,for the petitioner.\nMr.Mahipal Bishnoi,Public Prosecutor for State.\nMr.Pradeep Shah for the complainant\n                              ....\n\n\n      The petitioner, accused of offences under Sections 323,\n\n307, 325, 341 IPC and Section 3(i) (x) of the Scheduled\n\nCastes and Scheduled Tribes (Prevention of Atrocities) Act\n\nhas moved this application for bail under Section 439 Cr.P.C.\n\n      The accusations in the present case are based on a\n\nreport made by the complainant Pradeep Salvi on 30.05.2009\n\nthat at about 2:30 p.m., he saw the petitioner and another\n\nperson raising construction at his plot whereupon he raised the\n\nqueries but he was abused in the name of caste and then, the\n\npetitioner gave him beating with an iron rod whereby his leg\n\nbone was fractured and he received other injuries too.\n\n       The facts of the case make out that the said injured\n\nPradeep Salvi was hospitalised for the injuries sustained and\n\nthen, was shifted to Ahmedabad where he expired on\n\n18.06.2009.     After investigation, the charge-sheet has,\n\nhowever, been filed in the matter against the petitioner for the\n\noffences aforesaid    and not relating to the death of the\n                                    2\n\ncomplainant. The charge-sheet also mentions that there had\n\nbeen six other cases registered against the petitioner in the\n\npast. It was, however, stated before the learned Sessons\n\nJudge that the petitioner    had been involved in two other\n\ncriminal cases.\n\n        It has been pointed out during the course of\n\nsubmissions that the petitioner is not a previous convict and\n\nno case is pending against him. It has also been pointed out\n\nthat there has been a cross-case in this matter registered at\n\nNo.189\/2009 on the complaint as made by the father of the\n\npetitioner for the offences under Sections 323, 380, 384, 427,\n\n447, 452, 455, 120B IPC against the said deceased Pradeep\n\nSalvi   and another Shri Vinod Salvi who has since been\n\narrested in the said case and prima facie, it is apparent that it\n\nwere the complainant with other accused person who\n\nattempted to trespass into the property of the petitioner   and\n\nthen, caused substantial damage to the property. It is also\n\nsubmitted that as per injury report of the complainant, he\n\nreceived four injuries by blunt weapon and two of them are\n\nshown to be of bony injuries on left hand and left leg but in\n\nthe histopathologcal    report, the cause of death has been\n\nstated as asphyxia; and such injuries are not alleged to be\n\nthe cause of death.\n                                    3\n\n      It is submitted that there being the cross-case and the\n\nalleged injuries being not the cause of death, in the totality of\n\ncircumstances, the petitioner deserves to be enlarged on bail.\n\n      The learned Public Prosecutor and the learned counsel\n\nfor the complainant have vehemently opposed the bail plea of\n\nthe petitioner with the submissions that the petitioner has\n\ncriminal antecedents and had caused grievous injuries that\n\nled to hospitalisation and ultimate death of         the injured\n\nPradeep Salvi.\n\n      The facts have been noticed in this case that prima\n\nfacie, the injuries said to have been inflicted by the petitioner\n\nare not alleged to be the cause of death that has been stated\n\nto be respiratory failure and then, there had been a cross-case\n\nlevelling accusations of the complainant with another person\n\nhaving intruded into the property of the petitioner and having\n\ncaused damage to the property. Before the learned Sessions\n\nJudge, it was suggested that the petitioner was involved in\n\ntwo other criminal cases; but it has specifically been pointed\n\nout on behalf of the petitioner that he had been discharged in\n\nother cases and such facts could not be refuted by the\n\nprosecution.\n\n      During the course of consideration of this matter, case\n\ndiary pertaining to FIR No.189\/2009 was also obtained by the\n                                        4\n\nPublic Prosecutor and perusal of same has left too many\n\nthings of dissatisfaction with the Court particularly when it is\n\nnoticed that the investigation in the said FIR has been taken\n\nup in an inexplicable leisurely manner. However, presently\n\nthe matter being considered on the bail plea of the petitioner,\n\nthe other aspects are left for consideration later.\n\n      After having examined the challan papers pertaining to\n\nthis case and so also the case diary pertaining to the cross-\n\ncase, without comments on merits, this Court finds it a fit case\n\nfor grant of bail to the petitioner.\n\n      Accordingly, this bail application under Sec. 439 Cr.P.C.\n\nis allowed and it is directed that the petitioner Bhupesh Mehta\n\ns\/o Bansi Lal Menta be released on bail in relation to FIR\n\nNo.183\/2009 Police Station, Pratap Nagar, Udaipur provided\n\nhe executes a personal bond in the sum of Rs.10,000\/- with\n\ntwo sound and solvent sureties in the sum of Rs.5,000\/- each\n\nto the satisfaction of learned Trial Court for their appearance\n\nbefore that court on each and every date of hearing and\n\nwhenever and wherever called upon to do so till the\n\ncompletion of trial.\n\n      Several shortcomings and lacunae on the part of the\n\ninvestigating agency have been noticed by this Court during\n\nthe course of submissions in this case like making of incorrect\n                                          5\n\n     suggestions about pendency of criminal cases against the\n\n     petitioner without stating complete and correct facts and then,\n\n     of not taking up investigation in the cross-case with reasonable\n\n     expedition and of unnecessary delay.
